When Kwaku Baako informed us about the atrocities of Kwesi Pratt during PNDC Regime, some of us did not believe until the truth was confirmed during the NRC. Kwesi Pratt is the most dangerous Journalist Ghana had ever have, he had the gut to recommend his fellow journalists to be executed by PNDC. Pratt even recommended Baako to be killed by the regime, thank God Baako was instead touchered violently and severely but his life was spared. This is what Kwesi Pratt can do. Now Pratt is a secret agent to NDC and US Embassy in Ghana. May God forgive Pratt and spare him the untold evils that will come upon him and his generations. The souls of those journalist killed through Pratt's recommendations to PNDC will never forgive Pratt. Now Pratt has the guts to take Diplomatic Passport and smuggled his weak-headed children to work at the Ministries under Mills NDC, may God forgive Pratt and his dependance and spare them of the evils ahead of them...

They should reverse it, because this will create room for the criminal to operate and run away. And also injustice will increase

DEAR H.E>PRESIDENT OF GHANA DR>JOHN DRAMANI MAHAMA, HER LADYSHIP CHIEF JUSTICE OF GHANA GEORGINA THEODORA WOOD, HON.MINISTER OF JUSTICE & ATTORNEY GENERAL OF GHANA MARIETTA BREW APPIAH-OPPONG AND THE READING PUBLIC OF GHANAWEB.COM,
THIS IS TO RESPECTFULLY COMMENT ON THE ABOVE PUBLICATION CAPTIONED: "SUPREME COURT WAIVES PENALTY OVER BAIL BOND" AND IN VIEW OF THE ONEROUS DUTY AND RESPONSIBILITY BEHOOVE ON US AS LAWYERS TO PROTECT AND DEFEND THE CONSTITUTION AND THE RULE OF LAW THAT I AM RESPECTFULLY MAKING THE FOLLOWING LEGAL SUBMISSIONS FOR CONTEMPLATION AND CONSIDERATION< THERETO.
THAT AS GHANAIAN LAWYER/INTERNATIONAL LAWYER AND LEGAL CONSULTANT THAT IT IS AN OBLIGATION TO HELP PROTECT AND TO DEFEND GHANA 1992 CONSTITUTION AND THE RULE OF LAW.
THAT GHANA 1992 CONSTITUTION CLEARLY PROVIDES FOR THE SEPARATION OF POWERS OF THE JUDICIARY AND THE LEGISLATURE KNOWN AS PARLIAMENT OF GHANA.
THOUGH THERE SEEMS TO BE SOME RELATED FUSION OF THE LEGISLATURE AND THE EXECUTIVE, HOWEVER, THERE IS A CLEAR SEPARATION OF POWERS BETWEEN THE JUDICIARY AND PARLIAMENT OF GHANA.
THAT THE CONSTITUTION POWERS AND AUTHORITY CONFERRED BY GHANA 1992 CONSTITUTION ON PARLIAMENT "TO MAKE OR ENACT LAWS" AND THAT OF THE JUDICIARY "TO INTERPRET LAWS" AND THE EXECUTIVE "TO IMPLEMENT OR EXECUTE LAWS".
IT IS AT THESE RELATED BACKDROPS THAT I RESPECTFULLY DISAGREED WITH THE SUPREME COURT RULING THAT "STRUCK OUT THE PENALTY ASPECT OF SURETIES OF BAIL BOND".
THAT THE SUPREME COURT PURPORTED RULING WAS UNCONSTITUTIONAL IN THAT THE SUPREME COURT HAS NO CONSTITUTIONAL POWERS AND AUTHORITY "TO RE-WRITE THE LAWS OF GHANA SINCE THE SUPREME AUTHORITY IS TO INTERPRET THE LAWS AND TO PURPORT TO ARROGATE LAW MAKING POWERS AND PURPORTEDLY EXERCISED SUCH POWERS TO STRIKE OUT PART OF THE LAWS BEST CAN OR COULD BE DESCRIBED AS "JUDICIAL ACTIVISM AND LEGISLATING AT THE BENCH".
THAT THE SUPREME COURT OF GHANA CAN OR COULD "REMAND THAT PART OF THE LAW FOR REVIEW TO PARLIAMENT OF GHANA" BUT TO PURPORT TO STRIKE OUT THAT PART OF THE LAW WAS UNCONSTITUTIONAL AND TO BE DEEM AS AN ACT OF NULLITY.
THAT THERE IS THE NEED FOR GHANA JURISPRUDENCE TO DEVELOP BY LAWYERS RESORTING TO THE PROTECTION OF THE CONSTITUTION AND THE RULE OF LAW.
RESPECTFULLY SUBMITTED>
GOD BLESS GHANA AND AMERICA.
VERY TRULY YOURS,
BENONY TONY AMEKUDZI, ESQ.
