Gersis, by your own comment you agree it's quite distasteful to say what I've attributed to Tsatsu in the article. Well, guess what, the man said that and even worse things. In fact, not only did he say that he has better grasp of the law than the petitioners' counsel, but he also claimed that they can never ever dream of attaining his level of knowledge of the law in their lifetime. After the interview, I had a call from two friends, both of whom were shocked by Tsatsu's comment. That's when I decided to write this article. So, Gersis, I'm as shocked as you're that someone like Tsatsu would say such things.

1. Note that I agreed with Tsatsu that it was improper for Justice Anim-Yeboah to refer to IMF Articles of Agreement because the IFC is a member of the World Bank Group (WBG), not of the IMF. More appropriately, he should have quoted from IFC/World Bank articles of agreement.
2. Nevertheless, also note that I also pointed out that the effect wouldn't have been different because both the WBG and the IMF, as members of the UN system, derive their immunity clauses, which are written into articles of agreement, from the same source, the contentious 1946 UN Convention on Privileges and Immunities.
Yes, anyone who is a practioner of profession forever remains a student of it. But it's ridiculous to base the supposed superiority of your knowledge, or legal arguments, relative to another's, on you having once taught the latter. It's even worse to hold an opponent lawyer in utter contempt for the same reason, as if being your former students made them permanently inferior to you. No serious academic worth his salt behaves like that.
So, yes, let's now focus on our attention on "our sinking economy". But you must address your advice more appropriately to the likes of Tsikata because their comments have the potential of poisoning the atmosphere.

1. Retroactive punishment occurs when a law or an ordinance is passed to apportion sanction on an action that has already taken place. Retroactive punishment is therefore the consequence of retroactive or post facto legislation.
2. In the particular context of the Election Petition trial, the relevant law on which the petitioners were basing their claims already existed at the time of the 2012 elections. However, Tsatsu's argument is that you cannot punish voters for the failure of electoral officers to do their public duty. That's vicarious penalisation. Pure and simple! As to whether the claim is sound is completely another matter.

Kwame, your question actually reinforces my position. If that's Tsatsu's concern then the term "retroactive penalisation" is a mischaracterisation. Now, as to whether voters cannot be punished for the mistakes of presiding officers is a matter for the judges to decide applying the law. Unfortunately, we're yet to see the reasons behind the way the judges voted. I'd rather wait than speculate, except to say that votes were cancelled in some polling stations where there was an over-vote by one ballot. Certainly, all the voters in those polling stations were punished for the crime or mistake of one voter, don't you think?
Secondly, it's factually untrue that "every adult in the world have the right to adult universal suffrage" (sic).

1. I wasn't his student, will never be, so his primitive pedagogical ideas don't affect me, unless he also thinks that no one else can ever study law and become as good as he thinks he is, in which case the man's hubris would be reaching divinely tragic proportions.
2. I studied in the same universities from Tsatsu received his education and also earned a first class. You must see why, while I respect him as an older person, I'm not intimidated by his so-called superior, or rather gnostic, knowledge.

If I may ask, is vicarious liability not a law requiring action to be brought against employers for wrongful acts perpetrated by employees? In this instance, the electoral officers were not employed by the Ghanaian voting public, so I contend that Mr. Tsikata was correct in using the adjective "retroactive" instead of "vicarious." "vicarious penalization" is a situation where a person suffers the punishment of another's wrongdoing. For instance, father jailed for son's stealing of a goat. “Retroactive penalization” on the other hand comes about when one made to suffer punishment prescribed by a newly enacted law for committing a crime in the past.
Now to the supreme court chamber. Mr. Henderson, when Mr. Tsikata was arguing his case he made reference to both terms. Although he did not expressly mention "vicarious penalization" it was at the center of his argument.
He pontificated that although the 1992 Constitution mandates a presiding officer to sign the results at the end of the polls it has not indicated what punishment should be visited upon him who fails to do so; neither has it shown a remedy. in that case, per his argument, not even the presiding officer can be punished, talk less of the innocent voters whose inalienable right the petitioners sought to revoke.
Annulling the votes is tantamount to "vicarious penalization" - punishing the voter for the wrongdoing of the presiding officer.
Meanwhile, he stressed that even if the court was to prescribe a punishment for culprit presiding officers, that should be applied prospectively (i.e. to subsequent elections, not retrospectively (i.e. to past elections). That was when he mentioned "retroactive penalization".
He made this point to rule out any possible cancellation of votes.
In any case the petitioners failed miserably to bite at the cherry; why waste your ink and efforts and time writing provocative articles to dent the image of Ghana's legal dinosaur.
