Why can Okudjeto not simply accept that his is a false, outrageous and quite frankly divisive analysis and conclusion which if anything only serves to negate the very peace he claimed to be calling for. Is it as a result of the onset of senility which comes with age? If so, then could that be an index for us to determine the appropriateness of his analysis on this matter? Sam Okudzeto has made his analysis. Is he wrong? If so, let us have the benefit of your intellectual wherewithal as to why and how he is wrong. Throwing insults at those whose analysis you disagree with is intellectual laziness in my view.
This Sowu chap, was he helping the debate? That because it is said at the wrong time, it should not be said? When is the right time? If the argument is that, for the sake of peace, all should forget or not discuss issues arising from the petition, we would be storing problems for the near future (2016). it is better we air everything now so that we can get things acceptable to all in future. We bury our heads in the sand at the risk of the wheel coming off Ghana's democracy in future. Acknowledging problems and fixing them is the mark of a progressive society.
We should not be afraid to let our countrymen have the benefit of our thoughts. The only proviso is that, it should be done with civility and I don't think Mr. Okudzeto insulted anybody in critiquing the summary by Justice Atuguba.

Even NPP's myriad accusations were all dropped in favor of the famous Pink Sheets that have nothing in their folders. We all realized during the Bawumia's stand this case shouldn't have gone to court.

How are laymen like me going to learn anything if these so called experts of the law don't break down in simple terms to us. 5-4 doesn't mean dismissal imho. Just look out how he confused the other judges by saying a different thing from what the others have said.
How on earth can he do that.
The court registry therefore have to come to correct so many things Atuguba did. other than that Atuguba tried to portray that one of his own colleagues justices did not know what to do and so he voted twice "for and against" which was not true.
So was there any overting by the even the judges? nswer me!!!
Why did Atuguba also lied to the media that the reasons for the ruling are all ready to collection by interested reports and he public at the court registry knowing very well that, that was true.
Why did he ran away to the USA just after his judgment and emailed to the registry his reasons for the ruling three days after from his hiding place in USA? Is it not a shame to Him and GHANA?
WHAT has NANA AKUFO- ADDO AND THE NPP done to Dr AFARI GYAN and ATUGUBA for HIM like that?
We all watched it and followed everything. There was no way MAHAMA should have been declared as validly elected. WHAT A SHAME TO THE SUPREME COURT. THEY COULD NOT EVEN DEFINE WHAT IS OVERVOTTING IN THEIR RULING? IS IT NOT A SHAME?
Lawyer OKUDZETO is RIGH. THE ROBBRY WAS OBVIOUS. THE PETITIONNER WON BOTH THE ELECTION AND THE COURT CASE.
We thank GOD Nana and the NPP says they are interested any review. You would see what would happened next. SAME ON JUSTICE ATUGUBA for all his treat. He was very bias from day one. Sir john was right to criticise him only that he did it very harshly.

Ghanaians wants development, yet we don't want to hear the PLAIN TRUTH. We get upset at anyone who doesn't speak in favor of our political party. We don't even sit down to analyze what the person said, WHETHER IT WAS THE TRUTH OR NOT. That is not so healthy to our beloved Ghana.
The panel was wrong, and they themselves know that as they have to even come back to correct their on judgement delivered. How can a full SC judge misread a judgement??????????????? Isn't that shameful to you????????????

If he is saying that the verdict should have been 5-4 in favor of the petitioner instead of the respondents according to him and the bench made a mistake then i don't know what he is calling for. What he is lacking in his argument is that the supreme court initially said that first, the would looked if there were irregularities and then they would decided on whether the irregularities affected the results. So he couldn't just looked through the transcripts of the judges and come up with different verdict to prove them wrong because they the judges voted on whether they think that the irregularities affected the results that why they came up with 7-2 in favor of the respondents. As a prominent lawyer,he should known that Justice Atuguba did not go through all the judges analysis(transcript) to come up with 7-2 verdict. what he is saying now is that Justice Atuguba took upon himself and read the transcripts and came up with the verdict. He is being bias for saying that the judges should have annulled votes where presiding officers did not sign the pink sheets.

