Dr Gyampo has made a very important constitutional point. It did not occur to me that the head of NCCE also enjoys security of term of office similar to the heads of EC and CHRAJ. I agree with him because by this appointment of moving the head of NCCE to EC, if allowed to stand unchallenged, President Mahama could get away with murder and manipulate the constitutional restrictions and remove the security of office granted by the constitution. It’s a dangerous precedent and should be rejected. In fact, it could be unconstitutional because once appointed the president has no powers to remove or reassign the appointees without due process. In the future, another president could reassign her back to NCCE and Ghana would be threading into dangerous waters.
Regarding the view that “it is customary and a time-tested convention that when a matter is in court no action is to be taken on it”, Dr Gyampong is wrong and there is no such convention anywhere in the world for reasons I provided in my article on Ghanaweb yesterday. For example, whilst the same sex marriage suit before the Supreme Court, it did not stop some state from banning or legalising same sex marriage.

The President cannot dismiss without due process as in the case of the CHRAJ Boss, Ms Lauretta Lamptey who is currently going through investigation for abuse of office. If what the president has done is allowed to stand, then a future NPP administration can easily move her to another position of similar nature and appoint a new EC head. In fact, it is not in the best interest of the Mrs Osei. It makes her new position insecure. To avoid future manipulation of the constitutional appointment, the president should rescind his decision and appoint a different person. Otherwise, it should be challenged at the SC. This never came to my mind until I read Dr Gyampo's views. Probably, I was unaware that NCCE head is also constitutionally protected position. It's not part of the executive where the president has the prerogative to sheffule his appointees.

Under pressure he had to write to the Chief Justice for her to call investigation into the activities of Ms Lamptey before she was asked to step aside for her deputy to act in her place up until investigation is over and I belive she is still in her official residence enjoying her full benefits,she is still the boss if she has not yet resigned.
Mr Gyampo raised an important issue a lot of people including the presidency overlooked in the appointment of this lady,the president cannot transfer anybody from any of the three institutions,if we allow that to stand somebody may come to transfer the CHRAJ boss and her and even the Chief Justice.
They better revoke that appointment and let her stay at where she is,resign and then appointed EC boss if she is the only person that position is reserved for.
Let us put politics aside and do the right thing to avoid creating a mess in future.

I don't see anywhere in the Constitution where it indicates that someone with a secure tenure cannot be offered another appointment. With all these hoopla, if the person is not concurrently functioning in the two outfits, isn't all that needs be done is to have him or her resign to be reappointed? It would be up to that individual to either accept the new position or not. While you may call such shift in Positions as a reshuffle, some may see it simply as reappointment in which case, a resignation from the previous Office would be presupposed.
The Constitution does not condemn appointees to these secure positions to get stuck there indefinitely, against their will. In either case, they would be serving the State. So, why should it be unconstitutional to have them serve in positions that may extract their best services to the Nation?
We have more crucial things to worry about that any such strict adherence to the letter, or some norm, are more needed. For example, the strict adherence to various implementation of our criminal code. Another is the Constitutional demand that all Officials declare their assets prior to and after service, and our requisite Authorities scrutinizing these Officials at their point of exit to see if they did accumulate any excessive wealth dubiously while in Office, and then prosecuted for applicable crime.

1. Samuel Atta Akyea decided to to go to court to obtain an injection stopping the EC in 2008 to conduct an election in the B/A region when the party realised the NPP was losing the 2008 elections.
2. Nana Akufo Addo, Dr Bawumiah & Obitesbi Lamptey went to Court apparently to stop the EC, Dr. Afari Djan from declaring President Mahama as having won the 2012 Elections. They eventually went to the Supreme Court challenging the results of the Election results. They lost miserably.
I REALLY THINK THAT THE NPP IS VERY GOOD IN OPPOSITION, AND SO WILL REMAIN FOR A LONG TIME TO COME. IN FACT GHANA NEEDS THE NPP IN OPPOSITION.

There is nothing in the constitution that says the president cannot appoint NDC member or a member of a political party to that position.

With regards to what the professor said,I think he made a valid point,transferring the lady from that position which is equivalent to where she is going could mean she can be transferred from the EC too,it seems those who advised the president to make that error didn't think about that,she did not resign from NCCE which means she is being transferred,the man is smart on that.

