Since before independence we have been plagued by all sorts of ruthless , vicious and willfully authoritative govts that all have one thing in common , denying the right of free speech and proper analysis of the motives and agendas they seek to keep hidden . Most of these govts were led by people who didnt belong to the majority but rather minority tribes and very marginal political clans . starting with nkrumah who is praised to high heaven but this same oligarchy , he st in motion a climate of fierce political antagonism whereby moderate minds of a liberal persuasion had no business in participating as only the radicals could stand the heat .The MOTIVE , be able to spend without consensus or agreement the wealth of the nation ie in today's jargon chop Ghana money some . The nice Judges didnt get good advice before call the to the courts. Supreme Court Judges when dealing with cases dont listen to what anybody says outside the courtroom that is why we call the Judges. How can you Judge listening to what people are saying outside the court.
Something is not right at our Supreme Court. All these Judges/Poilce we pay, not one of them did see it as a crime except the nine Judges sitting on the Petitions case.
Our legal serve is on a downfall unless we all speak out.

If you are in contempt of Atuguba's court, he and only he determines whether you have violated his directves, and he can only do that by inviting you to show cause why he should not hold you in contempt of his court and punish you for breaching the orders of his court. Noone else can do so on his behalf. Abide by instructions from the courts and be free.

It is well known that the burden of knowing what the law says on any given topic rests with the individual not with the courts or its judges and magistrates. Contempt of court is enshrined in legal procedure and practice. If one is not sure that his or her comments about an on-going case will be contemptuous, he or she seeks legal opinion before making them. Judges and magistrates do not announce the law or give any directives. Their job is to interpret and apply it. In the matter of the on-going case brought by the Petitioners, any comment designed to bring the court's work into disrepute or denigrate its Judges may be subject to a contempt charge. The SC does not have to announce this anywhere. That is why they say ignorance of the law is not an excuse. If you slap you neighbour and argue that it was not announced any where that slapping is an offence, you will still be charged with assault, and if found guilty pay the penalty. Likewise, insulting judges doing their duties is like slapping them and claiming they did not tell you that insulting, denigrating and disparaging a judge in the course of performing his or her duties is an offence that is punishable. If you cannot abide by the laws of a land, find anothe country that will tolerate judge-bashing and emigrate. In country subject to the rule of law, like Ghana, ignorance of the law is not an excuse.

There is a crime of contempt of court in all courts in all countries. Judges try not to invoke their powers and before they invoke them the situation warrants it. First,they issue a notice or warning to all in court and, if necessary, out of court. If you speak in abedroom, and no one hears and reports you, no one will know you committed contempt and no court will summon you for trial. If you go public (for example if you write contemptuous things here) and you are held in contempt, you have yourself to blame. Is such a simple thing difficult for you to understand? Poor Ghanaman.

Talk about variance of justice.Our Justices should tamper their use of judicial fiat with some humility since power resides with the governed.If things were in their appropriate sequence,we the people,should be feared not thrown into jail for expressing our opinions no matter how outrageous it might sound.The idea of protecting free speech is to allow even the most contemptuous as long as no other violations of law occurs.Manufacturing obtuse interpretations simply to "show we the people where power lies" is not the way to strengthen our tolerance and foster our democracy.The Justices are civil servants and they need to acknowledge that fact and spice their judicial temperament with humility and respect for the consent of the governed.

Can’t believe sending these recalcitrant politicians to prison for contempt is fuelling the partisan debate to the detriment of truth, accountability and common sense. What befuddles me most is the way supposed intellectuals are behaving as if freedom of speech has no limits. These attention seeking political philanderers are all over the place, lecturing us as to the encroachment of peoples’ liberties by the Supreme Court. The jail birds ignored all warnings by the Supreme Court to desist from their lies and incendiary reports in the media. Laws are made to be obeyed and sending those pyromaniacs to jail for refusing to heed the warnings was a great decision. Our intellectuals have always been good at one thing; POST MOTERM commentaries, and they are not disappointing in this matter. We never heard of all these professors when the court started complaining about the manner in which pundits were misrepresenting occurrences at the court. The so-called intellectuals were mute. None of them came up with solutions that would preempt this situation. The Supreme Court is duty bound to render unadulterated justice in the serious matter before it. It needs peace to do that.
