Test the legal system on this issue and if they also agree with the government that it's ok to disregard and disrespect the court in this way, then their ruling will will set a precedent for the future. If the courts allow this disrespectful action to slide by, then we must as well kiss good bye to our democracy. This case has a huge implications for the survival of our democracy but it looks like our timid judicial system is so scared of the government that it has become totally impotent. US immigration will NEVER usurp the authority of the judicial system and deport a person while a court case is still pending. This thing only happens in a jungle country like Ghana where your government and security people have absolutely no respect for the judiciary. This is a hugely bad precedent being set if the judiciary doesn't drop the hammer heavily on these crooks. This smacks of total disrespect on the part of the government towards the judiciary.

Immigration can deport anyone unlawful entrant or homeland security can deal with anyone according to their legislative power but they can't usurp the power of the court in any real democracy.
Once you resort to the court, it is only the court that can make the final decision.....

You guys don't understand the issue here. It's not about the prerogative of the immigration service to deport illegal immigrants. There's no question about that. However, when there's a case before the court, they cannot deport until they withdraw the case. This can always be done in an instant when the subject is deemed a security threat. In most cases the withdrawal is done so fast that the lawyers of the subject won't even know it until the deportation is done. To the ordinary person on the street, it will seem that no legal recourse was followed. US is a country of laws and immigration will not blatantly flout a court order under the pretext of national security threat without going through the courts. It's not obvious to you but there is a standby judges all the time to accede to judicial issues at the blink of an eye. There's nothing to show that this happened in the case of the SA3, and that's the issue we are talking about.

(b) he has been found by a court to be destitute or without means of support or to be of unsound mind or mentally handicapped;
(c) he is a prohibited immigrant;
(d) he is in Ghana without a valid permit, or any of the conditions on which his permit was granted has been broken; or
(e) his presence in Ghana is in the opinion of the Minister not conducive to the public good.
(2) A recommendation for deportation is effective if it is made by a court upon conviction for an offence punishable by a term of imprisonment exceeding three months with or without a fine and
(a) on an appeal against the conviction, the appellate court has upheld the recommendation; or
(b) no appeal has been brought within the time allowed for appeal but the recommendation was made by—
(i) the High Court, or
(ii) an inferior court and has been approved by the Chief Justice.
