William Atuguba and his 8 other colleagues have, forever, created a judicial vessel of endorsing/turning illegality into legality with pseudo application and interpretation of the Law; it is a travesty of justice because common sense says so.

Note that the polling agents role came out of mistrust for the EC. So their role in itself is unconstitutional to the point that they are not mentioned in the constitution so in my layman's view and according to your analogy, all previous elections are unconstitutional, flawed and must be annulled. Let common sense prevail and stop being overly academic. The judges did their job in maintaining the sanctity of the state and did not rely on any technicality to destabilize the state. Let the petitioners and respondents learn and fashion out ways to improve the system of elections and do well to get out of your confusion, sir!

But I have come to accept the SC ruling on one and only one ground. The unseen hand of disproportionate mayhem that could have been unleashed on the land had the ruling gone the other way! A stark opposite of what Nana Addo's magnanimous concession has brought on. So quite painful, justice seems to have been bruised but our current socio-political setting may be just deserves the ruling. Sad but ok!

One would have thought that the Supreme Court will be the place where common sense are common, but it appears, in Ghanas SC, foolishness must rule. Eiibei! My kookoasekruasenee common sense teaches me that when you are producing a report of any kind, you first have to cure it of any errors before you can validly declare same. When it comes to elections, I believe, before the results are declared, any errors, be it administrative or whatever need to be cured before the final declaration. The EC said there were no ERRORS of consequence, and went ahead to declare the results, despite admonitions by the NPP to the contrary. Thenthe EC refrain, GO TO COURT! In court it was proved beyond doubt that there were ERRORS, to the extent Atubuga at the end, pontificated, "going to court is jot easy". The EC admitted many many ERRORs, so also the Counsel for NDC and Mr Mahama. So my question is, how could the EC have declared an ERROR Election for one competitor? My common sense tells me that since the process was not cured of the ERRORS any declaration was invalid. The SC should not have labored so much and for so long to have declared that there were so much ERRORS so the declaration was in ERROR. Strangely, they also made the biggest ERRORS of all ERRORS, in their declaration. So how we have Error Elections, Error declaration, and Error Judgement. "na ye kooye anaa ye baa ye" learned people indeed!!

For the information of Dr Frimpong, there were no "ILLEGALITIES" in the presidential (and parliamentary polls. This is a complete disgrace coming from a so-called professor. There were ADMINISTRATIVE ERRORS and omissions e.g of signatures by officials.
Clerical errors which were not orchestrated by anyone nor were they planned in any way, systematic (and systemic) and what we were presented with were selective examples which automatically introduce BIAS in analysis and any conclusions drawn.
The judgment was the right one and those who should be held to account for 'retarding' our democracy are the justices who saw any sense in supporting the petitioners' case at all.
It is they who should be questioning their consciences, and their own judgment. They sought to derail our democracy but the majority prevailed. Frimpong and his like are completely out of order and frankly, they should stop crying over 'spilt milk' and fomenting doubt and dissent among the general populace and NPP supporters in particular.
The NPP should look elsewhere for the reasons why they failed to win the polls, having been so sure of themselves. It is pleasing to see they are beginning to put their act together towards their congress and EDUCATION OF THEIR ELECTORAL OFFICIALS!!! something they failed woefully to do at the last polls.
They still have to repair their image before Ghanaians and if their supports like Dr Frimpong will continue to advance these silly arguments, then I suspect the electorate will punish them severely, come the next polls.
You mark my words - I wish the NPP would simply wake up and realise that there are always winners and losers in elections and for them to think that democracy is only advanced when they win is ridiculous and frankly an insult to our very democracy.

I think the NPP were dubious in filing this petition to have the victory of John Dramani Mahama annulled . If they believed that Akuffo Addo won but the Electoral Commissioner wrongly declared Manama victorious , why didn't they petition the Supreme Court to compel the EC to bring all alleged ballot boxes to be openly counted vis a vis the pink sheets that were recorded at the polling stations on 7 & 8 December , 2012 ? Not only that but also the fact that a different figure was recorded by KPMG should have necessitated the SC dismissing the petition if you insist on the annulment of the results not signed by the Presiding Officers. By the way , what would have been the punishment for such officials ? Prof. , don't you also realise that such officials, if they chose to become overly partisan , could refuse to sign future pink sheets if the results did not favour.his party knowing very well that his lack of signature would get the results annulled if the losing party went to court ? So Prof., you want to keep a straight face that for well over fifty thousand polling agents that the NPP fielded to oversee their interest , not a single agent could see that they were been shortchanged .?
