Since the case is between the state and KKD and not between Efe and KKD, the state can proceed to court but with Efe not willing to testify and the state lacking forensic evidence, proceeding to court without Efe testimony is an exercise in futility.

The state has a weak case even with Efe willing to testify andnow that she is not willing to proceed with the case, the state will be wasting taxpayers money if they take this case to court.

The lawyer is wrong, the state cannot force Efe to testify and his assertion that the state can call Ewe as a Prosecution witness of a complainant unwilling to proceed with a case is not true, the state cannot force her to testify.

What the state can try to charge her for is filing a false report but Efe has not recanted her rape accusation, she is just saying she doesn't want to continue with the case and that is her right.

The state though can continue to prosecute the case if they think they can get a conviction without Efe's testimony.

Civil cases can be withdrawn by either party at any time from the courts before judgement is pronounced by the judge.
RAPE cases are CRIMINAL CASES; THE STATE vrs. THE ACCUSED.
The complainant in this case is not a party to the case. The parties are : the THE REPUBLIC vrs KKD.

The Republic of Ghana should therefore continue with the case. The lady in question could be used as a Prosecution Witness, possibly as PW1. If the lady refuses to appear in court as a prosecution witness, then that is another matter.
Other people who were in the bedroom while the act was going on in the bathroom could also be used as witnesses.
We want to see this case continued in court to its logical conclusion.
If the lady refuses to appear in court and for lack of evidence the case falls, then this is another matter, The lady provided written statement to the Police and therefore this must be used.
NEXT TIME IT WILL BE A MURDER CASE AND RELATIVES OF THE DECEASED WOULD WRITE TO SAY THEY WANT TO WITHDRAW THE CASE FROM COURT AFTER THE ACCUSED HAD PAID MONIES TO DECEASED FAMILY.

In any case in situations where the AG has been ordered to retrieve money illegally paid through judgement debt, they have failed to do so 2 years on. How on earth would they have the expertise and guts to go chasing an alleged rape victim. They sound like empty barrels, they just wanting to show some teeth, no bite!

If not, what if an expectant one reports you for rape because you did not marry her, causing your arrest? Have you thought of how many men could be incarcerated if women capitalize on this issue? It could be you anytime so be on the lookout. However, when the time comes refuse bail or freedom till it gets to its logical conclusion. Tell them its a case of the REPUBLIC VRS DAVID AMOAH so you want to be in jail till the end because rape is not a bailable offence by law.

The media in particular rallied behind KKD, who is one of them, so much so that any story contrary to KKD's version was drowned. The young lady was outed by the media who flashed her photograph around without shame. The media went further to provide her residential address. No one can convince me the media were oblivious to their actions. Women advocacy groups were deafeningly silent while Ms Thompson was pummeled by the press. Even the female media presenters did not rally around her. Where was the outrage of female parliamentarians while KKD's attack dogs were in action. As for the media commission and GJA, the less said about them the better.

This lawyer should rather focus on how all well minded Ghanaian lawyers which he claimed to be should come together and fight to retrieve all dubious judgement debt payments, but I wonder if he has not even benefited from one.

The chain of events does not augur well for other males or females who get accused of similar wrongdoing or become victim of alleged indignation respectively. I would have preferred KKD to defend himself, prove his innocence and counter sue the woman for the shame inflicted on him.

On the other hand, there would have been more credibility if the woman had defended the offence she reported in court and won. She would forever remain as the woman who had consensual sex with a famous man and reported it as rape.

In the process I sleep with say 10 of them. As conscenting adults. A few years pass and 1 of them cries rape for one reason or the other. Then for another reason of the other (and I can name plenty), 3 of my ex flings join the rape case. As a man, what is my defense? Yes, I have been immoral, and that's my choice. But when did immorality equal RAPE! In today's world, that is what is happening now. No one knows what happened in KKD's situation but he will forever be labelled a rapist. How unfair on the man of today is that?
