Every year the Ghana Cocoa Board goes aborrowing for millions of dollars to use the loans to purchase cocoa from our cocoa farmers for onward export.+
If Tsatsu Tsikata was wiser than an 'ant', you would have used the extra funds of the GNPC to borrow Ghana Cocoa Board to revamp the cocoa industry to bring in better returns, instead of giving the monies to that ghost company called valley farms to chop our monies 'by heart'.
And this ant-size brained Tsatsu Tsikata has forgotten that some innocent voters had their votes annulled by the EC through no fault of theirs.

From day one I have been saying that the legal team of Akufo Addo are incompetent, hack lawyers who are just pettifogging as against the well informed and eminent lawyer like Tsatsu Tsikata.
Tsatsu Tsikata has again displayed and proven that he an astute lawyer who understands legal terms than Supreme court internship of Akufo Addo's inept amatuer legal team who were all basically Tsatsu Tsikata’s students at Legon. Tsatsu Tsikata has stunned the overwhelmed legal teamof NPP by pulling a legal term from his old sleeves leaving them dumbfounded. You cannot buy experience.
Wantonly, Gloria Addo approached the press without double checking the legal term "retroactive penalty" and then claiming it is alien to her. Clearly, this betrays her legal ability and capacity to stand against such an experienced lawyer like Tsatsu Tsikata. This is an indication that NPP have lost the battle (foolish case) before the oncoming SC verdict. In fact this whole circus at the SC was a waste and face saving deception maneuver by the sore loser Akufo Addo and the NPP.
"retroactive penalty" is legal term which is a commonplace in the commonwealth of nations e.g. it is a common practice in New Zealand since 1990. Underneath is a 101 law for internship Gloria Akufo.

Knowing very well that they cannot possibly win this case as all evidence is going against them, Tsikata has resorted to the last desperate option of employing eccentric behaviour to hopefully dazzle and impress the judges with non-existent legal principles so as to subjugate them into a submissive condition of sympathy.
If he does not know, the voodoo myth as a legal luminary surrounding him has been broken for good by his justifiable incarceration for committing crimes against the state. In addition, his poor and abysmal performance during this trial has confirmed without any doubt that the man is only a Team C lawyer. Even some of the lesser known lawyers in their team were more impressive than Tsikata.

I'm not a lawyer, but when I heard Tsatsu make that argument, I thought it was logically bizarre, because every judgment against any party can be described as "retroactive penalty". This is because judgement is a judicial ruling on an action that's already happened. What Gloria has done here is to point to the confusion in Tsatsu's mind because the law only recognises "retroactive legislation", which is a matter of fairness and justice, because an action cannot be punished by a piece of legislation that's enacted after the fact. Now, were the laws under which the Petitioners are seeking reliefs enacted before the 2012 elections? Yes. Some of them are even entrenched clauses in the 1992 Constitution. But I'd even further to suggest that what Tsatsu was doing his characteristic sleight of hand: to use sophistry to dazzle and confuse judges. This usually happens when a lawyer knows he doesn't have a good case. Many of the things Tsatsu said in his address were not factual.

Yes there may be something like Retroactive law but the woman was first of all expressing her doubts about the existence Retroactive PENALTY. These are two different things.
Secondly, the general sentiment is that this Retroactive Law or Penalty, even if they exist, they are alien to the laws of Ghana.
Thirdly, my main concern is that whether Retroactive Law or Retroactive Penalty exists or not, I really dont give a toss. What matters is, was or is there enough practical evidence to prove that Mahama did win the elections or not?
All this nonsense just to complicate the issue and confuse the public is just a ploy by a desperate drowning man to clutch at straws with the hope that he might survive.
The world has evolved past the old feudalistic and elitist law that took decisions based on mere mind-boggling legal technicalities. As our judges and lawyers have happily discarded the vulgarity of blonde wigs, I hope that they will employ reason and good old common-sense to come to a sensible judgment that should be understood and appreciated by all. And if that should be the case, then we all should know which way the judgment should go, dont we?

