So the Tsikata case was ruled while he was away. As soon as he came back he packed the court with judges who overturned the Tsikata case.
We've all seen what's happening in Egypt where the security forces have stormed the mosque on a Friday when they were praying. What difference is this from what President Kufour did when Tsikata was arrested in Church?

Anyway, the packing of the Court could be as many as the whole membership and as few as only one member to ensure a desired verdict on a case. So, it would not matter if Kufuor had to add only one Judge of his choice that he trusted could help overturn Tsatsu's verdict. You know better.
I personally do not argue much about the constitutionality of Kufuor's action in expanding the membership of the Court. It is the timing, the choice of Judge and the utterances Kufuor was alleged to have made about the case while he was half the World away in the East that jointly casts his action in grave suspicion.
However, he showed a certain class that we could not see much on the other side, by pardoning Tsatsu. I wish the other side could that compassionate. We would not be dealing with the horrible conflict of shadow-ethnic feuds of today.

Kufuor's pardon came at the ninth hour not because he thought Tsatsu merited it. For, how do you elucidate on a frivolous and wasteful court case that dragged its ugly legs for long even with the court's refusal to allow Tsatsu's witnesses and in certain cases haul him before it without his counsel, only for Kufour to beat an about face brandishing a "presidential" pardon?
Tsatsu would have died in prison had NPP won the 2008 elections. Kufuor and NPP were didn't anticipate a loss. In a poorly orchestrated finish Kufuor dreaded retribution by NDC. He thought his ministers would be held accountable for the rampant thievery and banditry they visited on Ghanaians for their 8 years of stewardship. Had Mills been rational, logical and honest with himself about 98 percent of NPP ministers would have been in jail. So much the financial loss on which was based the trial of Tsatsu and jail sentence was manifestly endemic in NPP administration of Kufuor.

Are you that unbelievably shallow????? I will not be reading any of your articles again. The sinister move behind Kuffour's pardon is palpable, even to the ardent NPP stalwart. Case in point, his chief-of-staff, Mpiani was all over the place being arrogant, telling all Ghanaians that the NPP owns no explanation/accountability on how they rule Ghana and that they have the mandate and even refusing all media interviews. But when the NPP lost, he was chasing after all radio stations even calling in to radio stations without invitation to give them an interview. Why this 180 degree turn around? Because, the majority of Ghanaians(i.e. more than 50%) were asking for him to be sent to jail for his arrogancy alone. Atta Mills deserves all the praise for not being vindictive. I'm all for the presidency changing hands every few terms to deepen our democratic process. Berko, you missed the boat on this one!!!!!

If Kufuor indeed packed the Supreme Court, don't you think it is silly to see Mills/Mahama doing the same, and not leaving it as it is so that the number dwindle down. How many of you have bothered to check the number of Supreme court judges we have now.
When Kufuor left we had 10 judges, but from 2009 to 2012, 4 judges have been added to that number to bring it to 14. Not 11 or 13 but 14. Is there any sense in this? This is what patriotic people need to talk about.

Not only that, at the time of the decision, Kuffuor was abroad, upon hearing the news, he stated that he was surprised at the ruling cos he had actually met the judges and was convinced that the fast track court would be ruled constitutional. Exactly, he tried to influence the decision.
Kuffour was ok. Thats it, he was not extra-ordinary, he certainly was not an orator, made claims that were mostly not true and frankly speaking, was not an inspiring president. Stop giving him a pass all the time, Ghana was not that great under him

There are many who have said that, Rawlings penalized Justice Afreh, who was Dean of the Law School because he refused to work with him during the AFRC time. So even some of the judges believed that it was right to bring him on board at the SC.
But that is not what I want to worry my little head over. I want to see Ghana move on and stop those pettiness. The people change government for a reason and that is, they want to see improvement in their lives and institutions. You on the other hand keep on dwelling on the past and blame everything on the past. And yet, the same mistake is being made over and over and over. When can we move on?
I still believe that, it was wrong for Mills/Mahama to replace those judges who retired or died.

