Yesterday when the State through the A-G's Department failed to Appear in Court, I predicted the OUTCOME that has now come to PASS.

In every CIVILIZED SOCIETY, sometimes to serve the ends of Justice and gain RESPECT from World Opinion, No Matter people's CONNECTIONS and STANDING in Society, Courts BITE and BITE HARD to send STRONG SIGNALS to ALL that no matter your 'Connections' the law will NOT FAVOR you and MUST be Interpreted in a manner NOT inconsistent with its PREVIOUS APPLICATION that will be a CLEAR Departure from PRECEDENCE, which Departure, if it must Occur, MUST be Compelling enough to stand SCRUTINY.

The following is what I submitted on this issue yesterday:

"I am NOT SURPRISED the Attorney General's Department was not represented in Court, but I AM only SHOCKED that they will PLAY this CARD this early in the Court Process.

We all knew from day one that in view of some of the persons arrested in this matter and their connections to the Powers that Be, it was only a MATTER of TIME that the State would behave in a manner that will COMPEL the court to Admit the Accused to Bail.

How can the A-G's office NOT show up in such a case that the WHOLE WORLD seems to be interested in?

It is part of the Strategy of those High-Up in the system to Frustrate the Court Process to the extent that the Judge will have NO CHOICE but to release the Accused persons on Bail.

In a CRIMINAL Proceeding such as this case, The State versus Alhaji et al, the accused persons are considered INNOCENT until PROVEN Guilty. Bail was Imposed Presumptively, but not to the extent that the Accused Persons will be DENIED the LIBERTIES unreasonably.

If the State is not showing up in Court to PROFFER as to why the Court must continue to hold the Accused Persons, the Judge, PROCEDURALLY, cannot continue to RESTRAIN their Liberties.

Remember that a CRIMINAL Proceeding is an ADVERSERIAL process. You Cannot ACCUSE people of a CRIME, take them to Court and seek their DETENTION and not appear in Court to explain why FURTHER DETENTION is necessary. Under the Guidance of Criminal Procedure, you leave the Judge with no OPTION but to ADMIT the SUSPECTS to BAIL.

The Judge in the FIRST INSTANCE of a NO-SHOW by the AG's Department, KNOWING that the WHOLE WORLD has an INTEREST in the OUTCOME of this Matter, will seem to be CONSTRAINED in granting Bail. But it is ALL PART of the GRAND SCHEME.

The A-G's Department has ALWAYS Appeared in Court on the MUCH Lesser Charge of Illegal Acquisition of a Passport by Eric Amoateng. So Why CAN'T the A-G send even a MESSENGER to the Court to explain why the State would not be represented and Give REASONS in writing explaining why further Detention of the Accused Persons was necessary?

This is a REAL SHAME, and if I were the British Government I would WITH-HOLD Any AID if this GRAND SCHEME being PLAYED to the GALLERY is allowed to Prevail and the ACCUSED are EVENTUALLY FREED, and the State FAILS To PROSECUTE, which OUTCOME has been SUSPECTED from DAY ONE and has COMMENCED by the A-G's NO SHOW."

To say that the Suspects are ONLY Charged with ABETMENT of CRIME, is DISINGENIOUS and Pure HOGWASH, to say the least.

FACILITATORS of CRIMINAL ACTS are as DEEP in it and equally CULPABLE as those who get caught in the ACT. This is even more Important when you consider that Most of these DRUG Offenses are committed by 'MULES', people offered something small to be Couriers. Somebody made it possible for the Mule to TRAFFICK the DRUGS because he lacked the Resources to DO it alone.

It is settled in the LAW under the Doctrine of 'The DEEP POCKET THEORY' that if you want to HELP SOCIETY rid itself of or Minimize Wrong Doing, Its Laws must hit where it hurts most. That is why if a Driver causes Damage to your Property, you go after the Owner of the Vehicle, and NOT the Driver.

I can safely CONCLUDE that BUT for the assistance of those who have been admitted to Bail, Ruby Adu-Gyamfi, in all likelihood, could NOT have succeeded in getting the DRUGS on to the PLANE and subsequently out of the Country to the UK.
