  Organised Labour (OL) is not going to court on moral grounds but on the fact that they have discovered new information that makes the takeover not appear right to them. If it is true that they privy to some new information which hitherto was not available to them at the time they supported the deal, i don't see anything preventing them from heading to the courts.
  But come to even think of it, even if OL was part of the board that aproved the deal there is nothing barring them from going to court if they realise that they erred

  I see nothing wrong with organised labour going to court if they think that there is something legally wrong with the deal even if they approved it earlier

  Organized labour should hasten with alacrity to the courts with the new evidence that has come to the fore on this merchant bank sale steeped in corruption. The thievery is too much.

  The MD who granted many of the loans, including those to Engineers and Planners, which subsequently became bad debts was sacked and he became advisor to the then Vice President, John Mahama. Those loans did not go through the bank's due process and almost all without proper security. The equipment of Engineers and Planners are obsolete and are out commission and yet were accepted as security. The stench of this whole affair is quite unbearable.

  Mr Agyabeng is not only completely and irredemably wrong, but dangerously wrong. Let me proffer just one reason. In the Corporate world, there is what we call asymetery of information between the Board and Management. What it simply means is that management is well and better placed to have all the information at their disposal since they are in charged of the day-to-day running of corporate affairs. Although a Board, it may not have this same information in equal measure to that of Management. Sometimes, Management can shield/hoard information from the Board for their selfish reasons. The Rep of Organised labour says, they have now stumble upon fresh information that makes thier earlier acceptance now completely untenable. What is the use of the mind if it cannot be changed when better and further particulars are presented to you? The 'minority view' in Boards elsewhere have tended/proved to be very useful. We must encourage them to argue their case out. Infact, this is welcome news by organised labour if indeed they have fresh and better information that makes the deal stings.