History is such a bad teacher. History teaches you lessons or courses that are bound to repeat themselves in your later years. The ones who take or took their lessons serious always enjoy having an easy time in the later years. Those who don't always scratch their heads with their pens and try to think when they should know.
This is why we have case laws and if you look hard, you will understand why we keep records(not our strongest attribute in Ghana).
I am only saying the trend changed in Atta's time whatever your argument and we must let history guide us to change it further but denying the past is not clever. Currently, there is no cap or limit to the Supreme Court Judges and no leader is ready to make that change. Even the Constitutional Review could not do anything. And that is why it is important to move and demand accountability from our leaders.

Like you said, even the Constitutional Review Commission is not taking this issue of how many Judges we need up.
I wonder when Ghanaians will see the use of petitions to Parliament or the Presidency to change the course of issues in Ghana. Is it because we know we are secretly part of the problems?
We leave too much to leaders and forget they are humans and will also try and satisfy themselves if not under pressure.
I think Ghana first all the time, but always realize Rome was not built in a day.

It is good to use history for our future but in our neck of wood, that is not what happens; we only use history to condemn or find faults with our perceived enemies. If not, why should they continue to replace a supposedly "packed" court?
Just listen to the petition; if we have not learnt anything, we know that the election has its shortcomings. Yet, some of you believe otherwise. My problem has not been who will win this case, because NDC and NPP are the same, but how will we learn from the imperfections of the election and organize a better one in 2016. But Braveboy, 2016 will come and nothing has happened; that has been my problem with the system .

Now, Nyansasem clearly pointed out that the massive U.S of A. with a population of 375 million could only append the signature of 9 souls to the Supreme Bench of that land. Thence, a less developed country such as ours is instead parading 14 souls unnecessary to the Supreme Bench at our expense.
Such, I deduced, is the simple concept in his argument. Not Kweku Baako Jr. reference of John Agyekum Kufuor not packer the Supreme Bench to the brim or Atta mills replacing the retired ones during his tenure in office. But, the need to cut the size down to an acceptable level and then maintain the status quo from henceforth. That, I think, is his clarion chorus.

