You see you need to pay attention to what you write. If the polling officers were supposed to do such and they failed to, the result should be declared null and void. It is not genuine. Some people feel like elections are just casting a ballot, how do we get a winner declared. To avoid bloodshed rules should not be frivolously broken and allowed to stand. If the constitution contains errors, then it is bogus and Ghana cannot be ruled with or by it.

No. You it's a big lie. He is another great one on the bench. We need such a wise man at the SC. Not the corrupt type who interpreted the constitution as if if it were written with iron. being open-minded on issues is the best way to judge cases. The literal interpretation with regards to signatures on pink sheet will lead to serious sabotage in all future elections and Ghana should not entertain it. If a voter with sound mind cast his/her vote correctly, the absence of official signatures should not lead to h/her being disenfranchised. Period!

Please try to read these judgements, by the Supreme Court judges, with a modicum of objectivity.
Nowhere, in his judgement did this judge say "signatures are not important". All he said was that: after everything was said and done during the election, an signature omission by a presiding officer could not constitute enough grounds on which the results could be annulled.
What happens when even the best intellectuals decide to coat every thought out brains and every word out of their lips in regionalism and partisan politics.

After going through this judge's opinion, I'm wondering whether anybody can win election fraud in Ghana from now on. Not that anybody has won one before, but this precedence is going to make it harder. Reading portions of his opinion and scanning the rest, I got sick over it so copied to read it again. My reason is that the opinion is like from a twisted mind. Looks like the justice had an opinion to reject the petitioners and came out with some twisted reasoning to support himself.
Elections rules are rules. NBNV, etc. are rules to support the authenticity of election results. If they are flouted or abused, a justice cannot consider them as mere administrative errors. The EC office could easily do that by refilling the pink sheets and simply not sign. Any document to be authenticated from the polling station must be signed. Why do we sign or thump print documents in the first place? Oh poor Ghana. Nobody will take such a case to court again, and there will be bloodshed and this SC should take the blame. Some of the opinions look too twisted.

Reading Art. 49(3)(a)and(b)where it instruct the presiding officer and the agents to sign to confirm what had transpired at the polling station. The intention here is to authenticate the results at the polling station. So where the representatives of the opposing parties have signed to confirm the results, it has been authenticated enough eventhough the presiding officer did not sign. so its wrong for u to suggest that signature does not matter. there were signatures on all the pink sheets. u have lost full stop.

You found it difficult because you failed to follow his logic. If you had bothered to read maybe it would have made sense. Not having read it, you have no right to question his judgement.

I have always been thinking that what if a Presiding officer is deliberately planted by the a party in the strong hold of an opponent who intentionally refuses to sign the pink sheet?
Justice Gbadegbe ia a very intelligent man. I like his reasoning.
