The phenomenon of missing dockets in Ghana's Judicial System is undoubtedly part of the cycle of corruption that has eaten into the System.
Most, if not all, of such instances of missing dockets are strongly believed to be deliberate attempts by Officials of the Courts to impede Justice. In fact, many high-profile cases including the Murder case of the Ya Naa and 40 members of his family, have suffered such manipulations to set the offenders free.
Many of the corruption charges brought against certain highly-placed individuals in Ghana have been thrown out of Court for similar reasons. Those cases were not dismissed based on the facts involved but on the technicality of some Official misplacing evidence or docket.
There is not doubt that monies and other favors would change hands in the process of hiding dockets to impact the outcome of Court cases.
In this case, however, we learn the docket has been recovered. But we may find out that certain incriminating documents have been taken out from the files to influence the case in one way or another.
Such is the state of our Justice System in Ghana, and partly the reason why we can hardly make any dent in eradicating Corruption all over the Country. Such malfeasance by Court Clerks, Judges and Attorney-General's Personnel makes mockery of our Democracy and Rule of Law.
