To acquit the doctor on the more substantive case of having an unnatural carnal knowledge of the victim but jail him on defilement of a minor, when both people involved are males, judge Budu has created a perfect exit door for the doctor to walk through on appeal or have his sentence substantially reduced.

How did Dr. Ali Gabass defile the kid without having sex with him? The judge has technically made nonsense of "unnatural carnal knowledge" which is euphemism for homosexual sex. Did they just have oral sex, is that what the judge is suggesting?

Dr Ali Gabass is going to walk free on appeal, you mark my words. This whole thing of "defilement without unnatural carnal knowledge" does not make sense.

It's certain pepeni's nature of life that reflects his personal behaviour and therefore there's no way Mahama is a foolish and lawless man. Don't forget this cow is also sensational when it comes to dog meat over human life. The cause of these economic woes is Mahama's tribalism, nepotism, incompetence , selfishness, corruption and insane desire to rule at all costs . Just as the the Mayans of south America killed their leaders and ate their brains so pepeni killed the ideologist of the ndc Atta Mills to sit on his throne, didnt matter that he had no clue of how to build or develop a nation .He started by appointing mainly northerners who are as corrupt and incompetent as himself, where he appointed some one from another tribe he made sure he shadowed them with a pepeni chief director or deputy minister. In-fact half of these northerners by another strange twist are also actually related to him eg deputy minister of transport or chief director of our failing miserably Finance ministry. A president who can not trust or accept the citizens of the land and appoint people based on merit and competence is no president of mine and will surely fail .He then appointed his pepeni and intellectually inferior ministers so no one could challenge him or call him to order, what he desires the most is an authoritarian dictatorship so that's he secured obedience and loyalty at the expense of the constitution and the interests of the people. How many private sector investors have been rejected because they will or cant pay the bribes ? Without private capital govt borrowing only creates debt . He was not able to mobilize our last resource the diaspora to come and invest as when NDC came they made sure most of the business community incurred huge losses through abrogation of contracts , corruption and inflation of the cedi. First we had Kuffour who spent his 8 years of sophisticated corruption that made us loose control of our natural resources such as our gold and oil , then we had anther sorrow of an Ashanti minister of finance Duffuor whose was put there just to satisfy the balance of tribal politics but wrecked the economy by increasing govt borrowing and now advocated for hedging/gambling our oil , i wonder why they didn't first sell the golden stool or at least hedge it for the betterment of all of Ghana, no worries , when the war comes the stool will go for sure . Nkrumah allowed the primitive northerners and ewes to join Ghana in the hope that he could secure himself president for life with a dictatorship , had the USA allowed Mexico and all the other south American states to become part of their country they would never have developed as all that would have been their focus would be to rule even though they are not socially or intellectually ready to develop.Now its clear to all war is around the corner and elections may only turn out to be the spark that will bring about a fierce ethnic conflict leading to the breakup of the country as should have been over 100 years ago.

According to the report, the Judge found the accused guilty of defiling the complainant or victim but not guilty of having unnatural carnal knowledge. since the victim is a boy, then if he was defiled by the accused who is a man then it is assumed that there was anal sex which is referred to as unnatural carnal knowledge or sodomy.

My question is can a boy be defiled by a man without there being unnatural carnal knowledge? Was there penetration of the boy by the man or not? If there was penetration, then of course, unnatural carnal knowledge occurred, unless there was only oral sex.

The judgement is contradictory and does not make sense to be discharged on the second charge of unnatural carnal knowledge, if really the man is guilty of defiling the boy. How did he defile him without penetration of his penis into the boy's anus? I guess it was established in court there was only oral sex.

Our cultural set up is expressed to generally undermine the practice mainly because our ancestors knew of the untold problems associated with it.
His practice without have been generally ignored by even the police if it was between two consenting adults.
He abused a child and he has been duly punished for it, but to be fair we can not stop his sexuality as long as it has no direct effect on anyone.

I don't hate gays but I just don't like their aggressive stand to equally force everyone to accept and understand them.

That means if the Dr was to sleep witha 20 year old male , then it was accepted. This is bad judgement.

25 years for defilement, 25 years for unnatural carnal knowledge, 25 years for engaging in homosexuality, 25 years for infecting victim with HIV etc. etc all to run concurrently would still amount to 25 years. Meanwhile, Gabass' legal team was arguing that their client is HIV-negative so he couldn't be accused on that issue.

At the end of the day, what are we looking for? That the accused is put behind bars for being an enemy of the state. Finished!

The law is about unatural canal knowledge, so you get acquited when you are able to prove that havingt sex thru the anus is NATURAL. I think that was exactly what the gay doctor's defense team was able to do. In anycase, honestly speaking, homosexualism has become natural in the world today as it is practised and accepted in some countries. If our leaders in Ghana, Mahama and his people, are truly not for homosexualism, then they should do something about the law as it stands now to criminilise the act. Sorry to inform you that quite a number of very important personalities in Ghana are for this abominable act so they will not do anything to change the law to criminalise homosexualism.

After reading Brown's contribution in this very section, I realize that the judge used her discretion in this case. The minimum is 5 years, and the maximum is 25 years.

Given the denial by the accused, I am wondering if this will be appealed. In other words, if he is discharged on the carnal knowledge part, can he be convicted of the statutory rape part?

I still commend the judge for the bold move.

But better still WHY would you allow your desires to harm someone you LOVE? IF AN AGREEMENT CAN'T BE REACHED, BE SELF-DISCIPLINED & SACRIFICE DESIRES FOR THE SEEK OF LOVE.
I believe a CONSENSUAL LOVELY SEXUAL ACT or ACTS has NO BOUNDS.
So after doing all these in PRIVACY as it should [i.e. couples who engage in ANAL & ORAL sex], how different is that from GAYISM?
Truthfully there is, 'Hetro' sexual acts gives 'BUY ONE GET ONE FREE' but 'Homo' does not.
'aaaah!, so why would i go GAY? if not only in terms of a mere idiomatic expression'
