I did my utmost not to waste my time following and commenting on this foolish case from its very beginning. But since it seems almost all have lost their senses, let me intervene.
As some of us rightly said from the very start, it was a frivolous case without merit. We expected a 9-0 decision against all the reliefs sought. Tsatsu, expecting such a similar decision, was simply trying to explain why some of the justices granted some of the petitioners reliefs when there are clearly no merit to them. The obvious explanation he adduced was the political leaning of some of the judges, and picked on Justice Anim-Yeboah who he claimed has a record of taking decisions based on political leanings. Yes, that's serious accusations indeed and rightfully deserves public perusal. Was Tsatsu wrong or right in his observation? He just came out to defend himself again, claiming he only spoke the truth. Anyway who wants to charge him for contempt of court is welcomed to, but wait a moment!
Commenting on how and why judges of the SC of the US voted a certain way is part of the legal scholarship and devt in that civilised nation. In fact, before a judge is appointed, he/she is perused extensively in the media and Congress about ideological leaning -whether liberal (Democrat) or conservative (Repub), earlier judgements on certain controversial issues, etc. This is repeated anytime a case is before the SC. Nobody is charged with contempt for doing that! Can you blokes therefore moved on?
After all, Tsatsu didn't start this questioning of the motives of the justices. since the case went to court, the justices seen as not pro-NPP, esp. Atuguba, have been under a barrage of abuses, attacks, long articles directed against him. After the verdict, it reached such a high crescendo that we can call it a deluge! What other accusations are there which you blokes can make against the justices who voted 9-0 against that foolish case which you haven't made already? Tsatsu fired only one warning shot into their camp and hell should break loose??? No, na scatter, wey dey scatter!
I know that he Tsatsu is an Anlo man and comes from a long line of traditional rulers on my Right wing, those who subscribe to the Anlo emblem and motto of one firewood cooking the meal (Naketsi Deka No Dzome Bi Nu). Yes, making sure that even one person on the battlefield could win the battle, since we Anlos didn't have 1000s to deploy after a 1000 were killed! So for us, it is One Man Thousand! I think Tsatsu has just proved again that, indeed, one firewood can cook the meal!
Even his uncle Sam Okudzeto (where was this uncle when his cousin was been steamrolled into Nsawam under all kinds of strange legal shenanigans such as under a law which was passed after Tsatsu guaranteed that loan to Valley Farm, padding the SC, etc., by his political cronies and bedmates?)was alarmed by the power the smallish, short man packed! Ele kpi do ga wui. "He is short but wears an iron armour." Well, he got his opportunity to vent his spleen and he did! Hollering about it won't change a thing! You blokes don't have the monopoly to be maligning and abusing respectable people, so bugger off, all of you!

Contempt of the law will normally apply when an ongoing case has been compromised by the actions of certain individuals not when after the verdict, a Judge is rebuked for his judgement.

One thing I have noticed over the years is that no matter how stupid and and dangerous the utterances of your leaders are, THE BEST YOU CAN SAY IS "I DONT CONDONE WHAT HE SAID". There are several instances that Tsatsu Tsikata mentioned as facts of the behaviour of this Justice Anim, an appointee of the Kuffour led NPP government and for which critical brain analysis must be conducted before just jumping to the "equalisation" bus!! Did you know Justice Anim mistook IFC as IMF for which injustice was carried out against Tsatsu in his famous "Causing Wilful Loss " to Ghana?? Even as much as when NDC was making arguments to be party to the "vexacious and frivolous Election 2012 Petition???
Ghanaians, Tsatsu has not made any Contempt of Court statement!! Why are people especially this MP who seems to have no time to cogitate deeper on this factual statement of an observation from instances outside this SC assessment. Tsatsu's statement is not only based on this judgement please!!! If what Justice Anim is purported of doing is truthful, which I believe is the case, because under Kuffour's regime, there was a calculated effort of imprisoning Tsatsu!! Why was Tsatsu invited to court without a prior information of having a judgement, at a time when his lawyer was out of the country, the court deem it "fit " to imprison Tsatsu??

After controlling the car, he stealthfully slid his hand up her leg. The nun looked at him and immediately said, "Father, remember psalm 129?"
The priest was flustered and apologized profusely. He forced himself to remove his hand. However, he was unable to remove his eyes from her leg.
Further on while changing gear, he let his hand slide up her leg again. The nun once again Said, "Father, remember psalm 129?" Once again the priest apologized. "Sorry sister, but the flesh is weak."
Arriving at the convent, the nun got out, gave him a meaningful glance, and went on her way.
On his arrival at the church, the priest rushed to retrieve a bible and looked up psalm 129. It Said, "Go forth and seek, further up, you will find glory."
MORAL OF THE STORY: Always be well informed in your job, or you might miss a great opportunity!

