Personally, I an not an NPP sympathiser but legally the have a watertight case. I expect legal luminary like Tsatsu to know that the President and the NDC do not have a case regarding that aspect .
However Tsatsu who the whole world know as a thief and lier will fight tooth and nail to try to convince Ghanaians that no law was broken. The elections were compromised, simple and straight forward .

Bawumia keeps on insisting that voting without biometric verification was illegal. But there is no law which says that.

CI 75 Sec 30(2) requires that the voter shall go through a biometric verification process. But CI 75 Sec 30 (1) allows for any other evidence determined by the Commission , in order to establish by fingerprint or facial recognition that the person registered is the registered voter whose name and voter identification number and particulars appear in the register.

Bawumia has not argued , at least not yet, that Secc 30(2) of CI 75 should over ride Sec (30) 1 and further more also override Article 42 of the Constitution of Ghana which says 'every citizen of Ghana of 18 years of age or above of sound mind has the right to vote and is entitled to be registered for the purpose of public elections and referenda.

Ci 75 Sec 30(2) does not penalize any voter who votes without biometric verification nor does the CI expressly say any such vote will be deemed illegal. The specific grounds for annulling a vote are set out in CI 75 Sec 37 (1) and include instances where the ballot paper does not bear the official stamp of the Commission; is not thumb printed by the voter to clearly identify the candidate for whom the vote was case; is not thumb printed at all or has it a writing or mark by which the vote could easily be identified.

The fact that prior to the elections all and sundry went about singing no biometric verification no vote does not mean the law says so.

Bawumia is going to have great difficulty citing specific law not presumptions. But beyond it all it sounds all desperate to argue that where 2 people voted with some other form of verification but without biometric verification, 330 odd votes should be annulled. The object of biometric verification was to stamp out multiple voting and not to be used as a technicality to be declared president.

Illiterate, do you understand what that means? It simply means in cases where it is not possible to verify through Biometric verification, like lost of limb, any other reason that prevents one from going through verufication, then the EC will determine how one can be verified to vote.

What your Teacher DEGAULE is hiding from you is that, it does not include where the Biometric machine is not working and all those who cannot go through the Biometric process due to loss of limbs have a column on the pink sheet where their votes are tallied. Also these people are identified on the voting register when they were registering to vote. What Mahama and the Northern Chiefs forced Afari Gyan to allow to vote are not qualified under the rules your Teacher is telling you.

It does not include when Biometric machine is not working as you have intimated below under another post of yours.

These special people are even identified on the voter registration roles and their names on the voter register shows that, these people cannot go through Biometric registration and there is a column on the pink sheet where their votes are tallied.

He however presents another exhibit quoted from Myjoyonline.com in which the first respondent President John Mahama was asking the EC to allow voters to vote without being verified because there were challenges with the verification machine. He asks the witness to read the report on Myjoyonline.com in which several other people including chiefs expressed the same concern shared by the president."

Even if it was Dr. Bawumiah who introduced the exhibit, as a good lawyer, Tsikata was doing the cross-examination and he could have objected or refused to allow Bawumiah to introduce any exhibit as Luther did time and time again and the nine Justices would have agreed with him. Do you remember during the cross examination by Lithur when Bawumiah wanted to look at his notes and he refused to allow him to do that. You don't allow a witness to introduce any exhibit you don't want.

And i dare say that, Afari Gyan's statement does not necessarily become law. That was his opinion, and he was very fair to all sides in allowing people to vote in instances when the machines broke down. Ask NPP'S Ahmed Arthur of Okaikoi South constituency. That is what the NDC is keeping to it's chest until the last day.

We have laws for a reason, the law was flouted, it's that simple folks and it doesn't matter if you bring Nostradamus himself to act as the attorney for the respondents; he also won't be able to make any sound arguments but blow hot air! All this fuss about Tsatsu, you'd have thought it was the second coming of Jesus, I was even surprised at some of his utterances today. Dagombas are from Tamale, Yendi,Kumbungu, Tolon, Savelugu, Pong Tamale, etc etc and Mamprussis are from Naleirigu, Gambaga, Walewale etc.

