If I were the manager or owner of this hospital, I would sue the owners of the filling station for the tort of nuisance. I am a lawyer and I am cocksure that the law on nuisance does not allow a person to do something on his land that would prevent his neighbour from also enjoying the use of his adjoining land.
Alternatively, the owners of the Family Health Hospital can also seek the assistance of the Attorney-General to bring an action for public nuisance against the owners of the Filling Station.
In either case, the officers of the Ministry of Environment, Science and Technology, Town and Country Planning, EPA, NPA, LEKMA and a host of other experts will then be called as witnesses for the plaintiff (i.e. Family Health Hospital).
My sister attends this hospital for antenatal services and I am concerned for her safety so I wish the Family Health Hospital good luck in its fight against these uncaring businessmen.