The dispute, if we can call it that, is between the petitioners and the respondents. The voters are not party to this dispute and any sanctions imposed on the innocent voter will be a punishment of a kind.
Furthermore at the time that they voted, there was no law which said that duplicated serial numbers on a record sheet (not the ballot paper) would invalidate their votes. There was no law at the time they voted which said if only 1 person voted with some other means of verification other than biometric, then all the valid votes would be deemed as contaminated and rendered invalid.
Any such ruling which would amount to legislating from the bench would be retrospective to the elections and the "annulled voters" would be punished retroactively or retrospectively. GLORIA PLEASE!

Whether the serial numbers are for security purposes or not is immaterial. The EC is not responsible for generating the serial numbers on the pink sheets.
If these valid votes are annulled, it means the Supreme Court will be legislating after the fact.

Pink sheets are for record purposes. Ballot papers are for casting votes. The serial numbers on them are generated by the EC.

After some research I see what the professor was telling the Justices with the RETROACTIVE PENALTY. He says there is no law that says if the official fails to sign then the voter should be penalized. He is saying there is no law that says if someone over voted then the other voter should be penalized and so on.
Retroactive penalty exists in the books and the Professor is not the first to use the terminology, Gloria should have done a little reseacrh before jumping into battle with the Master.
I have seen some Chinese movies where the student thought he has learnt enough to go after the Master only to find out that there were some tricks the Master never taught the student!

Retroactive punishment is a means to change the law today for something you did in the past to punish you now. Any good lawyer knows Tsatsu's submission was excellent, no wonder the grade 3 legal team didn't understand his import. Experience is the best teacher and Tsatsu continues to demonstrate that. The Jounalist who reported on this subject is very lazy and unprofessional. He could have independently researched on this phase, then inquire from Tsatsu for his version and then compare with the findings then draw valid conclusions in order to educate readers. If this had been ignorant comments could have been avoided.

Nothing retroactive(no new enactment is taking shape in the court) is taking place in the Supreme Court, and that is what you and that ex-convict should learn to know.

I have heard people advocate that the sins of returning offices should not be visited on the electorate. Are those arguing this way including Tsatu saying that indeed statutory and constitutional violations occurred during the 2012 election but for the fact that these violations cannot be traced to one single voter the decision of the EC should stand? How about the reversed logic for the voters who have been denied the genuine verdict because of the sins of returning officers. I call on the Justices to stand strong and pronounce that verdict that will resonate around the whole of Africa and the world at large.

When there were problems with the biometric verification, he merely requested for people to be allowed to vote with other forms of verification.
Was he not entitled to express a view?
The EC did not tale a cue from the President. EC decided to extend the voting by a day to enable all voters to be verified before voting. This was within its powers.
As regards retroactive penalty, common sense should tell Gloria Akuffo that if you punish voters by annulling their votes long after the results of elections have been declared, you are punishing them retroactively.

The problem that some of these lawyers are having is that, they are trying to equate any penalty suffered as a result of of a "Retroactive Law" to penalty suffered as a result of "Retroactive Penalty".
A typical example of a "Retroactive Penalty" is what one sees during a lawn tennis match. The umpire may make a judgement in favour of one player. The other player may protest that the call was a wrong call. What they do next is to review the video recording of the play in contention to determine what actually happened. When this video review is done, the umpire may either reverse his/her earlier decision or uphold it. "Retroactive penalty" is also used in Basketball games.
FIFA is introducing the concept of "Reactive Penalty" (Goal Line Technology) during next year's World Cup in Brazil.
With Goal Line Technology, a controversial decision made by the referee of a game (as to whether a goal was a genuine one or not) would be reviewed and if the evidence shows that the earlier decision was a wrong one, the referee will change his decision immediately. As at now the rules of football don't allow such a thing. A controversial goal, once accepted by a referee, is a done deal (no going back on the earlier wrong decision).
So Tsikata's use of the term "retroactive penalty", may not necessarily be a term or lingo known to lawyers, but the idea he was conveying is already in existence. The EC has already declared that Mahama was the winner. A review by the Supreme Court that changes the earlier decision made by the EC could be a penalty to the beneficiary of the earlier decition made by the EC.
So to the court there may not be retro-activity, but taken as a whole, this petition to the SC by petitioners and the earlier decision taken by the EC qualifies perfectly as a "Retroactive Penalty", if the SC should annul the almost 5 million votes that the petitioners are asking the court to do which will be impossible to do by the SC.
