NPP has brainwashed its highly intellectually lazy followers such that, even some believe they lost the petition by 5:4, when they actually lost by a whooping 7:2. Common sense doesnt play in their mindset. Cogent reasoning is lost.

You think the law is used "blindly" these days? Maybe u live in the 12th century.

You think if u cash a cheque and the cashier forgets to make u sign that u received the money, u can come back and demand money because u didnt sign earlier? U must be out of your mind. A lot of injustice is done if laws are applied BLINDLY without common sense.

Because a presiding officer didnt sign, votes should be annulled? U MUST BE THE MOST STUPID HUMAN BEING IN THE WHOLE ENTIRE WORLD. What about other factors which can determine the truth of the case, like polling agents signatures, etc.

Some are even so stupid to mention that foreign materials were found in the box. Where from the hearings did petitioners claim foreign materials were in ballot box? LIES, LIES, TWISTING OF FACTS, MISINTERPRETATION, EDITING HAS BECOME NPP'S BEDROCK.

Justice Anim Yeboah had nearly done a great injustice to legal reasoning and interpretation in Ghana if it were not for the timely intervention of justice Atuguda and the brave three.Anim used a very narrow and restrictive interpretation of the constitution to arrive at his decision.

Constitution is a living thing and therefore evolves hence the expansive interpretation is used to distil its message and give it its proper effect.when balancing a constitutional duty and a right equity imposes an obligation on you to give right the benefit of the doubt.That is where Anim failed because he used a dictionary definition of shall to arrive at his decision.His argument of a word been mandatory and imperative and therefore a fetish which he can not derogate from is absurd.

In effect, if he had prevailed ,elections in this country will have been impossible since his ruling means a mistake by an official annuls all votes which all will take advantage of.The common sense approach which is sin qua non in constitutional interpretation was taken out of his interpretation and was therefore a victim to his political values thereby subverting the essence of the law.

I applaud Justice Adinyira for using the more accepted mechanism of intent and expansive constitutional interpretation and reasoning otherwise there will be mayhem in our next elections.Even in the developed world there is always a margin of appreciation for mistakes.

One folklore has it that a despotic ruler had decreed that anyone who committed a crime would have his/her entire family punished. Ananse took advantage of this to punish his enemies. He would lure children to the chief's palace and trick them to shit at the backyard of the palace,an offense the wicked chief punished swiftly. So many innocent families where victimized by the errors of their children. So by Justice Yabour's Ananse reasoning, if a Presiding Officer of my holy village refuses or forgets to sign a pink sheet, instead of the offending officer being punished my entire village folk must be punished for the sins of the PO.

Justice Adinyira is a reasonable judge; She validly dismissed all claims in the petition because the petitioners failed to discharge the evidenciary burden of proof, which is a little higher than the civil burden of proof on the balance of probability.

That basis is the fact and law on which all the judges should throw out the petition. That law and fact is material in the adjudication.

"It is especially significant to note that, indeed, article 49 is the only occasion on which details of voting at elections and referenda are specifically spelt out in the Constitution itself. In all other situations, the power to determine the manner in which elections shall be conducted is left to the 2nd respondent to regulate through the enactment of regulations pursuant to article 51. It is obvious that the Constitution itself recognises that activities at the polling stations are at the bedrock of the democratic system of governance, hence the need for specific regulation of same by the Constitution, rather than being left to determination by the Electoral Commission. The mandatory provisions in article 49 have an even greater significance when due account is taken of the Preamble to the Constitution. Serving as the spirit within which the Constitution is enacted, the Preamble operates as the yardstick by which the tenets of good governance ought to be measured. In this vein, it is humbly submitted that any conduct on the part of a person which militates against the attainment of the principles spelt out in the Preamble ought to be jettisoned by this Honourable Court. Interestingly, all the justices who granted the petitioners' reliefs upheld the Supreme Law of the land, the Constitutin of Ghana! It is as clear as daylight that the ruling had nothing to do with the law, and everything to do with the peace of Ghana, "which group is least likely to cause confusion if it lost."

If engineers, docctors, pharmacists and scientists in Ghana applied the laws of nature and physiscs the way the laws of the land were interpreted and applied in this case, all of us would be dead meat! That is why Nana Addo deserves commendation.

The five Judges realized that the EC explanation was accurate but not what the petitioners were trying to do. How did they object to anything that could clarify an issues? All some are people talking about is law and don't even know law. Law needs interpretations. Law is made to protect people's rights not to abuse their rights. Since those presiding officers cannot be solely responsible for their actions, how you go about using the law to punish innocence voters who did nothing wrong?

I was quite impressed when I heared Dr. Wereko Brobbey classify the points of view on the petition into 1) The Robots and 2) The Human.
We could examine Justice Adinyira's point on the strict interpretation of the law in this regard.
Lets take the 3 categories and analyse them in turns
1) Lack of Presiding Officers Signatures.
The law that borders on this category is article 49(3) of the constitution which states among others that the Presiding Officer (PO) and the Representative of the Candidates (Polling Agents) shall sign the summary sheet after the count of the votes.
Assuming that all the nine justices had decided that the use word shall implies an indispensable obligation and therefore no signature must annul all votes there justices will have put so much premium on signatures of not only the POs but also that of Polling Agents (PA) and we can all imagine the possibility of POs and PAs taking the entire country's election hostage and holding us to ransome. Imagine that all POs or all PAs in the Ashanti or Volta Region deciding not to sign pink sheets because they are on strike for salary or allowance increments or for any other reason. I hope we can now see Justice Adinyira's point.

2) No verification No Vote
As we are all aware, the petitioners claim was merely based on figures that were written on the face of the Pink sheet and which seemingly suggested that there were persons who voted without being verified. The petitioners never presented evidence from the Biometric Machine which suggested so. Neither did they bring some witnesses to court either by affidavit or otherwise to prove this. Imagine the 9 Justices had upheld this claim then they will have given a triumph card to POs to michievously insert figures just to get those votes nullified

3) The same goes for the Bawumia definition of over-voting
