The CJ is not above the Supreme Court. The chief justice is under the supreme court authority so petitioning her is an ill-advised move. Besides, she is also not exempted from the contempt warning

I have been listening to your comments and it seems to me that you always favour selective punishment. I won't be surprised to find out that you an indeed an Ewe. They are the only people in Ghana who always support and defend these kind of practices. Forcing people to comply with orders are only temporary solutions, as we have witnessed already with Ashawo-ba JJ's revolution. Pretty soon, Atuguba or whatever he calls himself will have to create another court and build a new prison for the number of people criticizing the Supreme Court and their incompetent actions.

We cannot sit back and watch the return to the ominous era of Culture of Silence, whereby tin-gods like Rawlings held themselves as above reproach or criticism.
Atuguba has proven himself to be a product of Rawlings monstrous reign when people could be called over radio stations to report themselves on trump up charges and will disappear thereafter without trace. Atuguba must get it through his cone head that he is neither “Lord” nor "God". If he does not get it, he is also on trial on how he conducts himself. We cannot accept the fact that he only sees jokes out of the misdeeds of NDC operatives but hastens not to strike NPP operatives with sledge hammer and threats. Who the fuck does he think he is, our creator or God who must be feared?
For somebody who holds himself to be a superior judge, what is he doing listening to radio stations and newspapers when he should be concentrating on what is in front of him, and blocking all outside influences. Is he saying he is influenced and clouded by what he hears on radio and TV or reads in the print media in rendering justice?
NPP made serious tactical error in allowing this Atuguba to sit on the case inspite of his very strong links to the NDC. If the country goes up in flames because of his biases he will have himself to blame. Some judge. Tweaaa! How can you just issue wanted statements to citizens on air without specifying what their charge sheet is and haul them before you without the benefit of legal representation. Are you nuts?

The founding fathers of the land of America distanced themselves from Thomas Paine after independence because he was not a believer. Now as much as it hurt them, common sense dictated that for the sanity and unity of America they must do so. The people of Rwanda waited for their rulers, who waited for United Nations who waited for their pay masters. The end result of waiting for the proper thing to be done was the demise of a million people.
I site these two examples above to demonstrate the significance of common sense. Those of us with our all and family in Ghana held our breath when we heard some comments on the radio. Fuel was being poured all over Ghana and luckily the match was wet. Mr Asare, do not underestimate the ability of an African to descend to violence of such horror that when sanity prevails s/he will refuse to admit that capability. I believe that time spent outside of Ghana is giving this dilution of civility and hence your inability comprehend the dilemma of our Judiciary.
At a trying time like this, what they need is help to hold the country together and not someone outside the country throwing fine words around without understanding the impact of what the judges are trying to achieve.
The next time you wish to show your calibre, perhaps a book might be in order for us to judge its worth by the number of sales.

It is clear the court prejudged and administered punishment without stipulating what crime was committed or what rules were violated. A clear procedural lapse on the part of the Judges.
However, one must also not lose sight of the disturbing nature of the comments, especially, by Atubiga and Boahen which threatens and has the potential to disrupt the peace and administration justice in the country. This, no one will disagree but as said the manner the whole thing has been handled by the eminent Justices needs to be looked at.
Undeniably, the article is very interesting, well written by some who knows law. In my opinion, this will keep the discussion going for days to come.

They are rather focusing on irrelevant issues.
One of your recommendations included "The Court must state in very specific terms how Mr. Awuku’s remarks are contemptuous, including at a minimum, setting boundaries for acceptable remarks, in light of the constitutional value of free speech"
Also there are a lot of administrative controls and flaws that the Supreme court judges are overlooking which is negatively impacting the whole proceedings. They seem to be operating according to any administrative guidelines and standards rather assuming that everyone follows a code of conduct which is subjective.
Many thanks, Ghana needs people with a lot of exposure to manage the country. You sound very knowledge with the law profession than those dealing with the Election case at the moment.

