SOURCE: myjoyonline.com------Executive Director of the National Anticorruption Action Plan (NACAP) says they would be compelled to go to court to demand accountability from government over its failure to retrieve monies wrongly paid to individuals in judgement debt.

Mrs. Linda Ofori Kwafo is baffled at government’s lackadaisical approach to pursuing beneficiaries of such monies.

The anticorruption campaigner was speaking on the Super Morning Show, Tuesday, December 9, 2014 in connection with the announcement by Deputy Attorney-General Dominic Ayine government that Gh?14.5million had been retrieved as part of the illegal money paid to contractors of the Ghana Youth Employment and Entrepreneurial Agency (GYEEDA).

President Mahama at a conference organized by NACAP on Monday, also disclosed that about 300 people have either been convicted or are facing trial for corruption-related offenses in Ghana since 2013.

“It is disheartening…We need a breakdown of the information they put across there,” Mrs. Ofori Kwafo retorted. According to her, “ the GYEEDA case is small”.

She recalled the “good cases” won in court by former Attorney-General Martin Amidu in which individuals and organisations that benefited from such wrongful payments were ordered by the Supreme Court to return the monies to the state.

The Supreme Court in June 14, 2013, ordered Waterville Holdings Ltd. to return to the state in excess of 21million Euros obtained illegally arising out of claims it brought against the state in 2009. A week after, the court again ordered businessman Alfred Woyome to refund a total of Gh?51.2 million judgement debt payment he received between 2009 and 2010.

The Court in another landmark judgment on July 29, 2014, ruled that Spanish-based Company, Isofoton pay back to the state a total of $325,472 and the interest accrued on the amount since 2011- the year in which the monies were paid.

“The amounts involved are huge…we need such monies to move our economies forward and government officials are silent on them,” the NACAP Executive Director questioned.

“Civil Society Organisations want to make the recovery of such monies…they should give us the detailed breakdown for us to know the progress that we are making.

“We cannot go and collect the monies; the state has a responsibility…we need the resources,” she demanded.

She hints the Civil Society Organisations will not hesitate to choose the option of “going to court and demanding for accountability so far us government’s responsibility in the fight against corruption is concerned”.

“We have also signed onto the United Nations Convention Against Corruption, which actually mandates us to be able to recover stolen assets that have been hidden outside this country. If within the borders of our own nation we cannot retrieve monies then how well would we able to retrieve [stolen state funds lodged] in Swiss banks and the rest?

“It’s no wonder, therefore, when citizens say that…they don’t actually have trust and confidence in government’s ability to fight corruption,” she told Kojo Yankson, host of the Show.

When the Minority in parliament ignorantly accused the IMF and the government of the bail out to the government for not seeking parliamentary approval before the deal,the IMF being knowledgeable organization simply told them it is not their business to go to the parliament of Ghana before they give money to the government, which shows how bogus the Supreme Court ruling is,the NPP that started the deal with these people and organizations should have been the one seeking parliamentary approval but not the contractors but our Supreme Court that rules with emotions ruled in favor of the government knowing very well that it is not contractors that seek approval for loans or contracts but rather the government.

It was these same NPP government that used the court to jail some former NDC officials for not seeking board approvals before guaranteeing loans for organizations using the people or the organizations that benefited from those deals as witnesses against those who signed the deals,which shows the type of Justice system we have in Ghana.

Sometimes I wonder how Martin Amidu became Attorney General given his pathetic understanding of Law. Government is enjoined to follow the law. Government is not supposed to desire the conviction of somebody. The moment a Government desires somebody'S conviction, it prosecution will become capricious and malicious. This is what the law is against and yet we have a so called Lawyer who calls himself experience making such an illegal statement.

The longer he has the money the more profit/interest he makes so when he returns some money it means nothing to him as it is just done if his profit - ie he has had a free koan for years .

It would be recalled the criminal Woyome sounded a direct warning to John Mahama that, should he allow anybody to convict him for the stealing perpetrated on the national purse using the non-existent contract, people including John Mahama will runaway from this country. It was a direct threat.
Today, Woyome has not only not refunded the stolen money as ruled by the highest court of the land, the Supreme Court, he is walking around freely thumping his nose at the Supreme Court ruling with John Mahama flouting the ruling also with impunity, and Ajet who gave the fraudulent judgment has also absconded from this country, and cannot be found anywhere.
The Min of Interior Woyongo claims he does not know where he is, the former IGP Alhassan claims he does not know where he is, it sure will be difficult for the acting IGP Kudalor to know where he is, the Minister of Justice Brew Appiah Oppong does not know where he is, and President John Dramani Mahama does not know where he is.
Ajet has effectively become an apparition after he was caught in a sting operation of haggling, bargaining and selling justice, akin to a tabletop tomatoes business at Makola market.
This is what you get when a country is governed by dangerous thieves parading as politicians.
Thievery has become like a fanatical religion adhered to strongly to the point of extremism by the John Mahama NDC gov't and Ghana is a goner.
Change must come to Ghana in 2016. It is an absolute must and a critical imperative.
Our brothers and Sisters in Nigeria set the tone by bringing Gen. Muhammadu Buhari to teach corruption a very severe and bitter lesson in Nigeria, and by so doing, put the country on the right track.
Barely 6 months into the administration of Gen Muhammadu Buhari of Nigeria and Nigerians deciding to break with the specter of thievery and corruption, they are reaping very tangible and positive dividends.
This is the way to go and Change must come to Ghana in 2016 by massively firing the John Dramani Mahama NDC gov't of everything thievery. Enough is enough!!!.
