We are still running away from the facts. Granted, it's 4 months or 1 month before the term of office of the sitting President expires, what constitutional provision clearly spells out, the timeframe and limit within which, sucha case needs to be resolved? In the Kenyan case, there were clear, specific, timelines which put the pressure on the SC, to meet specifc deadlines. I cannot for the life of me, understand, why, in our case, such, a provision is not in our statutory books. This need to be looked at, so as to ensure, the smooth transition of power, smooth dminstration of the President, reduction in the overall tension in the country, and to ensure rapid development of the country, with everybody on deck, contributing his quota. It's unforgivable that, we have such a hang situation.

Your article is good but there is a big difference between Ghana now and Kenya. Kenya's constitution is robust and strong not only for elections. It has devolved power to the counties. Whereas Afari Gyan is adding more districts and constituencies which is a waste of resources, Kenya has reduced their districts for 280 districts to 47 counties.. Can you imagine the amount saved on useless government officials? They voted the same day for County Governors as well so the governments are not appointed by people like Mahama who appoints thieves. The ratio of the funds to the counties have been designed in the constitution. They have also abolished the position of Regional Ministers (as it is in Ghana) and many others. The constitution of Ghana drawn by seamstresses and foot soldiers has outlived it's usefulness. If you remember, because of JJ Rawlings bitterness and atrocities to knowledgeable people, the Ghana Bar Association and the Ghana Medical Association for example never participated in the development of Ghana's current constitution. If we have a robust constitution none of the evil dwarfs would have come near government. We need a new constitution or rather copy Kenya's one simple.

The Kenya judgement was fast because the complainants gathered all their facts before going to court. They did not go backwards and forwards to gather all data and did not ask the EC to provide them with a 'pink' print, a document which, was signed by all parties at all the various electoral points during the election.
Secondly, the Kenya complainants did not give any flimsy political excuses regarding their objection to the chair of the panel of the judges. Thirdly, in the Kenya case, the figures presented initially were. maintained. The complainant was confident and did not change the figure every second. You can see that the delay has ben caused by NPP complainants and not the court, bearing in mind the political sensitivity of the case and being the first of such challenge in the history of Ghana .

The problem of law is that sometimes is illogical,give a man a chance no matter how ,he finds a way to derage around it.A one mouth period was ok for the NPP to present their case at the supreme court in order to allow the justices to hold a fast track hearings.But an intention of wait and see attitude in line with the legal process kept the NPP to the last minutes of the dead line to file in their petition.In the spirit of fairness , a new legislation should be sorted that would make it mandatory for seekers to file in petitions and for the court to take them as early as possible and rule on them before the swearing-in of the president elect.It would help ease the shilly shally the country is going on today.Kenya has set the example and hopefully future African countries with similar problems would follow this steps to save time waisted at the courts and the antagonies against one another.I hope this case come to an end sooner and Ghana would move on.I have great confidence in our judicial system,Over to you the Supreme Justices of our land,,,,,,,

What the nation needs is a constitutional review to give a time frame within which electoral petitions before a court must be disposed of.Until this is done the Supreme Court should not be accused of wasting time.The Kenyan Supreme Court acted in line with the demands of the nation's constitution which gave the Supreme Court 14 days to dispose of Raila Odinga's petition.Raila Odinga is now accusing the Supreme Court of ignoring some vital evidence from his camp because it did not have time to consider all the available evidence before it.In effect what he is saying is that lack of enough time to scrutinize the evidence before the court has caused him justice .The lesson here is that quick dispensation of justice also has serious drawbacks.