Atuguba warned all journalists to report what actually happened and not to spin what was said and incite scrupulous people into unnecessary action but Sam Awuku did not listen to the court and was ban from the court, not thrown in jail as you are trying to misinform readers. The other three banned should have learned from Awuku that if they didn't report what happened, they run the risk of being thrown out.
Is this guy, Asare, actually a professor? God help our souls. When has a lawyer in the US ever wrote to the Chief Justice to interfere in the supreme court? Even Law Professors at Yale and Harvard can't tell the supreme court what they think they are doing wrong, and they are among the best, if not the best in the world. The Supreme Court is the ultimate law of the land and its decision can only be overturn by 2/3 majority of congress
There seems to be a trend developing amongst Ghanaian educated professors who earn their Ph.D in the USA. They all think because they are lecturers in the US, they know better than their Ghanaian counterparts, a pure fallacy. The resources available to students in the USA are about 80% more than in Ghana, where one has to actually learn everything to earn their degree, so stop bullshitting because you are not as learned as you think. The GOP, for example, hate the fact that DOMA was repealed but there is nothing they can do about it because the supreme court decided it, just as they did with ObamaCare. Let Ghanaians judge their own case because they live there, we don't and we should stop trying to tell them how to do things there, corruption aside. And it looks like some of you can read pass the second line. This petition is just about how Atuguba and his bench have abrogated themselves to abuse the constitution of Ghana by parading people they perceive as guilty in front of them as GOATS.
In civilized Nation, if the SC deems it fit to charge you with "contempt of the law" it will write you and tell you about why they deem it so and ask you come to defend yourself but not to sit on TV and invite you without any letter or formal invitation to tell you about the charge.

Besides, the CJ is not a respondent and what's more who constituted the Panel? Was it not the Chief Justice?
At any rate, even if the appeal never came from the law professor, Prof Asare, any objective person, not swayed by partisan aspiration would partly agree with the intent of the SC in regulating pronouncements that potentially could bring their work into disrepute and inflame the already tensed political atmosphere in the country. Again they deserve our utmost respect! But in attempt to do so, it's important they are not seen to be pulling down a new cloud of abject intimidation on the citizenry reminiscent of the dark days of the AFRC-PNDC. That must be of concern to all of us. Power in the hands of the wielder can build but can also destroy!

The common law is often the starting point for determining what constitutes a contempt, and case law has established the powers of courts to deal with contempt.Contempt is therefore determined by case law as a shield to protect prejudicial court reportage and unguided utterances whilst the proceedings of the court is on.It also to protect the public interest to ensure that the proceeding is not used to cause public dissatisfaction.
It is rightly established at common law to safeguard the court from acts or omission calculated to interfere with the administration of justice from sinister agenda.Its therefore behooves all informed Ghanaians to to be objective when it comes to matters concerning the integrity and dignity of such important arm of state if the rule of law is to be protected.
We all acknowledge that rights have consequences and that they therefore come with responsibilities.Freedom of expression unlike the right for a fair trial is qualified and therefore not absolute.Asasre's attempt to give that impression is disingenuous of him.
The procedural rules of the courts in Ghana determines how contempt of court proceedings are to be addressed.The SC has the right to hear summarily contempt of court cases emanating from its proceedings unless the contemnor wants to be heard by another judge but these rules remain exclusive to the SC.
Asare's petition and the numerous cases he cited are mostly out of jurisdiction. these citations are not binding on our jurisdiction but just persuasive.To cite them as if these are binding authorities is another example of this writers woeful misunderstanding of the issues.
This forum has become a harpy hunting ground for his vexatious articles mostly criticizing Justice Atuguda whom he always posts on the SIL as a bias and incompetent judge and I am afraid he is becoming a meddlesome busy body and crank on this forum.Kwaku Asare is intellectually dishonest and dangerous

Judges are supposed to judge cases based on the facts established before them, but not on some expression of opinion that do not form part of the proceedings. what Atuguba is doing shows that they are monitoring discussions on the case, and this is dangerous. I expected that he is experience to know that coming out to punish or warn people about their comments which do not portend any influence on the decision of the court, exposes him of fearing his shadows. Why concern yourself with political comments outside the court. It is a shame!

Where does Asare get the idea that freedom of speech gives license to political hacks to disregard the warnings of the supreme court, and prejudice a sensitive case before the court?