Mr Justice Afreh said he was told that he was nominated for Supreme Court membership in 1995, 1997 and 1999 adding; "I do not know why my nomination was shelved. It was best known to whoever did that. It is now my time."
Mr Justice Dixon Kwame Afreh, 68, an Appeal Court Judge with 31 years of legal practice was on Tuesday sworn in as a member of the Supreme Court by President John Agyekum Kufuor. Justice Afreh was born in Kumasi on March 25, 1933 and was admitted to the Ghana Bar in September 1961.
He had his second cycle education from 1949 to 1954 at Achimota School. He then left for the University of Birmingham, England for his LL.B between October 1955 and July 1958 and continued to the University of London, England between October 1958 and October 1960 for his Master's in Law.
He was called to the English Bar in February 1960 at the Lincoln's Inn, London. Between 1962 and 1975, he lectured at the Faculty of Law, University of Ghana, Legon, rising to the positions of Senior lecturer, Acting Dean of Law Faculty and Acting Hall Master of Commonwealth Hall in 1974.
Justice Afreh worked at the Attorney -General's Office as Chief State Attorney between 1975 and 1978. In April 1973 to June, 1980 he worked with the General Legal Council as Director of Legal Education. He later joined the Pan African News Agency (PANA), in Dakar, Senegal between June 1981 and October 1992 as Head of Administration and later becoming the Financial Controller from 1989 to 1992.
Between September 1978 and June, 1979 he became Commissioner for Information and Cocoa Affairs under the AFRC regime. He was also a Deputy Commissioner for the Electoral Commission between 1992 and 1994 and was appointed a Justice of the Court of Appeal of Ghana in June 1994.
Members of the Minority National Democratic Congress (NDC) in Parliament opposed the nomination of Mr Justice Afreh contending that the timing was inauspicious since the state was seeking a review of the Supreme Court's decision that the Fast Track Courts were unconstitutional.
They went ahead and boycotted the vetting and did not cast their vote when the full House met to consider the report of the committee but Justice Afreh obtained 104 votes with two abstentions in a secret ballot. He thus obtained more than 98 per cent of the votes, even though; he needed only 60 per cent.
The NDC members of the Parliamentary Appointments Committee walked into the meeting halfway during the vetting to say that their boycott was not against the person of Mr Justice Afreh and walked out.
Mr Alban Bagbin, the Minority Leader, accompanied by four other members took their seats that were earlier occupied by other non-members of the committee. Mr Bagbin after obtaining permission from the Chairman, Mr Freddie Blay, congratulated Mr Afreh on his nomination and possible appointment to the Supreme Court.
Mr Bagbin said the Minority was not against the nomination of Mr Afreh as a person. "We don't have any grudge or a case against Mr Afreh. We were in the same chambers together." Mr Afreh retorted; "you are one of the younger lawyers. I regard you as my son," (Laughter).
Mr Bagbin replied; "I definitely regard you as a father and congratulate you on your nomination. “It is important to put on record that the Minority is not directing the boycott against you in person. We are protesting against a bad precedent that the government is setting that will affect the development of democracy.
"In the letter of your nomination it was stated that you were being elevated to enlarge the Supreme Court panel in view of the impending review of the review of the decision of the Supreme Court on the Fast Track Courts."
He said that if the practice were allowed to continue then it would open the gates to add to the number of Supreme Court judges anytime a review was needed. "We want to let the people know that we are not part of that process. Our intention to boycott is to raise the issue and not that we are not happy about you in person but that we are sorry it is happening to you at this time."
Immediately Mr Bagbin finished his statement he walked out together with the four other Minority members of the Appointment Committee. Mr Justice Afreh in an answer to a question before the Minority walked in expressed regret about the boycott of his vetting by the Minority saying; "I would have been happier it they were here to listen to me."
Mr Justice Afreh told the Parliamentary Appointment Committee that except the Chief Justice, Mr Edward K. Wiredu and a few others, the rest of the justices of the Supreme Court, Appeal Court and High Courts were his students.
"Most of those who were not were too young to be," he said with laughter. The former Vice President, Professor John Evans Atta Mills, Kwamena Ahwoi and a host of current and former ministers and MPs including Alhaji Mohammad Mumuni, MP for Kumbungu, who was very vocal in the boycott by the Minority against his nomination, had all been his law students, he told the committee.
Mr Justice Afreh said he was told that he was nominated for Supreme Court membership in 1995, 1997 and 1999 adding; "I do not know why my nomination was shelved. It was best known to whoever did that. It is now my time."
Referring to the timing of his nomination when there were indications that he would be sitting on a review of an earlier decision of the Supreme Court, Mr Justice Afreh said the critics were not challenging his qualification and merit to that office.
"There has not been reference to my achievements, which could have addressed the fears of those MPs, who have declined to participate in my vetting. I have not been comfortable for a week now since my nomination." He said he qualified to be a member of the Supreme Court long ago "and if today I am to go there then I console myself that this is the time for me to go."
Mr Justice Afreh said; "my nomination and if I am appointed would be a matter for the future. I don't believe in crossing the bridge before coming to it. My going to the Supreme Court will not be whether it is appropriate for me to sit there or not." He dismissed the claim that he was going to be at the court to be a judge in his own court saying; "I am not an accused in the Fast Track Court case nor a party to any suit.
"Even though, I was sitting at the Fast Track Court I don't think that constitute grounds for me to be labelled as a judge in my own case. To be a judge in your own case means that you cannot arbitrate in a particular case where you have interest."

