now, what does section 196 of the gh criminal code say?
secondly, the law in gh may be a lil archaic and since gh practices common law. it is best to look at similar cases that may have occurred in any english speaking nation.
this crime by awuah in my opinion falls under larceny and a misdemeanor. this is not an aggravated robbery. the judge has convicted and sentenced awuah as an aggravated, violent robber. this should not be the case becos the nature of the robbery was not violent, nor did it result in any aggravated assault on the victim. a misdemeanor/larceny charge shoul;d have been placed on awuah instead with a sentence of 3 to 14 yrs. this means that awuah is liable or release/parole after 3 yrs with good behavior. if he does provide information leading to the arrest of his accomplice. the conviction against him can be reduced or he can make a deal with the prosecutor.
therefore, i dont agree with wat ace nor the prosecuting judge in this case.

These poor thieves might have pulled a knife but did not really intend to harm the culprit that steal money. If they were hardcore the man would not have lived to tell his story than even run away and be chased by the victim. These young people are not real robbers as this Mr Know all Lawyer seeks to portray. They must be given a year jail and bonded to be of good behaviour. Our Youth faces greater peril than be so incarcerated...How can poverty drive people to this level?

There is a difference between STEALING and ROBBERY. When somebody is not looking and you take their wallet or a purse, that is STEALING, on the other hand when you use a weapon like a gun or knife to threaten somebody to hand over their property or you will kill or harm them, that is ROBBERY and at that point, it doesn't matter whether it is one cedi or million cedis, the crime has become a more serious one called ARMED ROBBERY and the punishment for armed robbery can range from 15 years to life imprisonment depending on the history of the person who has committed the crime.
You referred to this Baffour as an ex-convict, that means he is a habitual criminal and I have no sympathy for him. He was lucky he was not beaten to death. A lot of people have been killed for pick pocketing.
What is strange to me is that, all these people complaining about this the judge haven sent this young man to 45 years in prison would not have complained if he had received mob justice in Ghana by way of lynching.

The minimum punishment for a class 1 felony is probation for up to 48 months.
Depending on his background, he could get up to 3MTHS IN JAIL, PAROLED if convicted
If a prison sentence is imposed the range is 4 to 15 years.

Despite advance society is provided with jobs, social welfare etc passing sentences are concederd so, you have a complete job and social provided system that regulations and rul of laws are provided to follow and respectively for protection. Young men are looking for any job to do just to have a meal for the day but hard to achieve and no social welfare could garantee their survival. I think this laws are borrowed laws and was not review by any sensible person from Ghana. Our enviroment with such laws are premitive particularly when unemployed 20yr boy is giving 45yrs behind bars at a point where Ghana goverment is not providing for the youth.

When one checks in at any US airport, he or she is normally advised not to padlock your luggage because of the likelihood of home land security breaking the lock to check for any illegal stuff, so why bother with padlock? And everytime I get to Ghana and open my bags, I find this nice "note" from homeland security to let me know that my bag was searched. No big deal for me in this story. Not all Ghanaiians are thieves, you know? I will be more worried if my bags had to go through any politician's hands, though. They are the ones we should worry about.

Recently two carjackers were sentenced to 300 years for practicing their trade. We are patiently waiting to see how many years Woyome is given for looting GHC51.2 million from poor Ghana. He did not pull a gun to our heads as such, but he snatched food from the mouths of millions of Ghanaian babies. The School Feeding Programme has virtually collapsed because people like him have stolen so much and depleted the nation's coffers. He deserves at least 500 years with hard labour and without parole. We are waiting to see !!!
