Why is everyone saying that Justice Atuguba got it wrong as if the final say on the Petition rested with him? Was the Presideing Justice not reading what had been agreed upon by all the 9 Justices? Was the Presiding judge all-powerful that he was given sole role of concluding what the Justices had discussed or agreed on or not?
My second point is that although there were 5 Justices out of the 9 who wanted a re-run of some sort, the said justices split the votes on all 3 of the 6 reliefs, thus not commanding a majority of 5 on any of the 3 reliefs that were not unanimously summarily dismissed. In effect, none of the other 3 "competitive" reliefs garnered the 5 votes required to give it the force of law. So if there was to be a re-run of any sort, under what relief could that be done? I pressume that the Justices could not agree to order any re-run because of this simple fact. All that I have said is based solely on the fact that the Supreme Court determined the case by looking at the 6 relief sought individually. In that case, the 6 petitions lost by 6-o, since none of the 6 reliefs sought obtained 5-4 majority required for any of them to succeed. I am yet to be convinced otherwise.

How can these people not understand a simple verdict delivered by Atuguba? What he read was the collective agreement of all the Supreme Justices. Why could Okudjeto, who said he is a lecturer at the law school, dont understand it?

The SC set two rules/proposals for their judgement; whether there were irregularities/statutory violations and if there were, whether they were substancial enough to affect the results. I therefore thought at the end of all presentations they were going to look at how many of the judges agreed that there were irregularities/violations and judge the case before moving to the next stage ie how substancial they were. Unfortunately they dodged their own rules/proposals and did a different thing completely. The analysis used in the judgement was completely wrong considering their rules/proposal for judgement. The question is if they new they were to judge on the merits of the specific cases why did they waste Ghanaians time by first asking both parties to go and come out with their proposals and when they failed they gave theirs and did not follow them?

When you read the judgement, it is clear that 5 of the judges concluded that there were indeed violations.
It is true that all nine judges dismissed 3 categories of violations and malpractices, but 5 of them one way or the other granted the other categories of violations.
This is simple and frankly I cannot believe that Kwaku Baako cannot see through this.

He claims;
“What happened to the other two? This is where the issue becomes dicey,” he noted.
If the issue is dicey, then why give a judgment, otherwise, you give a dicey judgment and nobody is prepared for a dicey judgment. We want a simple and clear judgment but not a dicey one.
And that is why the Okudjetos, and the Gabbys, must note that their manner of analysis of the case is wrong and warped in logic.
Okudjeto said it was a dicey way of determining the case and no Ghanaian is prepared to go the dicey way with him and his cohorts.
In Atubga's judgment, there was nothing dicey. He just went straight to deliver and it should not take any intellectual to come back and decide. Everybody in the court understood it.
The issue is that it does not become dicey if you apply the issues to be determined to each category of error. It only becomes dicey if you apply it in the convuluted manner in which the Gabbys and Okudjetos are applying it.
Dont dicey Ghanaians when you are not prepared to be diced.

Ghana hasn't got time to be led by a completely clueless Mahama-Amissah Arthur administration, which is anything but, figuratively, an Undertaker, seriously burying the country whilst everybody is literally alive and kicking. Ghana has to live again, Ghana has to breathe again, Ghana has to soar with wings like eagles again, Ghana has to lift itself up again, and this is the time for the NPP party, with the vision and the know how to lace it's bootstraps and take the engagement to the NDC party and push till Ghana can break free from the shackles of the NDC oppressive regime and administration. Please Kwaku Baako if you are confused by the erudite analysis of the election petition decision by as done by Mr. Okudzeto, don't say you have reservation---say your weak mind could not grasp it. Let me make it clear to you that the issues set out by the SC the determine the petition namely whether irregularity indeed happened and their effect on the election outcome follows 'all or nothing law'. This is because the petitioners in presenting 6 categories and their effect on the election had already set the outcome for the SC. All the the SC Justices needed to do is to very the petitioners claim so the narrowed the outcome to 2 issues: 1) whether there were irregularities 2) whether they affected the election outcome. A can be seen to be upholding the petitioner's claim or not---that is 'all or nothing'. The decision of any of the Justices cannot be based on the the number of the 6 categories he or she rejected or upheld but rather whether he or she upheld at least one of the categories since upholding even one of the categories implies the 2 outcomes set by the SC has been satisfied that none of the candidates got the required 50% +1. Lawyer Okudzeto is thus correct in interpreting the SC decision which is a 5-4 in favour of the petitioners since 5 Justices upheld at least one of the categories as against 4 who rejected all the 6 categories.
Justice Atugba misinterpreted the decision because he based his decision on what he called the "net effect". He based this on the percentage or the average of what each upheld or rejected in the 6 categories. That is a completely wrong interpretation. Let me make it clear to you that the issues set out by the SC to determine the petition namely whether irregularity indeed happened and their effect on the election outcome follows 'all or nothing law'. This is because the petitioners in presenting 6 categories and their effect on the election had already set the outcome for the SC. All that the SC Justices needed to do was to verify the petitioners claim so they narrowed the outcome to 2 issues: 1) whether there were irregularities 2) whether they affected the election outcome. A SC Judge can be seen to be upholding the petitioner's claim or not---that is 'all or nothing'. The decision of any of the Justices cannot be based on the the number of the 6 categories he or she rejected or upheld but rather whether he or she upheld at least one of the categories since upholding even one of the categories implies the 2 outcomes set by the SC has been satisfied, that is, none of the candidates got the required 50% +1. Lawyer Okudzeto is thus correct in interpreting the SC decision which is a 5-4 in favour of the petitioners since 5 Justices upheld at least one of the categories as against 4 who rejected all the 6 categories.
Justice Atugba misinterpreted the decision because he based his decision on what he called the "net effect". He based this on the percentage or the average of what each SC a Judge upheld or rejected in the 6 categories. That is a completely wrong interpretation because that was not what the SC set out to determine. Of course that should not be surprising since Justice Atugba never hid his intention right from the start of the case that he will rule in favour for John Mahama at all cost.