This lady is ALREADY a head of a constitutional body just like EC, wasn't any Ghanaian beside her, qualified for the EC position while this lady remained at her former post?
Now concerning the appointment of EC, the constitution is ambiguous, when it says the president shall appoint such individual upon CONSULTATION with the Council of State. The obvious question is, what does "CONSULTATION" mean in this particular context? Does the president and the council put in "equal efforts" in seeking, and appointing the person in question, or the president appoints, and then "consults" the council after that for "agreement"?
As a matter of fact President Mahama is ALWAYS by action and implications exhibit ARROGANCE. The smartest decision would have been for him to WAIT for the case before the honourable justices for clarification on the wording of the constitution before appointing the EC head. But it doesn't surprise me because he's a member of a group that has NO REGARD for the CONSTITUTION and LAW. This is a man who said he'll "kill an ant with a BULLDOZER", apparently in response to Pres. Kufour's argument that justice should be measured against the corresponding misdeed.
If NDC cannot transform itself from its treasonable leaning to a DEMOCRATIC then it has no place in our political advancement.

The whole constitution written as a quasi-dictatorship document for the military despot transitioning from military rule to a democracy, critically, needs to be re-examined, reviewed, rewritten and realigned with the proper dictates and construct of a proper democracy. It is such a flawed document as to have any right and proper application in our democratic dispensation and it's relevance is increasingly becoming suspect. The document is not working and the ambiguities makes it imperative, it is looked at again. The CRC's work needs to be done again and those entrenched clauses as well as all those other clauses need to be reviewed singly, to create a proper and true constitutional document that serves the purposes of a right and proper democracy.
This is another test for the Supreme Court to bring clarity to an ambiguous provision which is underpinned by dictatorial tendencies within the context of the application of article 70(2) when looked at literally, as a process whose powers is vested in the President, who happens to be a major player and beneficiary in the electoral process, aside of the other issues raised by Gyampo, Ransford, Phd.
That is not the case with other constitutions in other jurisdictions even within the continent, and it needs to be looked at and rectified to engender that kind of trust, integrity, acceptability, confidence and complete buy-in by all in a spirit of transparency. It should be the natural norm and not an effect or benevolence of the status quo in this case, the governing.

Nobody's mind went to this issues the lecturer has just raised and if indeed it's through then it tell you how weak the council of state is in studying the subject mater and subsequently advising the president on it.This is a breach of contract and I this it should be tested in court,before her appointment,a lot of public debate had gone on regarding the appointment already and should've drawn the attention of the council of states attend to doing a good job.

Anyway Dr Gyampo's comment is quite insightful. A future government that does not feel comfortable with an EC chair easily transfer her/him and shift another Chairperson to the EC. So for instance if NPP comes to power and apppoints a CHRAJ Commissioner after say the death or retirement of an incumbent, the President could after a while "reshuffle" these Commissioners. A bad precedent indeed.

Please have you considered the removal Clause of an unfit Life Term Official in the Republic of Ghana as stipulated in the 1992 Constitution? Second, have you thoroughly read and understood Article 70(2) of the Constitution in juxtaposition with Article 91(3) of the Constitution ? As an astute Constitutional Law Professor will it not have been Prudent , knowing how intricate the Nomination Process , have by sought of Freedom of Information or by Court Brief initiated a Motion to Ask the Speaker of Parliament for an unequivocal explanation of the Article in question or even for the sake of your students file a motion before the Supreme Court for clarification and interpretation of the said Article well before the issue with current case the of the EC ? You know what ? The United States Supreme Court Justices serve for Life so also are the Appeals Court Judges , but a Republican President can seek the Nomination and Approval of a An Appeals Court Judge to the position of Supreme Court Justice by a Republican controlled Senate and at time same a life term Justice can be impeached by a Democratic controlled Congress And removed by the Senate irrespective of majority control all based on the magnitude of the Impeachable Offense.

If she was deemed suitable by the president, it does not make it a transfer simply because she was the head of NCCE. If another president in the future feels a NCCE boss is good for EC boss position in the future when she is no longer there, it is absolutely fine to give the position to that individual.

Contrary to the childish claim that the woman is an NDC affiliate, this noble Professor has exposed some of the dangers and flaws in our constitutional practice. He is also arguing about the spirit behind every law. He has made a lot of sense in the fact that a bad precedent has been set. If he will be prepared to go to court over this, I will personally fund him.

In fact, others with similar expertise or even general understanding of the intent of the Constitution could argue to shoot down the Professor's opinion. Those opposing him would not necessarily be ignorant, would they? When it comes to interpretation of the Constitution, different experts often bring different interpretations to some part thereof, often drawing on a perceived intent of the original crafters of the Law.
So, chill a little bit, Beatrice. I would fully agree with you that those insulting him are being uncouth, and are not helping to advance the process of brainstorming for better Ghana. But the your idea that folks are all ignorant who dare challenge the Professor's opinion is wrong.
