I am amazed by the so-called Pro's interpretation of the Constitution which appears to be modeled on the US Constitution.

The simple interpretation is that should the President and his Vice die or be incapacitated to the extent of being deemed incapable to lead,the Speaker of Parliament would be the designated leader of the country. This is to ensure smooth transition of power and uninterrupted leadership.

I do not believe that it had any relevance to the absence from the country of both the President and his Vice.

THE POWER OF THE PRESIDENCY IS NOT RESTRICTED BY TERRITORIAL OR NATIONAL BOUNDARIES.

Unless absolutely necessary,common sense dictates that the President and his Vice would not leave the country together.

Maybe, an amendment would help rectify what the Prof considers an error and give this a real clarity of expression.

Prof Baah is correct about the lapses in the constitution in the context of a caretaker president and he may probably have seen other lapses elsewhere (too many to mention) that's why he called for a "complete discard" of the whole constitution - otherwise an amend would suffice.

In the same vein most new governments throw away projects started by their predecessors, however well-intentioned the projects are. We must learn to amend and improve things that are no longer fit for purpose as opposed to discarding them in their entirety. What is the guarantee that if a constitution is re-written it will meet all requirements in 10,20 or 30 years from now? Would we need to throw it away again and re-write another one? I applaud your for raising this important issue but let's be pragmatic and amend areas that are no longer fit for purpose and spare ourselves the enormous task of re-writing a new constitution from scratch.

And any piece of work done by man cannot be perfect. If the document is discarded a hundred times and re-written a hundred times, it will never be devoid of little infractions. This is because to err is human! If it aint broke dont fix it. Or else a few greedy ones want to embark on a money spending spree in the name of re-writing the constitution. If a person is not a practising judge, he or she is not legally mandated to interpret the constitution. " The law is what the courts say it is". This prof is not qualified to interpret to the constitution. And asking for the constitution to be discarded is a serious offence.

Every time I go on Ghanaweb to catch up with the news from my motherland, I get discouraged by the amount of bickering reported on the pages among politicians, non-politicians, sports enthusiasts,etc. Instead people pulling their ideas & weight together to help build the nation, they're always attempting to tear each other apart: What a Shame!
For the professor to take just one article of the constitution and argue that the whole constitution 'is poorly written and must be discarded' is in my view, TOO MUCH of a stretch. The taking of the oath just legitimizes the Speaker as an interim leader in the absence of the President & his/her vice. Other nations of the free world have similar arrangements, except that the person acting in the absence of the President & his vice does not necessarily have to take an oath, unless there's a permanent vacuum created by the absence of the President & his/her vice. The Speaker is only in an acting position & can consult with the President & vice while they're out of the country. There's no ambiguity here; except for people who want to find fault with everything that their gov't does. There's no constitution anywhere in the world that doesn't seem to have 'flaws', if critically examined. We all tend to inject our biases when we attempt to interpret legal documents, including constitutions. (May be the prof should have used the article as a one-page critique assignment for his law class: instead of making a "mountain out of a mole hill").

This thing about the spirit of the constitution gives lee way for the judges to be corrupt and to interpret the constitution the way they want the case to go. It's up to the people to ask for more from the judicial committee in parliament who are taking huge remunerations and yet have nothing to show for it.

I agree with Prof.Baah in-toto. The 1992 constitution must be reviewed again to eliminate some irrelevant and archaic provisions.
1. The provision that the president cannot be prosecuted for his omissions and commissions whilst he was in office is untenable.This, in effect does not make the president accountable to the people. It also gives the president a blank cheque to steal from the national kitty by embarking on unproductive ventures like the guinea fowl project initated by john mahama to throw moneys to the dogs.
2.The transitional provisions must be scrspped for it serves no useful purpose.This transitiona provision was smuggled into the constitution by Tsatsu Tsikata to protect jerry rawlings against possible legal actions from aggrieved victims of the so called 31 December revolution. The National Reconciliation Commission has resolved this legal issue,and therefore the transitinal provision must be expunged from the constitution.
3.Why was the Speaker of Parliament sworn in as acting president, when the dejury president was away on official duties and the vice was outside the country. Is it not possible for the speaker acting as president to stage a coup or remove all team C ministers appointed by Mahama.This can create confusion.

There are provisions to revised and refine identified problem points and parliament should act on that...The elected government shd also take steps to avoid these possible conflicts...As much as possible the Pres and VP shd aviod both being out of the country at the same time....The provision as written is sensible and covers cases where say president is outside for extended period as Y'Adua was taking treatment overseas and the VP also had to go outside the country. But as much as possible, either the VP or President shd be in Ghana..they should not be competing for per diem.

It is irresponsible for the lecturer to use his position to pour scorn on nation's constitution instead of offering constructive suggestions as to how to fix these potential conflicts...

Ghana's Constitution is the best it can be but right now it is good enough. There is the need for certain Constituional amendment which my learned friends should begin to agitate for instead throwing away everything. When you design something for the first time it is always full of flaws even including your first essay at College, however you fine tune.

I do not see any serious flaws with it. It is simpleand focused and written in a straight forward English.

Educate our Parliamentarians to work harder for the people they represent and not their political parties.

The recent decison by Supreme Court was a clear example of the workability of the Constitution.

I agree that it is utterly absurd to have another sworn in as president when the other is of sound mind and health. Geographic location alone shouldn't be a factor. The prof however has made a mistake of throwing the baby with the bathwater. Throwing away an entire constitution is a knee jerk reaction. We should call for a referendum where required and amend to fit the current situation.

Even the US constitution is still subject to review based on the Union's peoples wishes. Africans and some Ghanaians see everything African or Ghana improper. When are we Africans and Ghanaians going to learn to appreciate our own? Another arm chair professor in our colleges and universities called Prof. Amoako Baah. Kufour after all those years as president did not see the need for second chamber or Upper house until he left office. So-called VIPs fleecing poor Ghana, including using state resources and assets like Presidential jets for their private business' at the expense of the tax payer. And Mahama who has been weakened by the SC electoral challenge has acquiesced to the looting and plunder of national assets. Mr President come again, did you say you will always uphold the truth? Then stop the misapplication of the presidential jet by so-called VIPs. Upon assumption of office, you swore an oath to protect the national interests of Ghana, including the internal and external aggression and the nation's resources. Why is the NDC under your leadership allowing the abuse of state jets? That is corruption and cronyism.
