What is it that Afari Djan has done which should warrant his resignation. At the Supreme Court, was there anything established to support the case that he was personally linked to any malpractices or shortfall in the way the election was organised. These communist inferior tactics of looking for scape goats where others have failed to deliver must stop. I listened to one of the NPP bigwigs in Kumasi who said that the drop in percentage votes in the Ashanti Region is as a result of migration of persons who are not of Ashanti extraction into the Ashati Region. Sorry!!. Please note that it is not only Ashantis who vote in Ghana and so if you do not get what you want, go check yourself and leave AQfari Djan alone.

To say Afari Dayan MUST RESIGN is and UNDERSTATEMENT. This self-acclaimed professional and braggart thinks he is the kingmaker in Ghana. He thinks he can single-handedly decide who should be president and who shouldn't. Since his incompetence were not scrutinised he developed HUBRIS and though he was beyond reproach.
If Afar-Gyan IS NOT FORCED TO RESIGN (EVEN IMPRISONED) any change at the Electoral Commission will be COMSMETIC. In the cevilised and advanced world any changes or reform starts from the top as the people at the top aare always contributory to the mess and chaos. Afari-Gyans carelessness and incompetence nearly cause genocide in Ghana. How can Ghanaians allow this man to still be in the position where he nearly caused mayhem in Ghana.
We need to be proactive and appoint people with integrity and professionalism to manage the country. Afari-Gyan has lost all his integrity, probity and professionalism. AFARI-GYAN MUST GO.

Yes, mistakes were made and corrections have to be made. But you don't fire the leader who has done this job for 20 yrs. That is how Africans do things and it shows how backwards we are as people. We do things without using our brains- bugabuga.

Even if he had to leave, we must maintain him now, so that he can teach the incoming leader a thing or two about how things are done over there- good or bad. You don't degrade that person and expect him to teach his successor successfully. How do we know another Ghanaian would come and in the next 3 years would perform better than what Afari Gyan has done for 20 years?

He should not be forced to leave the office. However, he should be told to train someone to take over from him as early as possible. And should be allowed to hang around as an "adviser" even for the next election. That is how things should be done, if the Nation is to be moved forward.

If you've organized 5 elections over 2 decades and there are such unpardonable mistakes as 'transpositional errors' and lack of understanding of 'overvoting' then I don't know why you think such an one should continue in office unless of course you're of the opinion that there's no other competent soul living in Ghana. Why should he resign if there is no policy that shows that after such and such terms or at such and such an age the officer should vacate the office? Who in his right mind would do so? Dr. Afari Gyan should do the honourable thing and resign. Successive elections have gradually brought us to the brink, and that is grossly an acute indictment of his tenure, as the EC Boss. In 2008, NDC hoodlums massed up at the EC offices, wielding all sorts of implements promising fire and brimstone, 2012, it took the magnanimity of Ghanaians and the abundant Grace of God, that the country was spared violence and mayhem. That is not the kind of ECommissioner that Ghanaians would want to preside over the processes that leads to the exercising of their franchise and mandate to choose who to lead them in elections, with a view to addressing their socio-economic problems, and if Dr. Afari Gyan has any conscience, he should resign to save us the embarrassment and near tenterhooks, the country sits on, every election circle. It's not healthy for the country and it's not good for our image as a peace loving country, because, there's going to come a time when there would be a potent conflagration and Ghana and Ghanaians would be the worst for it. Afari Gyan needs to bow out graciously.

