It is important to draw the attention of Citizens that the Electoral Commission is for Ghana and not for Government or the NDC. The 1992 Constitution which created the EC was enacted and adopted by the People of Ghana and it is aptly captured in the Preamble of the Constitution which is quoted below:
IN THE NAME OF THE ALMIGHTY GOD, WE THE PEOPLE OF GHANA, IN EXERCISE OF OUR NATURAL AND INALIENABLE RIGHT TO ESTABLISH A FRAMEWORK OF GOVERNMENT WHICH SHALL SECURE FOR OURSELVES AND POSTERITY THE BLESSINGS OF LIBERTY, EQUALITY OF OPPORTUNITY AND POSTERITY;
IN A SPIRIT OF FRIENSHIP AND PEACE WITH ALL PEOPLES OF THE WORLD;
AND IN SOLEMN DECLARATION AND AFFIRMATION OF OUR COMMITMENT TO;
FREEDOM, JUSTICE, PROBITY AND ACCOUNTABILITY;
THE PRINCIPLE THAT ALLPOWERS OF GOVERNMENT SPRING FROM THE SOVEREIGN WILL OF THE PEOPLE;
THE PRINCIPLE OF UNIVERSAL ADULT SUFFRAGE;

We the people of Ghana by extension created the Electoral Commission (EC) to serve our needs. The EC was not to lord over us. The Independence clothed around the EC which has been captured by Article 46 was to isolate it from manipulation by interested parties. But it is the view of the Framers of the Constitution that the EC will offer a level playing field for contestants to public offices. People who occupy elective public office have to be elected by the people in FAIR elections without any advantage to any party. Unfortunately the NDC and the GOVERNMENT want to abuse this basic requirement. But fair minded Ghanaians want to assure these groups of people that we shall resist this with our blood if it becomes necessary. We shall not allow any group of people to impose themselves on us through unfair process or illegitimate means. We have come very far from the fight for independence. I wish to suggest at this juncture that all the minority parties in the country should jointly present their position and confer with the International Community that in the event of any spill of blood or loss of any life in Ghana as a result of the bloated Voters Register, the Electoral Commissioner should be held responsible and should be put before trial at the International Court of Justice.
Now, what are the issues? It is a known fact the Voters Register (VR) has been bloated and this has been admitted by all the political parties and EC itself. The bloating was caused by the action of political parties to gain advantage. Are we saying this should be allowed to go? Is this what the Framers of the Constitution and we Ghanaians in our adoption of the Constitution agreed upon? The Answer is NO!
In our culture when there is disagreement someone who is considered neutral and fair minded is resorted to. The committee of eminent persons appointed by the EC has given their position on the VR and we are expected to go by it; otherwise why did we spend the taxpayers’ money to engage these people?
It is important to understand how Auditing works in Accounting where the term has been borrowed from. Auditing is done based on the Accounting Policies, Directors directive, Regulators directives, The Supervising Body of Accounting, Conventions adopted, Laws and so forth. So any Auditor working has the parameters within which he carries out the Audit.
Now in the case of the VR the only clear parameter which qualifies someone to vote has been provided by the 1992 Constitution under Article 42 – Every citizen of Ghana of eighteen years of age or above and of sound mind has the right to vote and is entitled to be registered as a voter for the purposes of public elections and referenda.
Looking at this Provision vis-a vis our circumstance as a country, it will be difficult to do an Audit instead of Validation after the compilation of a new register has been ignored. Someone will ask, how does one determine the qualification of a potential voter. This could be easily resolved if the politicians who contract the minors and Non-Ghanaians desist from this action. The NDC in cohort with the Government is the biggest culprit in this act thereby breaching the Constitution of Ghana.
Every person of Ghanaian extraction is known by someone and the age can be estimated if there is no documentary proof. Those minors who registered in 2012 have committed offense and could be prosecuted any time in spite that they have attained the age of majority now. I heard AsieduNketiah making the argument that those minors have attained the age of majority now so there was no reason calling for a fresh VR. This is ridiculous. Those people were induced with monies to vote for the NDC at the time and the NDC has the list of those minors as we speak today. They want to take the same advantage they took in 2012. There is no guarantee that those minors acting on their own conscious will vote for the NDC having attained the voting age now. We should not forget that the Constitution providesfor FREE and FAIR elections.
The Citizenship Law is not an Entrenched Provision and could be amended with Parliament initiating the process. I am proceeding on the basis that this Article has not been amended. The Constitution has outlined who a Ghanaian is and what happens for a Ghanaian to lose citizenship. Those people whose pictures have been on the Togolese roll as well our VR are eligible for prosecution and should be located and dealt with appropriately. What happened to one Dramani on the ticket of the NPP who contested MahamaAyariga for one of the Bawku seats? Was he not prosecuted for dual citizenship offense? These Non Ghanaians were also recruited and given money by the NDC to give them political advantage and the NDC has the list of them. Why should we allow other citizens to determine our fate as Ghanaians?
We are also learning of multiple registrations. I thought the Biometric registration was to prevent multi registration. How did it happen? If these are the challenges being faced by our electoral process, then Auditing cannot address the malaise. In the light of the challenges we have with the VR and the current level of awareness in VR, Validation is the best alternative aside compiling a fresh register. Let the EC know we are not ready to go into the 2016 elections with the defective VR. Despite the fact we have made the Commission independent, every Ghanaian’s input is required in making our electoral system effective. Inputs which are feasible and do not give any advantage to the contesting parties.
The minority parties especially the NPP is being advised it is easier to capture the polling station results in Excel Sheet, incorporating the right formula to sum the results. One can put filters into the sheet which makes it flexible to use.
To avoid transposition errors in the results, the minority parties should insist on photocopies of the sheet signed by the Polling Agents and Presiding Officer. And it should be agreed that any amendment to anything material on the sheet should be signed by all the parties as a proof of acceptance. This is commonly done in banking. The signed photocopies should be the primary record and the totals by the EC should agree with the summation of all the primary records whether the results were transmitted by STL.
If the NDC and the President want to win the 2016 elections, they should allow the people of Ghana who are qualified to vote to determine that. They should not be making skirmishes to gain electoral advantage. This signifies the lack of confidence in their performance for the past four years. The Constitution provides thatthe people reward the President and the Government by voting them for a second term based on performance and not stealing.
The dynamics for the 2016 election has changed and it will not be based on the 2012 issues – sympathy votes as a result of the death of the sitting President which has never happened in this country before, padding of votes by minors and Non Ghanaians and the belief the Vice President now President will perform well due to the several opportunities offered to him by the President then. One recalls Gordon Brown who was the Chancellor of the Exchequer during the presidency of Tony Blair in Britain. GB was touted as the brain behind the success of TB so the British people voted for him to become the President. He was a disappointment and was voted out. We are seeing the same play out in Ghana.
Now issues of corruption, mismanagement, economic conditions and the assassination of the sitting President will feature prominently.
I finally quote Article 1(1) to remind the Government - The Sovereignty of Ghana resides in the people of Ghana in whose name and for whose welfare the powers of government are to be exercised in the manner and within limits laid down in this Constitution