Talking of Atubuga, if this man really cared about Ghana and Ghanaians, and knowing the magnitude of this case, first he will have been very careful in his delivery of the verdict. This Atubuga was known to have said, the SC was going to work in the interest of Ghanaians, was it meant by what he did?????? Secondly, if he really cared, he won't be delivering such a judgement from abroad. What at all was he supposed to do abroad that couldn't wait for him to deliver the judgment before he left???????
If our SC could make such a BIG MISTAKE, then the country is not safe at all, and somebody needs to point out as bitter as that may be.

It is vey sad that so-called intellectuals like Paul Amuna, who obviously has not had time to read the 588 page judgement will have the audacity to call a reputable judge like Okudjeto, who has scrutinized and analysed the 588 page judgement with a legal brain, as making a fool of himself. This is very unfortunate. Obviously Mr. Amuna is a Northerner and most likeky and NDC supporter. And therefore because the judgement favours him, he sees any intellectual analysis of the judgement as making a fool of oneself. Does Mr. Amuna know that supreme court judgements are used as study material for student lawyers? Does he also know that SC judgements provide the precedence for the determination of future cases? If the SC is making an erroneous judgement, it stands to reason that other legal intellectuals point out the Flaws in the judgement as a way of protecting posterity from a toxic precedence. It is obvious that, Justice Atuguba did not even analyse the written judgements of his colleague justices before he came out to read the error infested judgement, with Baffoe-Bonnie being both for and against the voting without verification. It is simplistic for Atuguba to conclude, without taking pains to count the numbers affected by the over-voting and voting without verification, that, the numbers involved are insignificant and will not affect the result. In effect Baffoe-Bonnie was upholding those infarctions, but taking refuge in the presumed numbers being insignificant. To any right thinking intellectual like Okudjeto, this assumption is obviously a travesty of justice. Seeing the sensitivity of the case that was before the justices, they would have done Ghana proud if they had concluded Bonnie's judgement as yes, over-voting occurred, but when we counted the numbers affected, only XYZ amount of vote were affected and therefore did not affect the results. You just don't assume that the numbers will be insignificant without counting. This is how an intellectual should think. And this is how Okudjeto is thinking as a true intellectual. He is therefore right branding his critics as ignorant folks who need to stop hiding behind the tribalistic and political affiliations and be true intellectuals. Amuna should therefore open his mind and be a true intellectual, instead of this obvious show of tribal allegiance placated as pseudo intellectualism.

I am afraid the man has lost it.His fanatical foray into politics at this time of his life when we would wish he plays the role of a respected statesman is now being sacrificed on the alter of political expedience and fanaticism.
His analysis was wrong and it beggars believe and his reasoning flawed in logic otherwise a whole nation would not sit back and allow what he says is his stand to fly away without correction. The fact that no one takes his analysis serious enough to test it in court of law is evidence of his outrageousness.
Okudjeto is damaging his posterity.He was some one I associated with wisdom in my youth but i will agree with Shakespeare that it is only the eyes of childhood that fears a painted devil.He is now completely diminished in my estimation.

