Prior to Atu-bugabuga's buffoonery of sentencing Ken Kuranchie, Ghanaians heard it loud and clear from one of the justices that the Attorney-General's office could be 'activated' to prosecute charges of contempt against Ken, if he refuses to show a sense of remorse to the Kangaroo court.
So it was a surprise that after Atu-bugabuga rose and went for a calabash of 'burukutu', he came back in a rage and started implementing his sharia laws forgetting everything about the constitution which he was mandated to interprete.
The day of reckoning will surely catch up with Atu-bugabuga !

It now seems from your postings that anybody who thinks The SC acted wrongly and unconstitionally is unpatriotic and preparing to flee Ghana.

The provision under which contempt of court flows is one of the exceptional provisions under all civilized nation to protect the court and ensure that it is not undermined.
Hence the provisions under natural justice is subsumed by statutory and common law procedures under which due process flows, is suspended under the strict liability rules.
Contempt of court act 1981 especially on publications and crimes under health and safety crimes are strict liability crimes and do not follow due process under natural justice as we understand them.
This is what the 1981 contempt act say under English law:
The Contempt of Court Act 1981 (CCA) was enacted following a decision of ECHR that English contempt law contravened Article 10 of the Convention. It was intended to give greater protection to freedom of speech. The CCA introduces a strict liability rule. The strict liability rule indicates that conduct tending to interfere with the course of justice - particularly legal proceedings - may be treated as a contempt of court regardless of whether there was any intent to so interfere.
The strict liability rule applies only to publications. These are defined so as to include any speech, writing, broadcast or other communication in whatever form which is addressed to the public at large or any section of the public.
Two important limitations on the impact of the strict liability rule are:
It applies only to a publication which creates a substantial risk that the course of justice in the proceedings will be seriously impeded or prejudiced.
It applies to a publication only if the proceedings are active.
So from the above quote you can see that even the English law when it comes to strict liability rules as properly defined above, are exempt from due process rules of the natural justice and rights under freedom of speech.This rights have their limitations and we must respect that.

Most Ghanaian journalists are "obroni-wannabe-journalists" who, with their literal interpretation of "free speech" think they can be disrespecful with impunity.
The quality of journalism, and all other disciplines, for that matter, must reflect the cultural values of the people they are meant to serve. In other words, the tone, diction, etc, of Ghanaian journalists must reflect Ghana's core value of "respectful communication".
Abrasive and combative journalism belongs to Western journalists because, culturally, Westerners are "abrasive and combative". Culturally, Ghanaians, on the other hand, are tolerant, mild and respectful in their attitudes and behaviours. This must come through in all our communications even when we are angry. Ghanaians are ingenious and can come up with a "different way".

Ghanaians,by nature,are more tolerant mild tempted and respectful.These tendencies are reflective in our communicative roles.That's well taken.But this should also apply to those who sit in judgement of us i.e. Justices.
I believe,the apparent "disrespectful" behavior of the convicted journalists could be ignored by Justice Atuguba,if he didn't resort to the attitude of those in power in our country who always want to show those of us under them "where power lies".
There's always a fine line to be considered and if everyone of us would temper our undertakings professionally and with humility,such extreme outcomes could easily be avoided for the good of our country.

It is therefore not an issue for anyone to go and debate them on wether they are right or wrong. The Prof has missed the point; if he feels the Judges have too much power, he should rather advocate for a clearer definition of what constitutes contempt. That is the only basis upon which a person can go to court to defend a contempt charge.

Second, the title suggests that Justice Atuguba has some sorts of influence on the other justices. This reasoning is not only faulty, it is also a bad. Third, the title is filled with an intent filled with arrogance high proportion that he Professor Prempeh is an academic and therefore he knowns better than the Justices. This is faulty because 'teaching' and 'research' in some instance are different from 'practice' and what he proceeded to do in the article is his interpretation of the the Constitution. In deed, it is purely an exercise. Professor Prempeh and his ' Baylor' school mate Professor Kwaku Asare have never practiced as judges in their life hence, practical interpretation of the law seems not to be their concern. In spite of the intellectual wit which the article demonstrates, common sense still prevails. These are my arguments. 1. Ignoring Supreme Court's warning is disrespectful and arrogance and constitute 'contempt' no matter how one looks at it. 2. Society cannot be experimented for the sake of academic exercise. 3. The justices by all intent could not be criticized not even by Asare and Prempeh that they are in court to show the world their power on the people. The intent of all these content issue is very apparent with the exception of those who refuse not to see the obvious for their own peculiar reasons. I will therefore conclude that what Prempeh and Asare are doing constitutes interference. They should desist from it, wait till the end and they can subject the whole process into academic exercise which their terrain.