THAT BEFORE ONE CAN OR COULD UNDERSTAND THE SITUATION UNDER WHICH DR.AFARI-GYAN FOUND HIMSELF THEN ONE WOULD APPRECIATE THE HARD WORK AND THE GOOD WORKS HE HAS DONE.
THAT IT WAS THE SAME DR.AFARI_GYAN WHO WAS THE CHAIRMAN OF THE ELECTORAL COMMISSION DURING 2000 AND 2004 PRESIDENTIAL AND PARLIAMENTARY ELECTIONS AND DECLARED THE NPP PRESIDENTIAL CANDIDATE THEN H.E.FORMER PRESIDENT OF GHANA JOHN AGYEKUM KUFUOR WINNER OF BOTH ELECTIONS WHEN THE GOOD PEOPLE OF GHANA CLEARLY VOTED FOR HIM.
THAT AS I HAVE POSTULATED TO THE ENTIRE WORLD THAT "JUSTICE SEEKS THE TRUTH AND NOTHING BUT THE TRUTH".
THAT THE LEGAL ISSUES BEFORE GHANA SUPREME COURT THAT THE COURT ADJUDICATED AND RULED ON THE MATTER AND BY MAJORITY DECISION DISMISSED THE PETITION THAT WE MUST ALL CALL "A SPADE A SPADE".
THAT IT IS ALSO A TRITE KNOWLEDGE THAT THE LEGAL RESEARCH AND INDUSTRY THAT COUNSELS/LAWYERS PUT INTO A CASE HELPED THE JUDGES WORK TO BE VERY EASY.
IN FACT, THE SAME CANNOT OR COULD NOT BE SAID WITH THE 2012 PRESIDENTIAL ELECTIONS PETITION CHALLENGED SINCE COUNSELS FOR RESPONDENTS INSTEAD OF TO RAISE "A PRELIMINAY CHALLENGE ON THE PETITION ITSELF AND OTHER LEGAL ISSUES RAISED AS FRIVOLOUS, CAPRICIOUS, VEXACIOUS AND MALICIOUS" BUT RATHER ENGAGED THE PETITIONERS ON "PINK SHEETS CLERICAL ERRORS INSTEAD OF ON POINTS OF LAW AND LEGAL BASIS".
THAT THE WHOLE MATTER WAS "A QUESTION OF LAW AND NOT PINK SHEETS".
HOWEVER, THE SUPREME COURT OF GHANA HAS NOT BEEN FULLY APPRISED WITH THE LEGAL POSITIONS SINCE COUNSELS FAILED TO MAKE THE RELEVANT LEGAL ARGUMENTS BUT JUST DWELL ON FACTS AND RATIONALITY OR RATIONAL ANALYSIS OF THE FACTS.
IT IS MY FIRM BELIEVED THAT IF THE COUNSELS FOR RESPONDENTS WERE TO RAISE THE PRELIMINARY OBJECTIONS TO THE PETITION AND MADE THE RELEVANT LEGAL ARGUMENTS SUPPORTED WITH THE RELEVANT PROVISIONS OF THE CONSTITUTION AND OTHER RELEVANT LAWS THE COURT WOULD HAVE DISMISSED THE LAWSUITS ON THE ONSET.
THAT I AM RESPECTFULLY CALLING ON ALL THE MEDIA HOUSES THAT COVERED THE PROCEEDINGS TO PRODUCE THE TAPE RECORDINGS OF THE PROCEEDINGS OF THE AMICUS CURIAE REVIEW MOTION AND THE LEGAL ARGUMENTS THAT I ADDUCED AT THE COURT AND EACH COUNSELS RESPONSE AND THE COURT RESPONSE AND THE THE COURT RULING TO HELP THE READING PUBLIC TO ASCERTAIN THE DIFFICULTIES POSED BY SOME OF THE COUNSELS RESPONSES TO THE JUDGES.
THAT DR.AFARI-GYAN IN THE FIRST PLACE DO/DID NOT HAVE FULL RESPONSIBILITY OVER TEMPORAL 2 OR 3 DAYS ELECTION OFFICIALS SINCE THEY WERE NOT PERMANENT STAFF AND THAT THE INSTRUCTIONS GIVEN TO ME WERE ACROSS THE BOARD.
THAT THE TRUTH OF THE MATTER WAS THAT THE MALPRACTICES AND OTHERS THAT THE PETITIONERS COMPLAINED ABOUT AND COMMENCED THE LAWSUITS DID NOT OCCUR IN REALITY AT THE POLLING STATIONS THEMSELVES THAT THE LEGITIMATE VOTER COULD BE BLAMED OR ACCUSED OF BUT JUST "MERE CLERICAL OR ADMINISTRATIVE ERRORS" THAT DID NOT ACTUALLY AFFECT THE FINAL OUTCOME OF THE FINAL RESULTS DECLARED THAT IT THEREFORE DEFILED COMMON SENSE THAT THOSE GENUINE AND HONEST SINCERE VOTES CAST TO BE PURPORTED TO BE ANNULED THAT THE ISSUE THEN IS "WHERE THEREFORE WILL BE JUSTICE ITSELF?".
TO PURPORT TO FIND A FINDING FOR "A MERE HYPOTHETICAL SPECULATIVE CASE WOULD HAVE REALLY CAST A SLUR ON OUR JUDICIAL SYSTEM AND WOULD EVEN AMOUNT TO "JUDICIAL SABOTAGE".

BUT THANKS TO THE MAJORITY DECISION THAT DISMISSED THE PETITION.

THAT DR.AFARI-GYAN HAS DONE NOTHING WRONG TO CAST A SLUR ON HIS REPUTATION AND INTEGRITY ESPECIALLY AS DR.BAWUMIA TOLD THE SUPREME COURT IN HIS EVIDENCE IN CHIEF AND UNDER CROSS-EXAMINATIONS THAT WHEN THEY WERE PREPARING THE PINK SHEETS TO COMMENCE THE LAWSUITS THEY ALSO MADE "MISTAKES" AND HE EVEN FURTHER STATED THAT "THEY MADE MISTAKES AS ANYBODY OR ANY PERSON CAN ALSO MAKE MISTAKES" AND THAT THE LEGAL POSITION AND LEGAL EFFECTS OF DR.BAWUMIA TESTIMONY WAS NEVER ADDRESSED IN LAW.