Making reference to his admonishments to the V.P and Tsatsu is stale and akin to comparing the proverbial apples to oranges.
In your opinion a respected statesman should of necessity pertain to the docile breed. WHY BECAUSE PRESIDENT JOHN MAHAMA DIDN'T DECLARE HIMSELF AS THE PRESIDENT. IT WAS RATHER THE ELECTORAL COMMISSION WHO IS MANDATED TO DO SO. SECONDLY, DR MAMUADU BAWUMIA AND JAKE OBETSEBI-LAMPTEY, SECOND AND THIRD PETITIONERS SHOULD NOT HAVE PETITIONED THE SUPREME COURT BECAUSE BOTH OF THEM WERE NOT PRESIDENTIAL CANDIDATES.
NO ONE EXPECTED GHANAIAN VOTERS TO BE DISENFRANCHISED FOR THE SAKE OF CLERIC ERRORS, AND THE BIO-METRIC VERIFICATION WAS NOT THE ONLY CRITERIA TO MEASURE ELIGIBILITY TO VOTE. IT WAS STATED IN THE CONSTITUTION THAT PARTY AGENTS WILL BE PRESENT TO AUTHENTICATE VOTE COUNTS. THE FACT OF THE LACK OF RETURNING OFFICER’S SIGNATURE DOES NOT INVALIDATES THE VOTES COUNT. IF THESE SMALL ERRORS HAPPENED THROUGHOUT ASHANTI REGION, WOULD NPP USE THAT AS EVIDENCE?
GHANA’S 2012 ELECTION WAS INDICATED AS FREE AND FAIR BY ECOWAS AND AU OBSERVERS GROUP. ALSO PRESENT WERE OTHER INTERNATIONAL AND NATIONAL OBSERVERS GROUPS WHO MONITORED THE ELECTION AND GAVE THEIR THUMB UP. WHAT MORE COULD IT HAVE BEEN THAT NPP DELIBERATELY HELD THE COUNTRY AT RANSOM FOR ALMOST EIGHT MONTHS?
LAWYER SAM OKUDZETO IS NOT THE ONLY LAWYER WHO UNDERSTANDS JUDICIAL INTERPRETATION. AFTER ALL THE VERDICT WAS NOT CODED AND ANYONE COULD READ AND UNDERSTAND. GHANAIAN FOLKS DO NOT NEED FURTHER INTERPRETATION FROM SAM OKUDZETO.
IF DANQUAH INSTITUTE GOES ON BREEDING SUCH BIAS SCHOLARS WHO WANT TO ROAM THEIR IDEOLOGIES DOWN OUR THROATS, THEY MIGHT FIGHT USELESS BATTLE BECAUSE MOST WISE GHANAIANS ARE NOT TRIBALISTIC AND CANNOT BE INTIMIDATED BY THEIR FOOLHARDY. IT WOULD BE RATHER SAD AND PITY TO HAVE YOUR CHILD IN THE CLASSROOM OF PEOPLE LIKE PROF FRIMPONG AND SAM OKUDZETO WHO WILL NOT IMPACT ANY GOOD KNOWLEDGE, BESIDES PEDDLING FALSEHOOD AND WRONG INTERPRETATION OF THE LAW.
THE SUPREME COURT VERDICT COULDN'T BE OTHERWISE BECAUSE THESE LEARNED JUDGES WOULD NOT STOOP LOW FOR THE MERE FACT THAT NANA ADDO WANTS TO BE A PRESIDENT. THE DICE IS CAST AND NO AMOUNT OF REASONING CAN HAVE EFFECT OF THE VERDICT. COMMONSENSE SHOULD TEACH ALL THOSE WHO ARE MAKING HOLLOW AND USELESS STATEMENTS AND CONTRIBUTIONS TO TURN AND LOOK AT THE WAY PEOPLE VOTED THEIR PARLIAMENTARIANS. IN OUR ELECTION HISTORY, NO PRESIDENT HAS WON ELECTION WITH MINORITY IN PARLIAMENT. SECONDLY, NANA ADDO ONLY WON TWO REGIONS OUT OF THE TEN AND WHILE PRESIDENT JOHN DRAMANI MAHAMA DID BETTER IN HIS STRONGHOLD, HE ALSO BRIDGED THE GAP IN ASHANTI REGION. THEREFORE, IT'S QUITE OBVIOUS THAT NANA ADDO LOST THE ELECTION OUTRIGHT BUT TRIED TO THROW DUST ON OUR EYES OR BURY HIS SHAME BY GOING TO COURT.
WHEN I LISTENED TO NANA ADDO ON BBC HARD-TALK, I WAS CONVINCED HE HAD NO MESSAGE FOR GHANAIANS AND THEREFORE NO WONDER THAT HE LOSTS. HIS “ALL-DIE-BE-DIE” AND "YEN AKANFO" MANTRA REALLY SUCKS AND ALSO INCITES TRIBALISM. AS IF NOT ENOUGH KENNEDY AGYAPONG WARMONGERING TO EXTERMINATE THE EWES AND GAS ETHNIC GROUPS IN GHANA’S SECOND BIGGEST CITY, KUMASI, WAS NOT ONLY UNFORTUNATE BUT ALSO UNDEMOCRATIC.
OUR SUPREME COURT JUDGES MUST BE HONOURED FOR THEIR BREVITY FOR NOT SUCCUMBING TO BIAS JUDGEMENT. THE FACT OF THE NINE JUDGES GIVEN THEIR INDEPENDENT INTERPRETATION OF THE LAW IS AN INDICATION THAT OUR JUSTICE SYSTEM IS ALIVE AND KICKING. PEOPLE WOULD HAVE LOST RESPECT FOR THE ELECTORAL PROCESS IF THEY WERE DISENFRANCHISED BY THE MISTAKE OF A POLLING AGENT. IF OUR JUDGES HAVE LOWERED THEMSELVES FOR BIAS VERDICT IT WOULD HAVE PROMOTED FUTURE LEGAL CHALLENGES AND OPENED THE DOOR FOR COUNTLESS ELECTION LOSERS PETITION. NEVERTHELESS, IT DOES NOT ALSO MEAN PEOPLE CAN’T PETITION THE COURT WHEN THERE IS A PROOF OF RIGGING.
ONE FUNNY THING AMONG POLITICAL LEADERS IS THAT, WHEN THEY INCITE WARS AND DISTURBANCES IN THEIR COUNTRIES,AND WHEN THE SITUATION ESCALATES THEY WILL BE THE FIRST TO RUN AWAY, LEAVING THE POOR PEOPLE TO FIGHT USELESS WARS. This is a man who used to command so much respect in Ghana. Now look and listen to him. A man of such high standing in the legal profession, spewing out nonsensical garbage and making a fool of himself. Nine Supreme Court Judges heard both sides of the election petition in an open court that was even telecast across the globe. Their Lordships considered both sides of the case and decided unanimously to throw out the case.
Mr Okujeto now says he found, by his own analysis, in 5-4 in favour of the petitioners. I used to think that lawyers were supposed to uphold the intergrity of the profession by respecting the ruling of their fellow lawyers. By saying what he did, Mr Okujeto has behaved in a typical NPP fashion by publically denouncing the ruling of the highest court of the land. This is disgraceful, to say the least and he deserves any words of criticism or abuse that comes his way.

