Why would the insurance company pay the lien holder anyway when the driver is the principal insurance holder? If the driver were injured in an accident would the insurers have paid to the financier? I don't know the terms of the agreement but there is no moral in the company taking the money and not replacing the car.

This is interesting. What every borrower in a case like this one should understand is that you don't own the vehicle until it's paid off in full. The driver was just that, a driver. He didn't own the vehicle at the time of the accident. His name name was not on the title of the vehicle, reason why the insurance company made good by making payment to the micro finance company.

He was even lucky the vehicle had complehensive full coverage else the micro finance company could have sue him for the difference and balance of the total cost of the vehicle. All the monthly payments he made were for the luxury of him ridding in a brand new car. He has no case. Period!

My query though is - whilst you sympathize with the Driver, the finance company me be well within their rights in context of the contract, if the contract terms did not provide for mediation of arbitration by the ex president. I wonder if the judge's position would have been different, had the unilaterally elected mediator been someone else other than JJ. God help Ghana.

Now, the 12 months contributed by Taxi driver is in tact. Therefore, if the Taxi driver would be given a new Car then he should be allowed to continue from that level of payment. Otherwise he has been cheated by the company since the insurance has paid in full the full cost of the first car.

Folks, this is simple logic. The vehicle doesn't belong to the driver. Period! Until full payment is made and titled issued in your name, you don't own the vehicle. Got that???? You making monthly payments because you had an agreement with the Microfinance to loan you money. If that money is used to buy you a vehicle, you are required and bound by the agreement to cover the vehicle with full coverage and complehensive insurance in case of accident so the micro finance will get their money they loaned you back. Where is the cheating here? Come on folks! The driver was even lucky he had the right insurance coverage. Else the micro finance could have sue him in court for total refund of the vehicle. The driver's attorneys should know better and advice their client. He has no case. Period!

If the car was insured and then it got written off then Enterprise Insurance is suppose to pay for the value of the car at the time of the accident so that could be used to defray the cost of the car to the borrower.

I feel sympathy for Mr. Fio Yohannes for his lost but anything outside a contract document do not have a place in court of arbitration. Ex-President Rawlings in the first place should not have poked his nose into this matter at all as he is not party to the main contract between Mr. Yohannes and Microfinance Company.

It was stated somewhere in the article that Mr. Yohannes made an initial deposit or down-payment of GHC2400 towards this Hire-Purchase deal which was recorded in the Contract Document that should anything go contrary, that will be his compensation.

Let it be clear that as far as there is lien on the Car, Mr. Yohannes is not the owner and all income and liabilities goes to the Microfinance Company until the last installment is paid before Mr. Yohannes becomes the bona fide owner. Though he was paying his monthly installments towards the purchase plan as well as his insurance policy, he cannot claim any money from the Microfinance Company.

The Insurance Company is not going to pay the initial cost value of the vehicle to the Microfinance Company but rather a depreciated value which will be a loss to them (Microfinance) Company. It is hard to start again though but Mr. Yohannes should accept the deal of getting a new vehicle from the Microfinance Company and start again.

Justice Batu exercised a poor judgment for allowing Ex President Rawlings name to be dragged into this case as he (Rawlings) does not have any role to play in it all. The counsel for Mr. Yohannes, Madam Hanifa Yahaya do not have a case to win. E&OE.

Ghana International Airways passengers are still owed their refunds. Why hasn't JJ Rawlings the champion of Victims spoken to President Mahama, Ministry of Transport or helped their case in court. It affected more Ghanaians including single parents than this case
