DEAR READING PUBLIC OF GHANAWEB.COM,
THERE IS A WISDOM SAYING THAT "IF YOU LIVED IN A GLASS HOUSE YOU DO NOT THROW STONES" AND THAT AS I AM PERSONALLY AWARE IF IT COMES TO THE PROTECTION OF THE CONSTITUTION IT IS THE RESPONSIBILITY OF EVERY GHANAIAN AND NOT ONLY SOME WHO THINKS THEY ONLY DESERVED THAT ONEROUS PROTECTION.
IT IS AT THESE RELATED BACKDROP THAT I AM RESPECTFULLY RECALLING THAT "NO ONE PERSON IS PARAGON OF LEGAL BRAINS" AND TO PURPORT SUCH NOTION IS ONLY PAROCHIAL THINKING".
THAT SO FAR AS I AM CONCERNED THAT THE LEGAL REASONING BEHIND BOTH COUNSELS OF PETITIONERS AND RESPONDENTS AS WELL AS OUR DEAR LORD JUSTICES TO BE ASCERTAINED BEFORE WE CAN REASONABLY AND HONESTLY PURPORT TO BE CASTING "INSUNNATION" SINCE THE SAME ACCUSATION CAN AND COULD BE LEVELLED AGAINST THE SAME PERSON CASTING THE INSUNNATION.
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
THAT I AM NOT YET APPRISED OF THE FULL JUDGEMENTS OF THE SUPREME COURT" TO FIND OUT WHETHER THAT LEGAL DEFECTS HAVE BEEN CURED OR THE PRESIDENT OF GHANA WAS MADE A LITIGANT IN THE CASE WHICH THE FRAMERS OF GHANA 1992 CONSTITUTION AND PEOPLE OF GHANA NEVER CONTEMPLATED AND THEREFORE CLEARLY PROVIDED FOR THOSE PROVISIONS.
THAT I HAVE ALSO NEVER SEEN IN THE C.I.16 A PROVISION MADE FOR "STATEMENT".
HOWEVER, SINCE LITIGATION SHOULD HAVE FINALITY THAT I AM RESPECTFULLY URGING ALL GOOD PEOPLE OF GHANA AND GHANA'S FRIENDS ALL OVER THE WORLD RATHER TO MAKE SCIENTIFIC, CONSTRUCTIVE LEGAL ANALYSIS OF THE CASE WHICH WOULD HELP TO CONTRIBUTE TO THE DEVELOPMENT OF GHANA JURISPRUDENCE AND TO PURPORT TO RESORT ON THE CONTRARY WOULD ONLY BE A FRUITLESS AND TIME WASTING EXERCISE.
GOD BLESS GHANA AND LONG LIVE GHANA.
VERY TRULY YOURS,

If people were imprisoned for just making comments about the SC case, how much more will Atuguba be left free for lying to the whole world about the stance of one or more of the judges? If a judge upholds a voting without biometric verification, how can Atuguba lie to us by saying the very opposite of what was rightfully stated by the judge in question? On the 29th of August, I told you Atuguba will be judged by God Almighty before the day ends the next day so you see, I told you so. Atuguba must be imprisoned for life.

Before the verdict, some of us thought that the ordinary supporter of the NPP and NDC wee those likely to disturb the peace. They would not understand the technicalities of waht wen tinto the judgement and would have been swayed by the mere fact that their party won and the other persons' party lost. The winners would have taunted the losers and, in the process, caused commotion in the country.
But from the look of things, it is our educated and highly placed persons who are the threat. With Mr Tsikata's condemnation of Justice Anin-Yeboah, Gabby's description of the judgment as quoted here, some NPP leaders castigating Nana Addo for his quick concede of defeat, Vice-President Amissah-Arthur and Asiedu-Nketia's rubbishing of the NPP taken the case to court at all etc. etc., I am convinced that it is our leaders who do not understand and appreciate the democracy they profess, and to a large extent do not want peace.
For how does one explain any criticsm of NPP going to court over what it perceived were irregularities in the election, when the courts were the only prescription the constitution provides for such electoral situations. And how does one single out a single panel member for criticism when it was clear each member took individual decision on the issues brought before the court which were finally joined to form a single judgement? Then consider again, people criticizing Nana Addo for quickly conceding defeating, an act he had promised the people of Ghana all through the trial period. Has those people considered the impact of that quick decision; how that pronouncement immediately relieved Ghanians of the huge fear of mayhem and even war hanging over them?
WE, ordinary Ghanians have wholly accepted the SC verdict and are going about our normal lives as if nothing has happened in our political landscape. So why, why and why, our leaders?
In fact I am tempted to believe in the often cited case that Ghanian leaders ARE THE REASON FOR FREQUENT TENSIONS AMONG VARIOUS GROUPS AND THE KEY CONTRIBUTORS TO OUR UNDERDEVELOPMENT.

When a court disregards facts presented in a case and acts in a manner which can only be classified as ultra vires, it loses its legitimacy and perception as a fair and impartial arbiter. When a judge who is related to a person with substantial interest in the outcome of a matter before the court refuses to recuse himself from the case, as was the case between Atuguba and his nephew Raymond Atuguba who works for the Mahama Executive Secretary, it brings decision of the court into disrepute. Was Mahama wearing white before the decision was even announced because uncle Atuguba tipped off nephew Atuguba about the court's decision? And why would the Chief Justice not preside over a case with such great national import and appoint a judge who was obviously conflicted and compromised to preside over this case? And why were there errors in the judgment? And why was the judgment not accompanied by opinions explaining the basis for each judges decision? The court has ruined its legitimacy, public perception and stature and it will take great effort to regain public trust.

The panel was definitely going to declare Mahama/NDC the victors, I knew that right from the beginning. NPP should have stood their grounds to refuse Atugugba as the head of the panel due to his interest in the matter being that his cousin was close to Mahama. How can NPP say that they lost the election because of irregularities? They have not been able to prove its occurrence and for that matter how it favored NDC. NPPs logic is seriously seared. Why do I say this? Can you imagine two boxers in a ring, same ring, and one losing the fight and blaming it on the slippery nature of the boxing ring? Assuming that it was true that the ring was slippery, were both boxers not in the same ring so that both boxers were equally impacted? Why would NPP claim victory for the same condition that impacted them during the election? Another analogy, why would a failed candidate in an examination claim pass candidates were favored by difficult questions set by the examiner? This failure can only be attributed to inadequate preparation by the failed candidate. NPPs message did not convince electorates – free education… everything was hooked unto free education. All die be die deducted marks, kill all Ewes, Gas by leading members, at all cost… and twisting of facts on discussion programmes, the candidates, yen akanfo> etc. They should stop accusing the SC judges of bias when they have not been able to produce a single evidence to prove even a single vote cast by filling complaint form. This case is a frivolous case indeed, it should have been thrown out long ago. When you listen to them you marvel, they are twisting the judgment to mean that SC has given the green light for over voting, voting without BMV, presiding officers need not sign the documents. Only seared minds could be making such deductions.

Party and tribalism has blinded your eyes and all your education is useless now! If you're indeed a law lecturer, apply it so that other people benefit from it. You are too black and African in the way you conduct yourself. Allow people to express their disappointments in whatever way possible. There is none left; no; not at all any credible court left to either right the wrongs, injustices in the Ghanaian society, the courts on our land are NOT FIT FOR PURPOSE! You're all living in animal kingdom; you can kill, rob, rape, steal or do any harm unthinkable to your fellow human in Ghana and go free-no worries! Because of little money People like you have sold your souls for peanut! Shame on you Ernest Kofi Abotsi.
