The acting president is not the president. He functions only when the President and his vice are outside the country. His authority ends as soon as they come back. The wise men knew there could be the possibility that the two could be away at the same time hence that provision in the constitution. Bature is worried for nothing. Maybe he just want to be heard this time not criticizing unnecessarily.

The concern raised regarding the flaw in this constitutional provision is valid. We cannot have two presidents at a time. When the President travels overseas on official duty, he does so as the President and if he has to conduct business or sign any documents, he does so as the President. So the President does not cease to be president when he/she crosses the border. In fact, some of the functions of the President require crossing the border. What then is the logic in swearing in another president in Ghana. With that, we will have two presidents, one overseas and one in Ghana. Absolutely makes no sense and a recipe for confusion.

You are right. This because I believe this action of swearing in the vice, the speaker, the Chief Justice (in that order), is only necessary when the president becomes incapable of discharging his duties as president, say going under anesthesia during medical emergency/surgery.
Also, when the whole ruling government becomes defunct as a result of a "vote of no confidence", would the speaker take charge of government.

Our Constitution devices a method of dividing the traditional government powers into three separate but equal divisions. Each division was to operate as a "check" to prevent either of the other two from abusing its ruling power. The Legislative Branch of the government - Parliament - is where all the laws are initially created and voted upon.
The Executive Branch - the President and his ministers - are tasked with carrying out the laws of the land. The President has the power to veto any law passed by the Legislative Branch, but they can, in turn, overrule his veto with another vote. The president is commander in chief of the military but must depend upon the Legislative Branch to fund its operations and. The president also nominates Supreme Court justices. The Judicial Branch- the Supreme Court - rules on whether or not a law or executive act has a Constitutional basis and is valid. If these checks and balances are violated in view of having one person being the President (acting position) at the same time the Speaker. Who watches the watchman?

It's about time the constitution of ghana is suspended. because the sc verdit on the election petition shows clearly we don't have working laws. But our laws now depend on just de judges whimps and capprises. Very sad!!