They both understand each other just like Fantis and Ashantis but they speak different dialects .

Dagombas don't want to be called Mamprussis and to be fair Mamprussis don't also want to be labelled as Dagombas.

Aliu Mahama, Huudu Yahaya, Tolon-Naa , Gen Hamidu, etc are Dagombas whereas Prof Nabila, and Dr Mahama of PNC are Mamprusi's.

Generally the Mamprussis have a higher Christian population whereas the Dagombas have a higher Muslim population. I hope I have enlightened you enough.

1) Break the machines down
2) Make that appeal so that people from Togo, Burkina Faso, Nigeria and Benin could vote for NDC. No wonder the number of votes exceeded the number of registered voters.

There are two issues here. The constitution says nobody should be disenfrachised. The EC says no verification no vote. Remember that the constitution is supreme! It is not a case of Mahama asking people to break the law.

The Constitution says no one should be disenfranchised. So if I arrive at the polling station after 5pm, should I be allowed to vote. If yes, why has the EC been preventing people to vote who arrive at the polling station after 5pm? Mind you, I'm not talking about those who are already in the queue before 5pm.

Who told Bawumia that the only way to verify a voter’s identity and registration is strictly by the verification machines even when those machines are broken with the party agents and EC officials attesting to that fact; not to mention the circumstance the EC was in?Mahama just appealed to the ECC to verify the voters with the next best option available to them when the machines were broke. He did not force them to do it. EC in its wisdom and experience within the confines of the law went ahead to do that.

Once he said " no biometric verification, no voting" Mahama should not have intervened to instruct Afari-Gyan to let others vote without Biometric Verification. A law is a law. The machines should have been repaired no matter how long it took. This Mahama guy must be impeached for breaking the law and intervening in the electoral process. Likewise, Afari-Gyan must be charged and sent to jail for breaking the law. Doc. Bawumia is right in the sense that "the law is the law and Mahama had no business in appealing for the law to be set aside" to the disadvantage of other voters. Tsatsu Tsikata, an ex-convict should be not be allowed to practise law at any court in Ghana, and must be banned from the Supreme Court proceedings.

Nobody really avered his/her mind to the fact that the verification machine will fail so no contingency measures were put into place. The decision to allow additional day for voting ie 8th was an after thought.
Usually, the EC do not recruit well educated people to manage voting and its attendant matters. It has not been attractive to have well educated people take up this assignment. It is usually unemployed SSS graduates who avail themselves for this kind of jobs. So it is not surprising to experience the varied flaws in the handling of the pink sheets. The same can be said for the various parties as agents.
These agents are representatives of the candidates and should have be given proper training but we usually dont do this. The acts of these agents bind the various candidates. They can be ''Estopped'' for claiming ignorance in their actions during the process.
There is a classical banking law in relation to Estoppel which I will quote tomorrow after doing some research tonight.
NPP should withdraw from this legal case and learn their lessons well. The same is for all other parties and candidates to learn from this.

This after-thought NPP action would not hold water. Why were protests not filed? It is taking too long for the SC to throw out this case. You want the Law to work because Law is Law, but you ignore procedure, which is part and parcel of Law. Why are NPP not in a high court, but in Supreme Court? The Law spells out the offence and punishment as well as the PROCEDURE to be followed.

In fact there's electronic voting, very expensive and yet will not solve all the voting fraud. Ghanaians need a change in mentality else we will always go to court from henceforth.

So Law is law is at best an uninformed lay man's view who in the light of realities of the situation is still clutching on to the very few axioms he has learnt. Bawumia would do well to leave matters of law to his lawyers and just stick to the facts, because at the end of the day he would not be excused for making such unguarded pronouncements, that only legal minds can make. The EC make mistakes training officers and again got overwhelmed with all the abuses and problems. Don't forget they were under pressure to release results in a day or two. Look at all the mistakes in the NPP's documents even though they had 5 days to present it. It is not easy.