If we have a situation where a person can be accused and pronounced guilty by accusers presumed to be infallible without a trial, then we are getting far away from democracy.
Supreme Court dictatorship is equally bad as military dictatorship.
The Supreme should rather hasten and finish the case quickly rather than letting the case drag on and looking out for people making contemptuous statements.
It is like asking Hearts and Kotoko supporters to stop making predictions or provocative statements and insinuations during a match between the two teams.
The Supreme Court should rather take a cue from Kenya and bring this winding case to an end. The threat to Ghana's stability worsens as long as the case drags on. It will be surprising if they claim they do not have enough evidence to give a ruling.

I am amused about how some of the Justices at the Supreme Court especially Justice Atugba are so hypersensitive to comments regarding their decisions of the ongoing petition. What are they afraid of? If you know in your conscience that whatever decision you have taken is based on fairness and objectivity before your God, what do you care about criticism which is someone's opinion by the way? According to God's law, human beings become frightened when they know that what they are doing is wrong and unfair and that unfairness in being pointed out by other human beings. In otherwords, anxiety, fear, restless mind,aggressiveness etc. in most cases spring out of a guilty conscience. The Supreme Court Justices should therefore concentrate on delivering justice without FEAR or FAVOUR and they will be at peace with themselves, with others and with their God. The justice of God grinds slowly but it grinds exceedingly fine!

Besides, the CJ is not a respondent and what's more who constituted the Panel? Was it not the Chief Justice?
At any rate, even if the appeal never came from the law professor, Prof Asare, any objective person, not swayed by partisan aspiration would partly agree with the intent of the SC in regulating pronouncements that potentially could bring their work into disrepute and inflame the already tensed political atmosphere in the country. Again they deserve our utmost respect! But in attempt to do so, it's important they are not seen to be pulling down a new cloud of abject intimidation on the citizenry reminiscent of the dark days of the AFRC-PNDC era. That must be of concern to all of us. Power in the hands of the wielder can build but can also destroy!

He was the one who fought for the Supreme Court to declare the need for dual citizens to pay money to register as discriminatory. As a result of this action, you do not have to register anymore before you are recognised as a Ghanaian with a second nationality. To impugn his credentials is to close your mind to research.
Research into him rather asking someone to do that. He has argued on our behalf in Ghanaian courts in recent years and quoted in a number of cases!

What has Prof. Asare said to warrant the abuses being hurled at him? He is defending free speech which all of you are exercising and you are insulting him? Don't you think he is right that when contempt of court comes up against freedom of speech, it must be circumscribed? We cannot use contempt of court to stifle genuine public interest in this case. As such, there is some guidance required from the court specifying the instances of contempt in clear terms?
At the moment, no one really know why Sammy Awuku was hauled before the SC? Don't you think that it would have been appropriate that this was pointed out to him so that we all will know the line we do not have to cross?
At the moment, it is only the Judges who know what constitutes and does not constitute contempt? If this is obtained in a democratic society, then soemthing is not hanging right.
So it is high time the SC specifies what comments they will deem to be contemptious. There also must be a demonstration of intent before someone is held liable to contempt.
The very people hurling abuses are the very people who are likely to be caught in this wide and unlimited net of contempt.

Prof ASARE is a very good theoretician. But I have the impression that he has lost the sensation of our realities. The freedom of speech and media is not the freedom of saying or writing or doing whatever we want.
How many Ghanaians are really well educated and find themselves in position to differentiate the authorized and the forbidden? The petition case is the first in the Ghana history and it appears to be very sensitive. Therefore, as the case in before the Court we shall refrain from inflammable, violent and odious talks and writings. The unity of Ghana is not yet as strong as we believe and anytime anything can happen.
Do we need that in Ghana, of course no. Even in USA there restrictions on freedom of speech, writing and so on but one needs to be working within CIA, FBI, and other security agances before he knows it. Capitalists pretend just. The reality is totally different.
In conclusion, I like to say that the CJ does not have anything to learn from this theoretician who is no more connected to our reality. The Ghana SC should not give this man any tribute. They shall leave him with his subjective and surrealistic theory. We nevertheless thank him for his contribution to the case but we like to remind him that in this life there aren't 3 ways but just 2. Either you are at the right or the left side.In which side Prof ASARE finds himself? NPP or NDC?