I'm shocked by some of the comments I'm reading here. Tsatsu's sophistry and NDC's propaganda seem quite effective in winning over the mob. But it should be very clear by now why in spite of his acclaimed legal scholarship, Tsatsu has failed to establish himself as a prominent advocate. Rather than arguing on substantive law, Tsatsu's only trump card is marshaling his sophistry to split hairs over technical points and confuse judges. Let's take a couple of cases to illustrate this.
1. In the GNPC case reported here, from the High Court to the Supreme Court, Tsatsu never challenged the substantive facts of the charge on causing financial loss to the state. First, at the "Fast Track" High Court (FTC) and Appeals Court, Tsatsu argued that even the IFC thought the project for which the GNPC lent out its money was a sound project, and wanted a senior IFC officer to be subpoenaed to testify. Of course, even if the IFC official had showed up to testify that the project was sound, this still wouldn't have eliminated the fact that Tsatsu gave out GNPC money as loan without reference to the GNPC board and that the borrower defaulted, thereby causing financial loss to the state for which Tsatsu could be held liable.
Again, when he was found guilty in both courts and the matter ended up in the Supreme Court, Tsatsu's initial strategy was to challenge not the charge of causing financial loss to the state, but the constitutionality of the "Fast Track" High Court (FTC) that initially found him guilty. When the state went for a review of the SC decision declaring the FTC unconstitutional, Tsatsu, once more, went for a technical point, this time focusing on the argument that the law on causing financial loss to the state was being retroactively applied in his case. In other words, he was claiming that he gave out GNPC money to his cronies before the law came into being. The review panel, by majority decision, disagreed with Tsatsu's claims and he went in to do time!
2. The second high profile case Tsatsu has recently been involved in is the Election Petition. Here, as lawyer for the NDC, Tsatsu has again focused on technicalities and confusing the judges as his trump card. By the time case ended, he had pulled the rabbit of the bag: "retroactive penalisation", a term that in itself admits, as in the previous case above, that there has been a violation of the law. If Tsatsu's attempt to seek refuge under the much-accepted legal principle of "retroactive legislation" didn't save him, I don't see how his strange notion of "retroactive penalisation", which is a misnomer because punishment is exacted retroactively for an offence already corrected, can save the NDC.
A final point worth noting: in both of the two cases above, Tsatsu has tried to block institutional development in the country in order to save his own skin or that of his client. In the first case, he opposed the automation of court processes, i.e. "fast track" courts, on the frivolous excuse that the constitution doesn't mention or acknowledge automated courts. Incidentally, in the matter of the Election Petition, the man has also singularly opposed the use of digital material. But more importantly, he is also seeking to prevent the activation of important but untested electoral laws in the constitution. Why is Tsatsu always standing against the tide of progress? Mind you, even in the area of human rights, the NDC law luminary was the architect of the kangaroo courts and the indemnification of the PNDC era.

This phenomenon has given rise to what has derisively become known as "stomach journalism",under which 'govt-sponsored' media houses and or agents were allowed to dominate our airwaves under a corporatist arrangement.
Thus you find this Kweku Baako guy with Gabby Asare Otchere-Darko being sponsored on a "unofficial" investigative junket purposely to dig up 'dirt' on fmr. Pres. Rawlings and his wife. And even though the duo came back empty-handed, these dubious characters were able to fill our airwaves with total rubbish in a series of carefully choreographed publications that lacked substance.
Take a critical look at these two guys and others who operate in a similar fashion, and you can understand why this nation is such a big mess!

There is nowhere in the constitution which provided that if the Supreme Court sat with a minimum of 7 or more, extra judges should be introduced for review purposes. It's a Big Lie. Once the original court that heard the case first meet the required quorum for a review there is no need to increase the number. This was one major blunder committed by Kuffour which cost him the Mo Ibrahim award for ex-presidents. Indeed this conduct of packing the Court was expressly condemned by the African Peer Review Commitee on ex-presidents. And that Comittee is made up of seasoned and learned leaders. Kofi Baaako can not know better than them. This Baako guy spent the whole of 2001 to 2008 defending Kufour and he continues to do so.

But Atuguba and others maintained that it was constitutional, set up to speed up the delivery of justice in our courts.
It really comes as no surprise to learn that Justices Kpegah and Theodore Adzoe, the two "Ayigbe" companions, all ruled in favour of their "country-man",Tsikata. Afterall, that's what this group of people are noted for! Who doesn't know? I'm optimistic that given Atuguba's commitment to truth and fairness and peace, justice will be served on August 29. Atuguba will do it again, with majority support from his colleagues, because the petitioners have a genuine case. The case is a bad

