They set the precedent by refusing to allow the use of a single polling station biometric machine data to match electoral register data during the examination of Dr Afari ?gyan, to try and illustrate his point about the facts of how the election results were properly matched and collated.

The fact is, I am not a lawyer but a scientist. One thing I do know is that there is a universal law that when you attempt to block something or set a precedent that goes in your favour, always remember that others can use it. Just look around globally and examine even geopolitical actions and happenings that are the result of others seting either a good or bad precedent.

I would have been most surprised if they had been allowed their request. If you want to win a case at all costs, you must also be smart and wise in your dealings with the court. In my view counsel for the petitioners (and Philip Addison in particular) have failed to show wisdom in too many instances.

What were Addison and co. thinking when they vehemently protested the tendering of a BVD printout? Citing the technicality of non-pleading by the respondents in that respect, they blocked a very simple way of settling some doubts about verification during the voting exercise. Now, how were they expecting the other side to allow a similar act from them?

In fact, if the petitioners were questioning the elections as a whole and even demanding a relief of election re-run, their case would be more plausible.
However, what are they seeking? They want the court to:
i. consider "irregularities" ONLY in SELECTED areas;
ii. equate those "irregularities" to rigging;
iii. annul votes ONLY in those SELECTED areas;
iv. consider the remaining votes and on that basis declare Nana Addo winner.
How ridiculous and ludicrous!!

Asking for Collation sheets of 13 constituencies because you are missing 2000 plus pink sheets???????????? you had 24000 odd pink sheets and even claimed you supplied 11900+ to the court so how do 2000 pink sheets you don't have become an issue?? Lithur was right, are they asking for the EC to give them evidence to prosecute itself???? its clear that after the audit the "watertight" evidence of the nPP is leaking badly.

Atuguba ruled and voted against the respondents as well, when Bawumia was on stand and when the EC wanted to tender in some documents, Atuguba is only 1 vote on the 9 member panel.

Did'nt the NPP say only a few days ago that just 1,500 annulled pink sheets were sufficient for a run off, now they are saying they need an additional 2,000 pinks sheets on top of the 10,000+ found by KPMG. Very messy case.

Now when his pink sheets failed to add up, he now wants more information. This is foot bush litigation. After all their whizz kid task force could not even add up pink sheets. Untruth cannot be made truth no matter how much one tries. When they failed to get the KPMG soft copy they changed to Collation forms.
It is not too late to say we misfired and save Ghana further cost of unnecessary litigation.
