How can the Court on the hand issue an INJUNCTION that takes immediate effect until the FINAL determination of the case, and then turn around to ADJOURN the Case SINE DIE?
If what is reported is the Court's Ruling, then I am afraid to say that the Ruling is DUPLICITOUS.
According to the Judge "he could not readily establish any constitutional provision that guarantees workers the right to strike". Some may argue with this to the extent that if Lawyers for the Unions failed to Raise POINTS of LAW and AUTHORITIES in support of their Motion, the Judge as an ARBITER, is a Referee whose ROLE is to make sure FAIRNESS Prevails and can seek to achieve that Fairness by other routes available to the Court.
One way to achieve that FAIRNESS is to set the matter up for another hearing in the not so distant future to determine the Constitutionality or Otherwise of the RELEVANT and MATERIAL Issue of whether or NOT the Unions can strike. This approach has the PROPENSITY of THAWING Sentiments and making COOL HEADS Prevail.
As things stand, and knowing what goes on at Public Work Places, it is the Ghanaian Taxpayer, who accesses Services at any of the Striking Institutions who will SUFFER. I can see these workers reporting to work and DOING NOTHING. I can see them, when they PRETEND to be working, frustrating those who they are paid to serve. And I can see the Govt. doing NOTHING about that NONCHALANT Attitude.
Of course, when Ministers and Senior Govt. Officials or Party Bigwigs and those Bearing 'NOTES of the POWERS that Be' go to these Institutions, they will be served alright and in a manner so as to NOT INCUR the DISPLEASURE of the Power Brokers. But what about your Average Esi Ghana or Kodjo Brokeman?
We must NOT always look to POLITICAL EXPEDIENCY for an EASY WAY OUT. We must consider NOT ONLY the PROBATIVE VALUE of the Decisions we make BUT also their PREJUDICIAL EFFECTS. When we do that we can come to a BALANCE that makes sense and brings on Board ALL FEUDING PARTIES.
The Substantive Issue, which is who gets to be the TRUSTEE of the TIER 2 Pension Funds, is still BEGGING for ANSWERS.

They have no problem with their pay; they are not complaining that their colleagues who have gone on retirement are not receiving their pensions; what they are complaining about is that they want to be involved in selecting the company that manages their pension deductions as if that will add anything to their pensions. Workers' pensions are calculated based on a formula that is not affected by who manages the pension fund. This formula is not affected even by the interests, profits or losses that are made on any investments made on the fund. It is thus very trivial for workers to go on strike because they want to be involved in the management of their pension fund. The verdict of the judge makes him a good judge because good judges protect national interest.
