At 1530 Quarshie Idun asks for proceedings to be adjourned. Presiding judge Atuguba reminds him that the time is not even 16 hours and asks the reason for call for adjournement. Quarshie Idun says fatigue has set in. Atuguba asks if sitting down for his cross-examination will mitigate the fatigue. He answers no. Another judge on the panel suggests to Quarshie Idun to allow a member of his legal team to continue with the cross examination but he objects to that suggestion. Another judge again humorously suggests if he will allow a counsel on the other side to take over his cross-examination? He says “appearances may be deceptive.”
Judge Atuguba then grants his requests for proceedings to be adjourned to Monday, April 29, 2013 at 9:00 am.

Believe you me, providing we collectively exercise maximum restraint and utter faith in the judgement of the distinguished Justices we will come out stronger in our electoral system and chalk a remarkable feat other nations,especially African, could well emulate. And if the final verdict (premised on the good and non-subjective ruling of the distinguished NINE) triggered a condescending climate nationwide and not chaos(God forbid!)we would have in place a solid and legally sound government, irrespective of whose party it would, to govern in peace to heal wounds and turn the wheels of economic development.

As the old saying goes, "make haste slowly". I am commenting from Kampala, the capital city of Uganda where I have just been facilitating an FAO workshop.
I had a very interesting conversation with two senior Kenyan academics today at lunch. The conversation started with the president's latest ministerial appointments and eventually went into the Kenyan Supreme Court Ruling in the Case of Oginga v. the Electoral commission of Kenya in their recent, disputed elections!!!
I recall some Ghanaian voices praising Kenya's swift judicial process and lamentations about how 'inept' our supreme justices and our SC was in handling our own major landmark case of Nana Akufo Addo et.al., V. J Mahama et.al. At the time, I posted comments to the effect that we had very little to learn from Kenya and questioned what people knew aboiut the nature of the Kenyan Odinga petition and the details of how the matter was dealt with.
Among others, Otchere-Darko of the NPP and Danquah-Busia Institute who pretends to be knowledgeable of the law and related matters including constitutional law, wrote lengthily on the process, although his arguments were shallow and lacked real facts. It is easy to carry out 'arm chair analysis' as we all often do on this forum.the reality is always a different curtle of fish.
I can guarantee Otchere-Darko and his cohorts who seem to think that "justice delayed is justice denied" that if Ghana had followed the Kenya example, the case of the petitioners being heard now in court would have gone a similar way as Odinga's, thrown out, dismissed and that would have been the end of it!!! Is that what we want? Here is what happened in Kenya:
Raola Odinga filed against the Kenyan Electoral Commission (KEC)alleging OVER VOTING, GROSS IRREGULARITIES AND FRAUD. This was after the KEC had taken nearly FIVE days (v. 2 days in Ghana) to announce the outcome of the election.
Odinga had ONE WEEK within which to taylor his appeal v. 21 days in Ghana. Having filed his appeal, Odinga needed the evidence to advance his case (remember the pink sheets at the heart of the Ghana case?). Well Odinga was relying on the KEC to supply him with the evidence which his legal team ONLY received ONE day before the deadline for filing completely all his evidence.
How on earth could anyone accomplish such a feat when electoral commissions with their whole large battalion of workers up and down the country took nearly 5 days to complete the counting and declare the winner. Mind you, the Kenyan electorate were also around 14 million so, not different from the Ghana figure (talk about efficiency, transparency and fairness!!!).
Any how, in Ghana, Addo and his legal team have had plenty of time to sift through the "mountain of evidenced" and even with that, they still get their sums wrong, duplicate pink sheets, etc. as we are now hearing, following the facts of the case at the SC.
Odinga naturally could not manage to put all his evidence together although my Kenyan professors were of a very strong view that there had been large scale and gross malpractices etc. They also beileve that it was delibrate on the part of the KEC to delay providing "proper and better particulars to the petitioner, in this case Raola Odinga and his legal team".
As it turns out, Odinga's case at the Kenyan supreme court was actually DISMISSED ON A TECHNICALITY i.e. that he had not beenable to "file his evidence within the stipulated time"!!! I was shocked, amazed and shall I say flabaggastered to learn that this is what actually happended.In fact, I felt sorry for my hapless, helpless, frustrated and powerless Kenyan colleagues who felt so hurt and cheated!!!
Therefore the "swift" conclusion of the Kenyatta / Odinga case was purely because the supreme court there did not feel that the case should proceed since the petitioner had not met the legal and statutory requirements within the stipulated time!!!
Now my friends, this is a true story and those ignorant self-styled constitutional lawyers and foolish, pompous commentators in Ghana should take note.
Please check your facts before you begin to praise a system that we have known to be one of the most corrupt in the world. I repeat what I said then, and now, that Kenya is not, and never will be a good example for Ghana to learn from as far as constitutional law is concerned.
It is a great pity that in Africa, we have this state of affairs and somehow assuming POWER is more important than the means by which you get it. I believe we should applaud the Ghana supreme court for following due process and for being so patient with both the petitioners and respondents in our case. Do we all want to see a conclusion to the case, you bet.
However I would rather we followed this detailed and transparent process (televising in Kenya was a smokescreen and did not reflect truth and honesty, nor was the boastfulness of the Kenyan supreme court who had the nerve to refer to the Ghana case in his press conference following their 'botched' ruling for which they hid behind the constitution and technicalities)being followed in Ghana. Be careful what you wish for, Nana would have been dead in the water long ago if we had followed Kenya. It is certainly not a good example for Ghana, nor any other African country for that matter!

He was just one example of several commentators but he specifically argued strongly on this matter and even appeared to 'attack' the SC for delaying proceedings and I thought he should know he was wrong. That's all.

This whole court business is a joke. For me it also exposes some inefficiencies in the court system. Why do the judges work for only 4 days in a week? Why should a tired lawyer force the proceedings to be moved to the following week? If he does not have the energy he should not be there in the first place. His colleagues who went to the civil service are on pension so why should we allow this man to exacebate the inefficiency? is any body taking into account the downtime/idle time particularly of government workers during the week in watching television? the country is definately not managed by seriuos people or has been conned by a group of people(politicians) to believe that everything about them is paramount? we are heading for a ditch!! meanwhile judgement debts are being paid on the Quiet whilst we keep on watching television???
