As to be expected all the regions increased with the exception of Ashanti and I questioned myself as to the kind of economic activities going on in the Volta and Northern Regions to guarantee population growth. We all know that people in the Volta Region are moving consistently to Accra and those in the North are moving to the Ashanti Region, meanwhile the numbers in the North and Volta Regions have increased while Ashanti has reduced. This to me was just ridiculous and despicable, to say the least. Ghana's population has increased despite you moving to the USA . Why do some of you holes or cotton wool in your heads?

THAT AS I STARTED LAYING THE FOUNDATION OF THE MOTION THAT I WAS ASKED BY HIS LORDSHIP GBADEGBE WHETHER I DID ATTACH A SWORN AFFIDAVIT TO THE MOTION FOR LEAVE AND I ANSWERED NO BECAUSE TO MY BEST PROFESSIONAL UNDERSTANDING AND TACTICALLY STRATEGY THE AFFIDAVIT WAS NOT NECESSARY AT THAT STAGE AND MOREOVER, AS INTERNATIONAL LAWYER WHO DULY SIGNED THE MOTION WHICH CAPTURED THE REASON FOR THE MOTION FOR LEAVE DID NOT NEED AFFIDAVIT SINCE I WAS NOT A PARTY TO THE ACTION.
THAT I WAS ONLY COMING TO THE COURT AS "FRIEND OF COURT" TO RESPECTFULLY DRAW THE COURT ATTENTION TO SOME RELEVANT PROVISIONS OF THE GHANA 1992 CONSTITUTION PRECISELY CHAPTER 008 SECTIONS 4,5 & 6 WHICH IN EFFECT PROVIDED THAT "A SITTING PRESIDENT OF GHANA WHILE IN OFFICE IS NOT AMENABLE TO ANY COURT OF GHANA".
THAT THERE IS/WAS A CASE LAW/LEGAL PRECEDENT IN THE CASE OF "NEW PATRIOTIC PARTY VRS. PRESIDENT RAWLINGS AND ATTORNEY GENERAL" WHEN THE NPP CHALLENGED PRESIDENT RAWLINGS CONSTITUTIONAL AUTHORITY WHEN THE PRESIDENT APPOINTED THE DISTRICT CHIEF EXECUTIVES. THAT THE SUPREME COURT HELD UNANIMOUSLY THAT PRESIDENT RAWLINGS RIGHTFULLY EXERCISED H.E CONSTITUTIONAL POWER IN MAKING THE APPOINTMENTS.
THAT IT WAS IN THIS CASE WHEN THE SUPREME COURT ALSO DECIDED THE LEGAL ISSUE "WHETHER OR NOT A SITTING PRESIDENT OF GHANA WHILE IN OFFICE CAN OR COULD BE SUED OR JOINED TO A LAWSUIT AS DEFENDANT?"
THAT THE SUPREME COURT HELD OF MAJORITY 3 TO 2 THAT "A SITTING PRESIDENT OF GHANA CANNOT BE SUED OR JOINED AS DEFENDANT TO A LAWSUIT".
THAT THE FIRST PRINCIPLE OF THE RULE OF LAW PROVIDES THAT "THE SUPREMACY OF THE LAW AS ADMINISTERED BY THE ORDINARY LAW COURTS" AND IN THIS INSTANT CASE, THE SUPREME COURT OF GHANA HAS SETTLED THE LEGAL QUESTION.
THAT THE SUPREME COURT ASKED ME WHETHER I WOULD LIKE TO WITHDRAW THE MOTION FOR LEAVE AND TO ATTACH THE AFFIDAVIT TO IT AND TO COME BACK OR I WOULD RELY ON THE MOTION FOR LEAVE THAT I HAVE ALREADY ATTACHED THE RELEVANT PROVISIONS OF THE CONSTITUTION AND I TOLD THE COURT THAT I WOULD RELY ON THE MOTION FOR LEAVE AND ALL THE ATTACHMENTS.
THAT MY LEGAL STRATEGY OF CHOOSING THAT OPTION FIRSTLY WAS TO DRAW THE KIND ATTENTION TO THE RELEVANT PROVISIONS AND I HAVE DONE THAT.
SECONDLY, TO DEMONSTRATE TO THE COURT THAT ELECTIONS ARE NOT HELD ON PINK SHEETS BUT AT THE POLLING STATIONS THROUGH THE BALLOT BOX AND IF THE PETITIONERS THROUGH 2ND PETITIONER DR. BAWUMIA NOTORIOUSLY INFORMED THE COURT THROUGH CROSS-EXAMINATIONS THAT THE NPP POLLING AGENTS SIGNED THE PINK SHEETS AT THE POLLING STATIONS AND HAVE NOT ALSO MADE ANY FORMAL REPORTS OF ANY MALPRACTICES OR ANY WRONG DOINGS BUT JUST THAT THERE WERE SOME ERRORS ON THE PINK SHEETS AND HE HIMSELF COMMITTED SERIES OF THE SAME MISTAKES AND EVEN MIS-LABELLING SOME OF THE SAME POLLING STATIONS THEN WHAT IS THE RATIONALE OF THE COURT ENTERTAINING THE PETITION?
THAT THE COURT HELD THAT MY MOTION FOR LEAVE WAS PARTISAN SINCE IT WAS IN FAVOUR OF H.E.PRESIDENT JOHN DRAMANI MAHAMA AND I HAVE NOT ALSO ATTACHED A SWORN AFFIDAVIT TO THE MOTION FOR LEAVE THEREFORE THE MOTION FOR LEAVE WAS DISMISSED.
HOWEVER, I DID IMPRESS UPON THE SUPREME COURT THAT SINCE I RELIED ON THAT MOTION WITH ALL THE ATTACHMENTS IT IS/WAS IMPOSED ON THE COURT TO ACT "SUO MOTTO" THAT IS, BY THE COURT OWN VOLITION.
THEREFORE THE LEFAL PRINCIPLE HAS BEEN SET AS "IF A PREPARER OF DOCUMENTS MADE HONEST MISTAKES ON THE FACE OF THE DOCUMENTS IS IT FOR THE COURT TO CURE SUCH DEFECTS OR TO REMAND THE DOCUMENTS BACK TO THE MAKER OR PREPARER TO CURE THE DEFECTS OR TO DISMISS THE CASE IN ITS ENTIRETY?"
IN FACT, THESE ARE THE ISSUES FOR THE DETERMINATION OF THE SUPREME COURT.
IT IS THEREFORE NOT SURPRISING THAT ALL THE COUNSELS FOR BOTH PETITIONERS AND RESPONDENTS OBJECTED TO THE MOTION
HOWEVER, WHEN H.E.PRESIDENT OF GHANA WAS DRAGGED TO COURT BY THE PETITIONERS NONE OF THEM RAISED A PRELIMINARY OBJECTIONS.
THAT GOOD LAWYERS STRONGEST ARSENAL IS LEGAL RESEARCH.

The most significant lesson to be drawn from the election petition is that never again shall any malevolent person or party be allowed to make spurious and gratutious allegations against state instutions including the EC in respect of their statutory functions, unless such persons or party can adduce unimpeachable facts if they want to be taken seriously by any person. Henceforth, professional litigants and sore losers who find it convenient to blame the EC for their own known failures at the polls will now be circumspect in any future accusations. Seeing Bawumia agonise before their lordships under an avalanche of questions from counsel of the respondents and he resorting to lecture sessions just to claw back some credibility, was indeed sad. I dare say that if Bawumia were to know what he knows now, he probably would not have agreed to be a withness in a case which in the first place was doomed to fail, much less become a star witness.