The law was made for man and not man for the law; as such when the law becomes a problem rather than the solution, reason demands than wisdom should be applied. That is just what the responsible president did.
The president made an appeal not an order not knowing who was voting for who.
Bewumia does not deserve to lead.By the way he is behaving his weakness, which hitherto, has been hidden, is now exposed.He that have what it takes to lead a people and a nation.
Only the laws or the word of God that changes not but those made by man will always have to revisited so that it can continue to be relevant to the people.
It is pathetic to hear Bewumia condemning the wise and human appeal made by the president to ease the pain of the citizens.
It is sad that Bewumia should accuse the president of wrongdoing when the only thing that the president did was to heed the appeal of the sons and daughters of Ghana!!
Bewumia can not lead.He should get out of politics and concentrate in his banking career.

Ghana says that:
“Every citizen of Ghana of
eighteen years of age or above
and of sound mind has the right
to vote and is entitled to be
registered as a voter for the
purposes of public elections and
referenda.”
Therefore, only the following
four conditions are required by
the constitution for a person to
vote in an election or
referendum: (1) proof of
citizenship, (2) proof that you are
18 or older, (3) proof sound of
mind, and (4) your name appears
in the voters’ register.
Section 34(1) of C.I. 75 deals with the types of acts that would invalidate the ballot of a voter.
While we are at it, lets read Sections 30(1) and 30(2) of C.I. 75..

You really don't have to dig any deeper to find our where and how the EC stole the ballot for John Mahama. Just examine the 241,000 diasporan voters registry and you'll immediately find the answer. People don't have to pretend they don't know about these horrible revelations, when in fact the EC could only provide 705 registered voters names when the Supreme Court ordered them to tender in evidence.

When you subtract 705 from it, 240,295 is the total; strike that out of Mahama's alleged 311,000 winning number and the answer is: 70,705. That number cannot declare Mahama a winner! It's a shame that NDC fanatics would want to twist facts when everyone is watching. Deception and propaganda won't take NDC anywhere.

The president did not want any citizen of the voting age, dully registered with other forms of IDs to be disenfranchised. This is done everywhere. en everywhere So Bawumia wanted to disenfranchise about 50% of eligible voters whose fault it wasn't for the verification machines to break down? Is this man really serious? Remember, the president was not campaigning when he said that. As the head of the country, he had every right to ensure that no one was disenfranchised based on the malfunctioning of an equipment. He has that power! You should really also know that the so-called Biometric machine was only part (25%) of the whole verification tools used in the election exercise.. Let me list them here for you:'
1. The citizen's ID card
2. The citizen's Voter card
3. The voter's register itself which ought to be at the voting area to check and verify the name.
4. The biometric machine itself...

Remember also that the machine is very sensitive to dust, oil, grease, etc. etc.. Considering the the fact that most of the voting was done in a very dirty, sandy, windy environments. The fact also that even water to wash hands at most some of the voting station was unavailable... why on earth should a voter who had passed through all these registration exercise, may have even woken up very early in the morning, had perhaps stood in line for hours upon hours, just to be told that because the so-called biometric machine couldn't read his fingerprints, he is barred from voting. Would you like to experience that yourself? Think about it again. Know that, president is the main guardian and guarantor of the citizen's fundamental rights and therefore will never allow disenfranchising such a voter..
The fact is that no court of the land will annul such votes, based on that stupid law. you guys are only dreaming
Even in America and other advanced countries where such machines are manufactured and used, they do encounter such problems and they have to rely on other means of verification

However, the EC and the NDC believed they could deceive Ghanaians by faulting what the EC itself had declared to electoral staff as well as all political parties. Hoping that in worse scenario, their choice of president would be sworn in and tat will be the end! Well, Nana Akufo-Addo & Co., gathered the courage and filed their writ at the Supreme Court. Nobody will allow the EC to deceive Ghanaians anymore; the cheating and deception is too much. It's time to to the proper thing for Ghana's democracy to thrive. We're all hoping our Noble Justices would do the right think for mother Ghana.