How Tsikata was arrested during a church service on Sunday as he Tsikata will runaway; Prison vehicles were waiting at court ready to take Tsikata away to jail at the start of the case - how did prison authorities know the verdit ahead of the court. Usually Police vehicle take people from court to prison- so who inform prison authorities before the trail started - maybe Kuffour and his friends. How come Kweku avoided all these suspicious acts that points fingers to the Kuffour and his government and many more? Stop the lies, Kweku. But if I may help you with the Political undertones of the times in which Tsatsu's case occurred, it would be necessary to bring your attention to the fact that the advent of the NPP Administration to power was seen by many in that Party who loathed J.J. Rawlings and all he had ever done politically, as an opportunity to deal vengeance on him for whatever pain he had caused them. And in doing so, all J.J.'s lieutenants were possible targets.
These anti-J.J. folks in the NPP, if not every single member of the Party, saw Tsatsu as Rawlings' legal brain who had directed many if not all the legal processes under the various Administrations that J.J. led, including the AFRC.
Tsatsu, therefore, was a prime target for the Kufuor Administration in its silent, least-mentioned and possibly later-abandoned aim of making life for Rawlings a hell on Earth.
With regard to the packing-of-the- Court complaint, while it might have been fully legal for Prez. Kufuor to expand the membership of the Court, it is the timing and the choice of Justices he added to the nine who ruled for Tsatsu that raised eye-brows.
Then also, we cannot overlook any utterances he made on the Case, at that time, that some folks have referred to.
I understand how many who support Kufuor and any idea to punish Tsatsu for previous guidance to Rawlings would do everything to spin the facts and the spirit of the issue to claim perfect neutrality of Kufuor's action.
Even the appearance of impropriety could cast a long shadow on what our leaders do. So, we should not play dumb to these issues, and assume others are all dumb, too, and wouldn't see through any charade.

Afreh sworn in as Supreme Court Judge
Mr Justice Dixon Kwame Afreh, 68, an Appeal Court Judge with 31 years of legal practice was on Tuesday sworn in as a member of the Supreme Court by President John Agyekum Kufuor. Justice Afreh was born in Kumasi on March 25, 1933 and was admitted to the Ghana Bar in September 1961.
He had his second cycle education from 1949 to 1954 at Achimota School. He then left for the University of Birmingham, England for his LL.B between October 1955 and July 1958 and continued to the University of London, England between October 1958 and October 1960 for his Master's in Law.
He was called to the English Bar in February 1960 at the Lincoln's Inn, London. Between 1962 and 1975, he lectured at the Faculty of Law, University of Ghana, Legon, rising to the positions of Senior lecturer, Acting Dean of Law Faculty and Acting Hall Master of Commonwealth Hall in 1974.
Justice Afreh worked at the Attorney -General's Office as Chief State Attorney between 1975 and 1978. In April 1973 to June, 1980 he worked with the General Legal Council as Director of Legal Education. He later joined the Pan African News Agency (PANA), in Dakar, Senegal between June 1981 and October 1992 as Head of Administration and later becoming the Financial Controller from 1989 to 1992.
Between September 1978 and June, 1979 he became Commissioner for Information and Cocoa Affairs under the AFRC regime. He was also a Deputy Commissioner for the Electoral Commission between 1992 and 1994 and was appointed a Justice of the Court of Appeal of Ghana in June 1994.
Members of the Minority National Democratic Congress (NDC) in Parliament opposed the nomination of Mr Justice Afreh contending that the timing was inauspicious since the state was seeking a review of the Supreme Court's decision that the Fast Track Courts were unconstitutional.
They went ahead and boycotted the vetting and did not cast their vote when the full House met to consider the report of the committee but Justice Afreh obtained 104 votes with two abstentions in a secret ballot. He thus obtained more than 98 per cent of the votes, even though; he needed only 60 per cent.
The NDC members of the Parliamentary Appointments Committee walked into the meeting halfway during the vetting to say that their boycott was not against the person of Mr Justice Afreh and walked out.
Mr Alban Bagbin, the Minority Leader, accompanied by four other members took their seats that were earlier occupied by other non-members of the committee. Mr Bagbin after obtaining permission from the Chairman, Mr Freddie Blay, congratulated Mr Afreh on his nomination and possible appointment to the Supreme Court.
Mr Bagbin said the Minority was not against the nomination of Mr Afreh as a person. "We don't have any grudge or a case against Mr Afreh. We were in the same chambers together." Mr Afreh retorted; "you are one of the younger lawyers. I regard you as my son," (Laughter).
Mr Bagbin replied; "I definitely regard you as a father and congratulate you on your nomination. “It is important to put on record that the Minority is not directing the boycott against you in person. We are protesting against a bad precedent that the government is setting that will affect the development of democracy.
"In the letter of your nomination it was stated that you were being elevated to enlarge the Supreme Court panel in view of the impending review of the review of the decision of the Supreme Court on the Fast Track Courts."
He said that if the practice were allowed to continue then it would open the gates to add to the number of Supreme Court judges anytime a review was needed. "We want to let the people know that we are not part of that process. Our intention to boycott is to raise the issue and not that we are not happy about you in person but that we are sorry it is happening to you at this time."
Immediately Mr Bagbin finished his statement he walked out together with the four other Minority members of the Appointment Committee. Mr Justice Afreh in an answer to a question before the Minority walked in expressed regret about the boycott of his vetting by the Minority saying; "I would have been happier it they were here to listen to me."
Mr Justice Afreh told the Parliamentary Appointment Committee that except the Chief Justice, Mr Edward K. Wiredu and a few others, the rest of the justices of the Supreme Court, Appeal Court and High Courts were his students.
"Most of those who were not were too young to be," he said with laughter. The former Vice President, Professor John Evans Atta Mills, Kwamena Ahwoi and a host of current and former ministers and MPs including Alhaji Mohammad Mumuni, MP for Kumbungu, who was very vocal in the boycott by the Minority against his nomination, had all been his law students, he told the committee.
Mr Justice Afreh said he was told that he was nominated for Supreme Court membership in 1995, 1997 and 1999 adding; "I do not know why my nomination was shelved. It was best known to whoever did that. It is now my time."
Referring to the timing of his nomination when there were indications that he would be sitting on a review of an earlier decision of the Supreme Court, Mr Justice Afreh said the critics were not challenging his qualification and merit to that office.
"There has not been reference to my achievements, which could have addressed the fears of those MPs, who have declined to participate in my vetting. I have not been comfortable for a week now since my nomination." He said he qualified to be a member of the Supreme Court long ago "and if today I am to go there then I console myself that this is the time for me to go."
Mr Justice Afreh said; "my nomination and if I am appointed would be a matter for the future. I don't believe in crossing the bridge before coming to it. My going to the Supreme Court will not be whether it is appropriate for me to sit there or not." He dismissed the claim that he was going to be at the court to be a judge in his own court saying; "I am not an accused in the Fast Track Court case nor a party to any suit.
"Even though, I was sitting at the Fast Track Court I don't think that constitute grounds for me to be labelled as a judge in my own case. To be a judge in your own case means that you cannot arbitrate in a particular case where you have interest."

