The issue of this not altering the credibility or otherwise of either the plaintiff or respondents' evidence is neither here nor there. What is Ben Ephson and his cohorts afraid of?

If the Supreme Court is found to have been fair in their judgement at the end of the case, then both parties would abide by the court's decision. But, if against all sanity, the Supreme Court is found to have been partial in their judgement at the end of the case, then God save us all! It takes just one foolish person to cry: 'foul', and all hell would break loose! Just go to Kumasi Kajetia at 1.30 pm on any Wednesday, start running while at the same time you keep shouting: "Awi 00! Awi ooo!! Awi oooo!!!" You won't like to see people grinding up speculations after the SC ruling plus its attendant uncalled for tension. What do we lose at all if proceedings are made transparent? Tell me, Ben?

Where did the Kenyans get it wrong in choosing open proceedings?

We must not put up vain and weak argument to prop up what is fundamentally wrong and unhelpful.

The Supreme Court's reasoning against the public display of dispute in no way synchronise with this logic of basket and water! Even then the Court or the CJ would have calmed nerves more by going the Kenyan way not for just copying line, hook and sinker but the wisdom in that option.

For me, I still respect the choice of the Supreme Court; at the end of the day posterity would be the best judge. We wish them well and wish nothing short of peace after the verdict.