IT IS AT THESE RELATED BACKDROPS THAT TAKING COGNIZANCE OF THE FOLLOWING LEGAL THEORIES OR LEGAL PRINCIPLES IF THEY HAVE BEEN ADDRESSED WOULD HAVE HELPED THE COURT TO MAKE EASY DETERMINATION OF THE CASE:

(i) THE LEGAL PRINCIPLES OF EQUITY

(ii)THE LEGAL THEORY OF "MENS REA" OR THE "INTENT OF THE ELECTORAL OFFICIALS OF MAKING THE CLERICAL ERRORS".

(iii) THE LEGAL PRINCIPLE OF "HONEST MISTAKES AND ITS EFFECTS".

(iv)THE CONSTITUTIONAL AUTHORITY VESTED IN THE ELECTORAL COMMISSION UNDER CHAPTER 007 OF GHANA 1992 CONSTITUTION

(v) WHETHER OR NOT THE PURPORTED MISTAKES MADE CAN BE CURED BY THE COURT WHEN THE PETITIONERS THEMSELVES ALSO MADE THE SAME MISTAKES?

(vi)WHETHER OR NOT THE PROVISIONS UNDER CLAUSES 4,5 & 6 OF ARTICLE 57 CHAPTER 008 OF GHANA 1992 CONSTITUTION OF THE CASE OF A SITTING PRESIDENT OF GHANA WHILE IN OFFICE ACTED AS OUSTER CLAUSE(S) TO

ARTICLE 64 UNDER WHICH THE PETITIONERS BROUGHT THE PETITION THAT COUNSELS FOR RESPONDENTS FAILED WOEFULLY TO ADDRESS THE LEGAL ISSUE AND RATHER MADE A SITTING PRESIDENT OF GHANA H.E.PRESIDENT JOHN DRAMANI MAHAMA A LITIGANT.

The call by AFAG is as misplaced as the NPP's petition which was DISMISSED.

If he won't go, someone should hold him by the back of his trousers and pull him out of the EC compound into a waiting van a dump him near Nsawam prisons, where he ought to have been in the first place or straight to Brong Ahafo, where he's known to belong. Ghana cannot afford to have him be at the EC as boss to conduct and oversee another elections. That will be suicidal. No way! We won't allow that to happen again. Just yank him out of the place before it gets too late.

Similarly, Sir John support for AFAG's call is out of frustration and disgruntledness. It's on records that Sir John hasn't made any sensible statement ever since he became the General Secretary of NPP. By their words, you shall know them. AFAG like Danquah Institute and LET-MY-VOTE-COUNT are useless and hopeless setups whose statements doesn't reflect on the majority of Ghanaians. It's high time they stopped making these silly political confusion. Does AFAG speaks for Ghanaians? I don't think so and I don't think NPP file and rank even recognises this stupid and wasteful institution. The EC Chairman was appointed as the constitution demanded and the fact that NPP didn't win means he did a bad job. Dr Afari-Gyan will remain at post as long as he wishes until his retirement or the president government deems it right to replace him using the constitutional instrument. AFAG can go to hell together with hollow-minded and useless Sir John. For AFAG ignorance, NANA ADDO can't win the presidency with only Ashanti and Eastern Region. If NPP doesn't change their style of politics, they will be wasting their time. Their predecessors did the same to CPP Dr Nkrumah and at the end it's Ghanaians who have to pay the price. People should ignore AFAG and any such confused people. Thanks

This is a man who single handedly through dubious manipulations brought Ghana's electoral System into irreparable disrepute. I think, if Dr. Afari-Gyan is a man of conscience and integrity, the most thoughtful and honorable thing he should do, is to resign from the Chairmanship of the Electoral Commission. Dr. Afari-Gyan, is a disgrace to the Ghana Public Service, as such, people like him whose integrity is questionable shouldn't hold any public service office of any kind.

I think Afari Gyan must not only resign but must be probed. He is the reason for all the woes of the 2012 election coutr issues and all the debt th nation has incurred. He was aware that there was irregularities during the election process and and that the electoral process has some loopholes which he could have addressed even before the elections but did not do anything about it. Furthermore did not admit of any electoral irregularities until he was called in court before he admitted the electoral irregularities. In the first place, before he took the oath of office, he swore to be faithful in the discharge of duties but knowing of election irregularities and denying any such irregularities when confronted by citezens and knowingly denying of anything wrong about the Dec. 2012 elections should be considered as aiding and abetting and tantamount to a prosecution and imprisoned if found guilty. This will serve as a lessons to future electoral commisioners who would like to mess up with people's lives while discharging their duties. Dan Kare.

Until NPP accepted the fact that they lost the election 2012 through ballot box and that they won 2 out 10 regions in Ghana, even if President Koffour should be the EC Chairman or chief executive officer they will not trust him.
