Gabby cannot simply understand that that THE CONSTITUTION IS AND WILL REMAIN THE SUPREME LAW of the land and that any law that contradicts the constitution is unconstitutional and therefore void.
The LI which say there should be no appeal in the case of electoral disputes is against the constitution that empowers Judges to hear reviews.

Gabby, you appear to be very angry about this ruling and it come across your article. Unlike you, I am not a lawyer let alone constitutional law but that does not mean that I am completely naive on such matters. One thing I know for certain is that, in every democracy, the Constitution is always supreme. This means any legislation or regulation, be it primary or secondary legislation, Executive, Constitutional, Legislative or Statutory Instrument that contravenes the Constitution could be or must be ruled unconstitutional if it is challenged before the Supreme Court for interpretation. Therefore the Supreme Court may be right in their judgement.
However, it will be disturbing if the Executive was behind the application to the Supreme Court. I say so because the Executive cannot support a Constitutional Instrument and later turn round to challenge it at the Supreme Court. That does not make sense to me.
I am also not sure if you are angry because there is the indication that only an Executive (Presidential) Instrument can order the judiciary to work on public holidays. Just take out the current president and assume that any president in office could make that Executive Instrument, including Nana Akufo Addo, if his petition is successful. Would that make it right?
In my view, even an Executive Instrument cannot and must not contravene the Supreme Law of the land. Unless, there is a national emergency or a threat to the security of the state, it would be unconstitutional for an Executive Instrument to order the judiciary to work on public holidays. If Ghana wants the judiciary to work on public holidays, the Constitution should be amended or it should be done through primary legislation and not through any Instrument.
Perhaps, the Justices do not fancy working on public holidays when the rest of the nation would be enjoying. May be the ruling is to protect their rights to a public holiday as citizens, so it's not about pandering or 'kowtowting' to the Executive but safeguarding their own interest.
Gabby, cool down and do not take on the Justices yet because you have an ongoing battle at the same Supreme Court. Whether this ruling is right or wrong, only time will tell.

Meanwhile, a precedence in the British Legal Sustem does not necessarily have to emulated in ours. We do not have to assume all that is British must be a blue-print for our Legal System. Gabby must understand that the authority emanating from an Aristocrat is not the same as one that a Republic's Constitution confers on the Executive. In principle, it is easier to legally challenge a Monarch's ruling than that of a Constitution-derived mandate by an elected President of a Republic.
I am not a Lawyer but I can discern the difference in the legal seams that one might attempt to sever in both cases. Don't mislead us, Gabby!

You see, if you have a system where the Chief Justice in her own free will overturned a suprem cout rule, after nine good judges have decided on, then you should not be worried and this must tell you that whatever goes on there in the suprem court is far behind justice but rather the will of the powers that be. I personally see what is going on in Ghana politice and the on going court case as waste of resources just because whatever be the outcome of the case will at the end be turned by the powers that be in favour of oneself but not what the nine judges will deem fit as was done by georgina wood regarding the Live telecast of the case

I personally see what is going on in Ghana politice and the on going court case as waste of resources just because whatever be the outcome of the case will at the end be turned by the powers that be in favour of oneself but not what the nine judges will deem fit as was done by georgina wood regarding the Live telecast of the case