What our political scientists and law intellectuals who saw things differently ought to be doing now is exerting their energy elsewhere...using every drop of blood in them to ensure that this sort of thing doesn't happen again...ever, if their thinking is right that is, whether we do it constitutionally or institute changes in the electoral system. If they can't figure out how to achieve this, then how can they expect the rest of us to argue with city hall.

Why is everyone saying that Justice Atuguba got it wrong as if the final say on the Petition rested with him? Was the Presideing Justice not reading what had been agreed upon by all the 9 Justices? Was the Presiding judge all-powerful that he was given sole role of concluding what the Justices had discussed or agreed on or not?
My second point is that although there were 5 Justices out of the 9 who wanted a re-run of some sort, the said justices split the votes on all 3 of the 6 reliefs, thus not commanding a majority of 5 on any of the 3 reliefs that were not unanimously summarily dismissed. In effect, none of the other 3 "competitive" reliefs garnered the 5 votes required to give it the force of law. So if there was to be a re-run of any sort, under what relief could that be done? I pressume that the Justices could not agree to order any re-run because of this simple fact. All that I have said is based solely on the fact that the Supreme Court determined the case by looking at the 6 relief sought individually. In that case, the 6 petitions lost by 6-o, since none of the 6 reliefs sought obtained 5-4 majority required for any of them to succeed. I am yet to be convinced otherwise.

