Nationality – Citizenship – Declaration of- determining the Citizenship of a person with apparent substantial connections in two countries-Ghana Nationality and Citizenship Act, 1957 (No. 1 of 1957), s.4 (1) – Ghana Nationality Degree, 1967 (N.L.C.D 191), paras.1(a), 2(1) (b) – British Nationality Act, 1948 (11 & 12 Geo. 6 c. 56).

The plaintiff received a letter from the Principal Secretary of the Ministry of Interior stating that his permission to remain in Ghana had been withdrawn and that he must leave Within 48 hours. Consequently he brought this action seeking a declaration that he was a citizen of Ghana by descent, that he could not therefore be deported from Ghana and that he required no permission from the defendant in order to remain in Ghana. The plaintiff presented evidence that: his father was born in Kpandu, his paternal grand-Mother was born and baptized in Keta, his mother was born and baptized in Keta, his maternal grandmother was born in Keta, and he was born in Lome on 1 April 1933. The evidence as to the Keta births and baptisms was presented by ancient documents. The plaintiff based his claim on paragraph 2(1)(b) of N.L.C.D.191, The defense called no evidence and relied solely on the evidence as presented by the plaintiff was a Ghanaian citizen by descent.

Held: the plaintiff’s mother, grandmother and great grandmother were all born in Keta and were British and Ghanaian citizens by virtue of N.L.C.D. 191 para. 1(a) No.1 of 1957, s.4(1) and British Nationality Act, 1948 Of (N.L.C.D)191, the plaintiff was a Ghanaian citizen by descent.

Declaration that plaintiff was

a citizen of Ghana.

Counse;

J. Quahie-Idum with him J.N Heward-Mills for the plaintiff.

Gyeko-Darko, Principal State Attorney (with him S. Sampong, Assistant State Attorney for the defendant.

Editorial Note: the Ghana Nationality Decree, 1967 (N.L.C.D.191), PROVIDES:

“1. person born in Ghana is a citizen of Ghana by birth: provided that-

(a) a person born in Ghana before the date of commencement of the Ghana Independence Act, 1957 (L.N.63) (i.e. the 6th day of March, 1957) shall not be a citizen by nature of this paragraph unless he was immediately before the 6th day of March, 1957 and within the meaning of the in force in Ghana on that date a citizen of the United Kingdom and Colonies or a British Protected person;

The above wording was that considered in the Olympio case; however, the Ghana Nationality (Amendment) Decree, 1969 (N.L.C.D) had amended it at the time of this action by the substitution for paragraph 1 of the following new paragraph:

“1. A person born in Ghana is a citizen of Ghana by birth if-

After his visit , Rwallings also made a historic visit to Togo after so many years but it was to late when he tried reconciliation with Eyadema. Rwallings before then was seen as the main ally to the then togolese opposition leader Gilchrist Olympio and Eyadema knew very well that Rwallings was the one who helpped Olympio by sending mercenaries to fight against his regim in Togo. That was where he Eyadema ordered the border autorities to close the Togo-Ghana borders some weeks before 2000 elections . Konadu keep quiet or you will expose your lovely and faithful husband 'secrets. Ghanaians vote in Togo and togolese vote in Ghana. Nigerians vote in Benin and beninois vote in Nigeria. Kenyians vote in Uganda and Tanzania and tanzanians and ugandese vote in Kenya. This is Africa for you. Untill we all have proper data for each country's citizenship , the syndrom will continue to afect our elections of leaders in Africa. This woman is just acting as if it is something new to us. It was there during your husband tenure of office what did you do to stop it . Hypocrite and witch. You were comfortable with your husband when he used the same method to win elections for you to be called first lady but it is now a crime for you. Not that it makes any difference to me. But it is most nauseating when ultra-selfish, egoistic folks like Konadu would only resort to spoiling the chances of others when they got fairly and squarely beaten in competition with the others.

What qualities has Konadu shown over the years to fit the qualifications of a President? She would not have been known much around the country had her Husband, Rawlings, not been riding the crest of our Politics for decades.

So, she gets angry that the NDC did not choose her for a Flagbearer, and leaves the Party to form her own, and then, begins to sabotage the NDC from all angles, huh?

If she did know all along that the NDC had registered Togolese but chose to be silent on it till now, Ghanaians should call her out as a selfish opportunistic saboteur who does not have to be welcomed to our Flagstaff House as its occupier.

She must be rejected by both the NPP and NDC. Her current moves to form a cozy alliance with the tin-god of Akyem, Akufo-Addo, the 'Patapaahene' of Ghana, must closely be watched.

Such a puerile sour losers solidarity between the two could deepen our Political landscape for the worse. We all know how Akufo-Addo has never taken his two-time flopping at the Presidency with any grace. He turned around to have his minions blame everyone else in NPP for his failures but himself and his Akyem Mafia.

That is what the two, Konadu and Akufo-Addo share in common. The two must learn to be real statesman and -woman, if they want to be given the chance to become President.
