Asiedu Nketia explained that: “My Lord, I’m saying this because we have come to know over-voting to mean an occurrence where the number of votes found in the ballot box exceeds the number of people who are entitled to vote at that polling station; so that clearly is my understanding of over-voting, and I do not have any indication of this happening in any of the 26,002 polling stations which were involved in the 2012 elections”.

I think you should exercise patience. You do not expect the supreme court justices to do the job of the petitioners' counsels do you? Asiedu Nketiah is a witness for the respondents and so he will be given questions and directed in the way they wish to argue their case. It is up to the petitioners' counsels (when it is their turn to cross-examine) to probe into his assertions and try to punch holes into his witness testimony.

That is how it works. There is certainly no bias on the part of the judges, and if counsel for the petitioners have any objections during the process, they can raise them and I believe they have already succeeded in having some of their objections sustained by the judges in today's hearings. Why have you not commented on that? and why did you not accuse the judges of bias in sustaining counsel for petitioners' objections?

Stop being partisan and one sided in your own assessment of what is going on. Let's be fair and balanced, even if we feel things are not going our way. That is simply a fact of life and you don't always have to win an argument.

Don't the Petitioners and Respondents pay the same taxes for the Judges salaries?

I have not had a chance to watch the life telecast but based on what you are saying, it sweems ASIEDU NKETIAH has been allowed to make statements and as you rightly said, it is the Petitioners job to if any to cut him off but Tsatsu whether intentionally or what we saw him do during Dr Bawumiah's cross examination has a penchant of asking witnesses open ended questions.

Here, I will not accuse him of being a bad lawyer but rather doing a good lawyering since ASIEDU nKETIAH is hiw witness and therefore a good strategy to ask him questions that gives him a chance to explain himself.

That was the trouble the justices (not just Atuguba) had with him. They were simply exasperated by his shenanigans and who won't be. You would note that my criticism of him was based primarily on his evasiveness and inability to 'call a spade a spade'.

We may disagree on issues, but I think we should be fair to each other and to the proceedings.

I think Asiedu has been smart in trying to give straight answers to questions (perhaps coached to do so) and to be fair to justice Atuguba, during examination by Philip Addison, the bench did not interfere much with the witness or did they?

Some of you aqre so dumb you don't understand the court proceedings but you open your mouths and let the whole world know how dumb you are.

First, Asiedu Nketiah is being led to give evidence by his own lawyer so the statements he is making cannot be objected to by Petitioners lawyer since his own lawyer asked him open ended questions that gives him opportunity to make statements. It is the Judges who can cut him off.

Secondly, Asiedu Nketiah making long statements can later came back to haunt him since the Petitioners lawyers can sieve through his statements and impeach him for making wrongful statements especially his definition of what over voting is. This will be a big problem for him when he is cross examined by Addison or one of the Lawyers from the other side.

Making statements that are steemed with inaccuracies will come back to bite Asiedu Nketiah hard later, mark it on the wall. Asiedu Nketiah thinks he is being cute with such childish pranks, he will pay dearly for that.

Even I was not in the country I heard lots of irregularities and voting without verification long before declaration of the results. I followed the elections critically because I did not want anybody to tell me a lie.

Because what we were made to believe is not what they are pursuing in court. Ask the NPP to mention a single polling station where stealing occurred? The constitution and existing case law of Ghana frowns seriously on any attempt to dis-enfrachise registered voters. The president only added his voice to opinion leaders who were appealing for their subjects not to be dis-enfranchised as long as they were registered.

The facts about the mal-function of the Biometric Machines have not yet been fully investigated and understood by the EC and they must probe further into the performance of the Machines to avoid any further future problems with the machines. My personal observation was that the Machines tended to reject elderly voters more that it did for the youth.

I personally observed, my Lord the Chief justice go through the Biometric Machine on more that 4 occassions on TV before his finger print was accepted.

We must not just wish away that technological challenge with the machine

There is plain display of bias in this court proceeding! And the world is watching. The merit would be dissected by not only citizens in Ghana but literally the world over!

If Justice Atuguba cares so much about Ghana and his own integrity he must wean himself completely from any traces of political sympathy and do the just thing; impartiality!!!