All the nine Judges said no we will not annul the number you requested. Each had to decide on six issues - total 56. The score was 12 to 42. Atuguba annouced the cumulative effect. Mr. Sam Okudzeto has suddenly turned himself into a Judge and has given a dicey judgment.
He claims;
“What happened to the other two? This is where the issue becomes dicey,” he noted.
If the issue is dicey, then why give a judgment, otherwise, you give a dicey judgment and nobody is prepared for a dicey judgment. We want a simple and clear judgment but not a dicey one.
And that is why the Okudjetos, and the Gabbys, must note that their manner of analysis of the case is wrong and warped in logic.
Okudjeto said it was a dicey way of determining the case and no Ghanaian is prepared to go the dicey way with him and his cohorts.
In Atubga's judgment, there was nothing dicey. He just went straight to deliver and it should not take any intellectual to come back and decide. Everybody in the court understood it.
The issue is that it does not become dicey if you apply the issues to be determined to each category of error. It only becomes dicey if you apply it in the convuluted manner in which the Gabbys and Okudjetos are applying it.
Dont dicey Ghanaians when you are not prepared to be diced
Ghanaians needed a simple straight forward judgment but not a dicey judgment, otherwise, we will be fighting ourselves now because we lacked understanding of an okudjeto dicey judgment.
We needed a simple peaceful judgment but not dicey confrontational judgment.

Lawyer Sam Okudzeto New
A former President of the Ghana Bar Association (GBA), Mr. Sam Okudzeto, has described those criticising his analysis of the Supreme Court verdict on the election petition trial, as “ignorant” people.
“…If anybody is [picking] a fight with me, it is because the person is ignorant and I think we Ghanaians should learn now to begin to learn, instead of using sentiments. Sentiments don’t help anybody” he told Radio XYZ’s news magazine programme STRICT PROOF on Friday.
Mr. Okudzeto, in an interview with XYZ News on Thursday September 26, 2013, accused the presiding judge of the nine-member Supreme Court panel that heard the case, Justice William Atuguba, of “misreading" the judgment of his other colleague Justices.
According to Sam Okudzeto, his own analysis of the 588 pages of the judgment shows the decision went 5-4 in favour of the petitioners.
He, therefore, wondered why the Court ruled in favour of the respondents and validated President John Mahama’s election.
Mr. Okudzeto said he believes the Presiding Judge, Justice William Atuguba, gave a “wrong” analysis of the judgment.
Retired Military Captain, Joel Sowu, his harshest critic, described Mr. Okudzeto’s analysis as wrongly-timed and imprudent.
According to Captain Sowu, “…with his age, I thought that prudence should have played a part for him to decide whether to say what he’s saying at this point in time or not”.
“If you say the right thing at the wrong time, it is wrong; if you say the wrong thing at the right time; it is wrong and I think the timing is completely overboard and it is uncalled for and it must be condemned by right thinking people who want peace in this country”, he stressed.
He wondered why Mr. Okudzeto made those comments despite the fact that: “The petitioner himself has said ‘I will abide by the thing’”.
“…So who are you now to start critiquing and rubbishing the judgment of the Supreme Court?”
“…We are all saying that the word ‘Supreme’ means ‘something or nothing’, and he, as a former President of the Bar Association, seriously, I’m disappointed in him”, he thundered exasperatingly.
Mr. Okudzeto however retorted that: “That is the level of their ignorance; that because the Supreme Court has pronounced judgment therefore, we as academicians should not analyze it?”
“If they are doing that then they are ignorant and this is what they need to be educated upon…I was doing a critique of the judgment; I’m entitled to do; in fact which I’m obligated to do. They should learn now and begin to learn because it is the sentiment that creates the tension in the country. It is not the analysis”.

This is the same man who was at a peace rally calling for peace before the 29th August verdict. So what peace was he really calling for?
What makes him think he is right and the panel of justices are wrong? Why can Okudjeto not simply accept that his is a false, outrageous and quite frankly divisive analysis and conclusion which if anything only serves to negate the very peace he claimed to be calling for. In other words, it makes him a hypocrite and that is unstatesmanlike!!!