I'm not surprised though. Whe they were being persecuted and jailed by Acheampong, they called for an Ewe to liberate them. He later became an enemy. When Nkrumah threw them into prison and they were not brave enough to topple him, they called on an Ewe, Kotoko to liberate them.

He's forgotten that he was not the only person jailed by Rawlings. His colleague ex-convicts are very objective but he, as said earlier, has taken an entrenched position like a mad man does and so one wonders what sense such a person makes for anyone to continue listening to him or publishing what he says. How can he say Kuffuor did not pack the judiciary? Does he know what we mean by judicial independence and he tried to allude to it? As long as judges continue to be appointed by the presidents, there's nothing like judicial independence. I can't appoint you, send you for a purpose and you'll disappoint me. That was exactly what happened in Kuffuor's case. Judges will only be said to be impartial when we begin electing them like MPs.

We stated on the day Mr. Tsatsu Tsikata was sentenced that there was an absurdity by the Justices of the Supreme Court on the matter of Cocoa Farm has nothing in common with oil exploration. We can also then conclude that education has nothing to do with farming. An answer to the illogical conclusion above is that the University of Ghana has an agricultural department, thus need an agricultural research farm and have them.
Crude oil exploration need a lot of things down stream, including an agricultural research farm to carry on experiment. Ghana is cocoa exporting country that depends on small scale farmers and there is the need for commercial scale cocoa farms and that was what Tsatsu Tsikata went into.
A crude oil extracting company that has even a small fertilizer plant need a farm that it owes alone or with other to test her products. The justices were just daft on that issue, or ruled to please Kufuor and Akuffo Addo.

