Gambia does not have Supreme Court Judges. They rely on othr West African Commonwealth countries such as Ghana, Nigeria, and Sierra Leone to provide Judges for a sitting.
In this case Jammeh requested Sierra Leone and Nigeria to provide Gambia with Judges for the Petition.
Both Nigeria and Sierra Leone said their Judges are indisposed.
Which Judge should come and rule against your wishes only to be picked up and tortured in prison.
If your Electoral Commissioner have fled because he presided over an election and refused to call it for you against your wishes, which Judge in his right mind would be prepared to sit to hear your petition.
By your own acts you have caused this situation. Gambians say they no longer want you, please go.
And next time Lawyer Akuffo should read hiscase work well before making ignorant comments not backed by facts!

They were not there in the first place.

Jammeh accepted the results and unlawfully rescinded that acceptance, the judges left because they had reason to fear for their lives, surely any constitutional void had been created by Jammeh in refusing to accept the lawful count. Any legal formulation that allows somebody like Jammeh to profit from his own wrong-doing to exploit the constitutional vacuum thereby created, is mischievous, to say the least. No self-respecting lawyer should ever advance such spurious arguments with a straight face!

The Supreme Court judges never fled the country. There is only one SC judge in the Gambia and Yahya Jammeh is responsible for that situation and this permits him to 'import' SC judges from Sierra Leone and Nigeria to assist the sole Gambian to sit on cases. The Nigerian Judiciary are saying none of their SC judges are available now until May. Yahya Jammeh has not only crippled the country's Judiciary but all other state institutions I including the Military where the current CDS is just appointed from a very low rank and promoted above his seniors. Lawyer Akufo must understand that Yahya Jammeh came to power by overthrowing a Democratic Govt in a couple, abs so can't justify his prolong stay on the constitution. ECOWAS has tolerated this last dictator in the region for far too long. Why would Jammeh not allow the declared winner take office whilst he carries on with his Supreme Court appeal? That is the law
and both ECOWAS and the AU are right on this point.

No individual is greater than the State so Jammeh has no power to set aside the will of the people to satisfy his selfish interest.Diplomacy and War are both acceptable methods in international relations practice. Thus where diplomacy fails the second method must be used. HE SHOULD BE MOVED FROM POWER BY FORCE PERIOD.

Second, given the pedigree of Jammeh as a bloody putschist, it was prudent for the Justices of the Gambian Supreme Court to flee the Gambia for the safety of their lives. Let us call a spade a spade: Jammeh is a disgrace to democracy and rule of law in the Gambia,in particular, and Africa, as a whole.