This writer is commenting on wrong behavior of the Justices that, they don't have any absolute power to criminalize anybody for positively or negatively commenting on their rulings provided that criticism is of no imminent threat to any of the Judges period.
I will advise you to make a hard copy of this article and read it over and over and I bet you will come to the conclusion that this is a classic article worth reading. If Ghana have about 5 to 10 of the sort of Prof. Asare in our Law School, we would be very fortunate to produce high quality lawyers in successive years. We are grateful to have such quality learned people somewhere and not some quack PhD holders who cannot discern right from wrong. E&OE.

So in my opinion at the time of passing the Freedom of Speech Bill,the Libel law should have been used as a Clause in the bill to take care of what Justice Atubuga is trying to do until we learn not to politicize and twist stories in favour of the party we support.
Therefore considering the way we "yab" I think Justice Atubuga should summon people before him to answer questions to bring sanity in the Country.But victims should receive a letter and must be represented at the Cost of the State.

There is such a thing as fair comment in the public interest and surely the Justices of the supreme court should not be affected by statements in the court of public opinion - if they are, then they should rightly recuse themselves because they cannot be fair in their judgement! Well said Prof, you've done the legal fraternity a great service! Lawyers should speak up when they see such injustices being dished out by Judges who should know better than to sanction people without due process!

I also live in the US. Even here there are limits to Freedom of Speech when the government determines that the security of the nation is at risk. Don't forget security includes peace. And when people have disagreed with courts' decisions, they have done so in a respectful manner--not in the way being done certain elements from the NDC and the NPP.
As regards Law, one size doesn't fit all. That's why even here in the US, States are allowed to enact their own laws in certain areas. So you're being disingenuous in your argument.
The ongoing presidential election case has the potential of sending the country into a tailspin if not handled properly. That's why it's necessary to crack down hard on those bent on causing mischief.
Finally, no one can tell any Supreme Court how it should operate. The ground rules are always set by the Justices themselves.

The Supreme Court Justices have a herculean task to accomplish; it's not easy, esp. with all the threats from supporters of the ruling govt. But Ghanaians are vigilant this time around. We won't allow any groups of people to murder our judges and justices because certain decisions or rulings didn't favour them.
Election fraud is a serious matter and nobody should expect the Supreme Court to come out with any biased ruling or verdict. We should also know that the whole world is watching; there must be true justice. Nothing but the truth must stand.

Truly, the actions of the courts contrary to Professor Asare's observation prove the court to be indeed a serious Supreme Court. The actions of the court from a sober reflection shows that the courts do not wish to compromise in a minute seconds anything that will jeopardize the security of this country.
One thing should be made clear; Professor Kwaku Asare should not sit in America and think that for that reason he knows better than the legal experts nor the judges and the lawyers in Ghana. Such comments (whether one thinks is a freedom of expression or irresponsible) in the media created genocide of unwarranted proportions in Rwanda. Therefore if the judges in their wisdom feel such comments should be stamped out, it is in the right direction.
For his information the courts did not sentence Mr. Sammy Awuku. They only banned him from courts for the comments the courts deemed unwarranted. And it was within the purview of the court to exercise such power. We also don't know the actions that will be sanctioned against the new list of persons to be appeared before the court; hence it's a prejudicial to speculate what will happen to these persons.
In addition, the appeal to the chief Justice is misplaced. The chief Justice is not above the Supreme Court but rather below it and there she/ he cannot impose his/he will on the Court. The warnings of contempt apply to everyone including the Chief Justice. Finally, the Chief Justice is not superior to judges of the Supreme Courts. They are her/his colleagues. He/she is only "primus inter Paris"
Finally, Freedom of speech does not mean insults or irresponsible comments. Freedom without protection is anarchy.

This is a good one, there are lawyers and law in Ghana but there is no law abiding persons in the country. Anyone can say or do whatever they want but nothing happens, and due to poverty the poor are always misjudged.