Mr. Tsatsu Tsikata, lead Counsel for the National Democratic Congress in the ongoing election petition filed by three leading members of the New Patriotic Party, is certainly one of the most brilliant personalities of our generation. That is without question.
At the age of nine, he was a student of the prestigious Mfantsipim School in Cape Coast. Five years later, he was at the University of Ghana, Legon, going through the paces that would qualify him for the first degree in law.
When he graduated from the nation’s premier institute of higher learning with LLB, he was barely 18, the age when most Ghanaians were in their first or second year at the secondary school. At the University of Ghana, where he was lecturer in law until the coup of December 1981, he was adored by his students.
With Jerry John Rawlings in the saddle after the December 31 coup d’etat, Mr. Tsatsu Tsikata, born at Keta in the Volta Region in December 1950, became one of the advisers to the Chairman of the Provisional National Defence Council, and thus one of the most powerful men in this land of our birth.
On June 18, 2008, Mr. Tsikata was sentenced to a five year jail term, for willfully causing financial loss to the state. He was said to have guaranteed a loan of GH¢230,000 of state money to Valley Farms, a private venture, from funds provided by Caisse Central, now Agence Française de Development in 1993, while he was Chief Executive of the Ghana National Petroleum Corporation.
Barely five months later, Mr. Tsikata was released, pardoned by then President John Agyekum Kufuor. Last week, on the fifth anniversary of his incarceration, the former Chief Executive of GNPC celebrated his release by issuing a press statement. State-run Daily Graphic published the piece titled “Five Years On – His mercies never fail.” The article featured in almost all the newspapers, classified by Mr. Martin Amidu, former Attorney-General, as “Criminally-rented NDC press.”
Mr. Tsikata saw his release after barely five months in prison as a miracle. “Five years ago,” wrote Mr. Tsikata, “on June 18, 2008, a judge, without any advance indication that she was going to deliver judgment, pronounced a sentence of five years imprisonment on me.
“I was taken that afternoon to the Nsawam Medium Security Prison to begin serving my sentence. Within five months of that day, however, I was out of prison and alive in circumstances that were nothing short of a miracle,” he wrote.
In brief, Mr. Tsikata was telling the world that prison conditions were horrible. He suffered an asthmatic attack on the night the doors of the prison gates were shut behind him. “I could hardly breathe. In that state, it was not possible to lie to sleep. I sat on a chair by my bed breaking out into a sweat…Only the grace of God kept me through those hours of the night of Saturday, November 15.”
We thank God for the life of Mr. Tsikata. Unfortunately, not many of those brutalised by the junta he lent support to and advised, were given the opportunity Mr. Tsikata was allowed.
The trial judge might not have waited for the lead counsel before ruling on the case. But every Ghanaian knows that Mr. Tsikata was given every opportunity to prove his innocence in a case that dragged on for nearly six years in various courts.
The eight top officials executed in June 1979, when he was a leading adviser to Jerry Rawlings, were never given a day’s notice to argue their cases. When Air Vice-Marshall Joy Amedume was tied to the stakes and executed for borrowing ¢50,000 (GH¢5) nobody gave him the chance to prove that he had collateral to back his demand. He was alleged to have used his influence, and that was it.
On June 30 1982, three judges and an army officer were taken away from their places of abode, with a curfew in force, and executed at the Bundase Military Firing Range. When the disappearances were first discovered, then junta head Jerry John Rawlings, shedding the tears of a crocodile, appeared on national television and announced that the abductions were the work of the enemies of the revolution.
What is interesting is that at the time he made that declaration, Jerry Rawlings knew that three of the four murderers were residing in his own Boys Quarters at Ridge, a suburb of Accra. As the leader of the group, Sgt. Samuel Amedeka, was to state later, at the time they went round picking their victims, the murder squad knew that they were carrying out the orders of the Provisional National Defence Council, chaired by Jerry Rawlings.
Sad to state, but many Ghanaians believe that the abductions and murders were sanctioned by the leadership of the military junta. Incidentally, Mr. Tsikata was known in the Ghanaian society as the Chief Adviser to Jerry Rawlings at the time.
Jerry Rawlings and his aides could declare their innocence to the high heavens, but most Ghanaians know that the whole abduction was instigated by the leadership of the PNDC to put fear into the citizenry, at a time the very existence of the military junta was being questioned.