It is clearly because of the traits Justice Yeboah had displayed and displayed during the case.
Clearly, I did not see how failure by some presiding officers to sign pink sheets at dubiously selected polling stations should result in the cancellation of valid constitutionally mandated votes so as to make the person not voted for as a president.
Only judges who are using kindergarten logic in interpreting the constitution will give such a ruling.

Excerpts from Atuguba's reasoning- culled from a FB page
"The right to vote is fundamental to our democratic advancement and must be protected unless there is some compelling reason not to. Hence, in Article 42 of the Constitution, the framers entrenched the fundamental right to vote. It has been contended by counsel for the petitioners that the second respondent is mandated under the Constitution to oversee the conduct of public elections in this country. Counsel further contends that Article 49(3) makes it mandatory for the presiding officer to sign the declaration forms in the prescribed manner. Counsel for the first respondent has invited this Court to note that authentication is required to be done not only be the presiding officer but by the polling agents who are present at the polling station on election day.
I find that the petitioners do not dispute that their polling agents signed the declaration forms in the prescribed manner. I also find that the effect of the signatures of the petitioners’ polling agents is to confirm the information contained therein. There is no evidence before this court that the petitioners’ polling agents disputed or raised any protests regarding the information contained on the declaration forms at any of the polling stations complained of. Thus, the petitioners’ polling agents by signing the declaration forms in the prescribed manner represented to the world at large that the results recorded and declared by the presiding officer were a true reflection of the outcome of the elections at the polling stations complained of.
At this stage, it is vital to discuss the constitutionally entrenched right to vote discussed extensively in the cases of TEHN-ADDY and AHOMAH-OCANSEY (supra) as against the duties of the presiding officer to sign a declaration form that has been witnessed by all parties. Should this Court annul votes merely because of a presiding officer on polling day omitted to sign the declaration form in the prescribed manner? Especially, since the polling agents of all the parties involved were present and signed the declaration forms in the prescribed manner? I do not think so.
We have been urged by the respondents to apply the case of OPITZ V. WRZESNEWSKYJ SCC 55 [2012] 3 SCR. I am aware that this authority is persuasive but I find the principles set out by the Canadian Supreme Court to be relevant to the petition before us. Paragraphs 46, 56 and 66 of the OPITZ case are worthy of mention and proceed to do so:
“(46) The practical realities of election administration are such that imperfections in the conduct of election are inevitable. As recognized in Camsell v. Rabesca [1987] N.W.T.R. 186 (S.C.), it is clear that ‘in every election, a fortiori those in urban ridings, with large number of polls, irregularities will virtually always occur in one form or another’ (p. 198). A federal election is only possible with the work of tens of thousands of Canadians who are hired across the country for a period of a dew days or, in many cases, a single 14-hour day. These workers perform many detailed tasks under difficult conditions. They are required to apply multiple rules in a setting that is unfamiliar. Because elections are not everyday occurrences, it is difficult to see how workers could get practical, on-the-job experience.
(56) In our view, adopting a strict procedural approach creates a risk that an application under Part 20 could be granted even where the result of the election reflects the will of the electors who in fact had the right to vote. This approach places a premium on form over substance, and relegates to the back burner the Charter right to vote and the enfranchising objective of the Act. It also runs the risk of enlarging the margin of litigation, and is contrary to the principle that elections should not be lightly overturned, especially where neither candidates nor voters have engaged in any wrongdoing. Part 20 of the Act should not be taken by losing candidates as an invitation to examine the election records in search of technical administrative errors, in the hopes of getting a second chance.
(66) By contract, if a vote cast by an entitled voter were to be rejected in a contested election application because of an irregularity, the voter would be irreparably disenfranchised. This is especially undesirable when the irregularity is outside of the voter’s control, and is caused solely by the error of an election official.” [Emphases added.]
I find the above paragraphs very pertinent to the petition before us. The petitioners have not proved that the absence of the presiding officers’ signature was willful. Accordingly, I would dismiss the petitioners’ claim that the absence of the presiding officers’ signature on the declaration form is an irregularity, violation or malpractice and that same affected the outcome of the 2012 presidential elections." - His Lordship Justice William Atuguba of the Supreme Court of Ghana

Did he also analyse or took into consideration the actions and inactions of the president of the panel. How come he and two others never ruled in favour of the petitioners. Yes, and that is precisely the point that Prof Tsatsu Tsikata is trying to make. Most of these judges were appointed by President Kufour but the rest did not exhibit the very biased sentiments and nature that Anin Yeboah showed. And that is the point that Tsatsu elegantly made. You may not like the NDC as a judge but you don't have to oppose everything the respondents put forward.
And if you look at Anin Yeboah's prior judgement on the Tsatsu case, it is clear that Anin Yeboah is SO BIASED he has no business being a judge. Such a biased mind should NOT be allowed to sit at the court of the land.
Tsatsu's exposure of Anin Yeboah will go a long way to solidify Ghana's democracy