All the three murdered judges – Poku Sarkodie, Kwadwo Adjei Agyepong and Cecelia Koranteng Addow, were sitting on review cases brought by aggrieved persons, in respect of the Armed Forces Revolutionary Council, the previous military junta headed by Mr. Rawlings. For the attention of Mr. Tsikata, an adviser to the PNDC Chairman at the time, none of these victims was given a minute to plead his/her case.
I do not know who advises Mr. Tsatsu Tsikata. If I were him, I would lie low after all the atrocities he aided the PNDC to perpetrate against fellow human beings in the name of a revolution that has only replaced the rich and famous of society.
At the time he was in prison in 2008, Mr. Tsikata was supposed to have carried out a consultancy job that landed him a cool $5 million on his release, with the National Democratic Congress back in power. I am not in a position to argue about what kind of consultancy he undertook. I have a worry though. I do not believe there is any Ghanaian alive who could vouch on the number of Ghanaians sent to the so-called People’s Court, established on the advice of legal brains behind the military oligarchy, and allowed to argue their cases, as Tsikata did.
Mr. Tsikata cannot claim that he was not one of the legal brains that aided the establishment of the People’s Court. Neither is he unaware of long custodian sentences passed on people on the flimsiest of charges. Victims of the People’s Court, I dare state, never had the comfort of six years to plead their cases.
There was no proper legal defence, as Mr. Tsikata had the luxury of experiencing. In many of such cases, the victims were never given the opportunity to clear their names.
Lest I forget, even when President John Agyekum Kufuor granted a pardon to the convicted criminal, Mr. Tsikata swore to clear his name in court. Five years on, we are still waiting.
What is interesting is that the administration of John Evans Atta Mills handed over $5 million of public money to Mr. Tsatsu Tsikata on the pretext that a firm he owns -Strategic Oil and Gas Resources Company, had provided consultancy services to Mitsui Ocean Development Company Limited, the organization that won the bid for the construction of the Floating, Production Storage and Offloading (FPSO) Kwame Nkrumah, for the exploration of oil in the Western Region.
Critics say Mr. Tsikata might have been in prison at the time the consultancy was said to have been provided. In Parliament, Deputy Minister of Energy in the Kufuor administration, Mr. Kobina Tahir Hammond, engaged former Minister of Energy Dr. Oteng Adjei, to tell Ghanaians whether Tsatsu’s company had truly been paid that whooping amount of $5 million.
Mr. Hammond also wanted to know what kind of services Strategic and Oil Resources provided to warrant such a quantum payment from the public purse. The Minister’s response was that a private company had the right to be sub-contracted by MODEC. “The award of the contract was not illegal; payment of money would also not be illegal,” Dr. Oteng stated.
The Member of Parliament for Adansi Asokwa insisted on a definite answer, but the Minister remained evasive, forcing a confrontation that lasted one hour, until the Speaker intervened on the basis that the time allotted for the purpose had elapsed.
Obviously displeased by Mr. Hammond’s request, Mr. Tsatsu Tsikata issued a press release the next day. “It would have been hard to fathom why a Parliamentary question would be put about legitimate contractual relations between two companies, but for the obsessive determination of people like Hon. Hammond to get Tsatsu Tsikata by hook or crook,” Mr. Tsikata stated in his release.
“Unfortunately for such people, however, the activities of Strategic Oil and Gas Resources (Stats Oil), a company of which I am a share-holder, as well as Chief Executive, will stand up to every scrutiny,” he stated.
The jury is still out on whether the $5 million payment is justified, especially, when the deal was said to have been hatched at a time the Chief Executive, and the man said to have presented the so-called consultancy, was in prison.
In a moment like this, my heart goes out to Mr. Baah Boakye, one-time official of the Foreign Service of Ghana who was transferred under a certificate of emergency to West Germany. The message out there is that his wife failed to join him. I am told that the woman involved is the same person cited in Mr. Tsikata’s testimony, as providing solace to the then prisoner in hospital.
This is a cruel world. Many had no opportunity to clear their names when they were dispatched to the next world on flimsy charges. On the other hand, those who helped to perpetuate those heinous crimes against their fellow beings, are paid huge sums for providing consultancies from locked prison cells. It all adds up to the murky world, where hard work is rather punished.
Tsikata’s five year jail anniversary message should galvanised Ghanaians to ask more questions about a revolution that rewarded rhetoric against hard work. I shall return!
