This article does not give enough information regarding to the topic so as to comment fairly on land litigation between a Lessor and a Lessee but there are so many of such cases in our courts because the land acquisition industry is as murkier as the Oil industry. The underlying denominator is greed greed greed. All players are guilty be it the Landlord or Tenants, Lessors and Lessees alike, Assignor or Assignees. Public servants are the most guilty for they will do anything within their power to take control of Ga lands all in the name of the Law because they obviously benefit greatly in managing Ga lands.First and foremost the valuation of Ga lands when offered by Land Administrators to prospective Lessees are undervalued with regard to the true market value. These public servants tend to benefit from an undervalued land because the immediate resale yields huge profit margins. A case in point is Land commission litigating with Osu Stool Council for the management of Osu Mantse layout.An acre of land at anywhere within this prime part of Accra goes for USD2Million or GHc3.8Million. This is far bellow the Valuation board value of GHc600,000. Prospective investors and developers are willing to pay as much as USD500,000 or GHc1Million as kickback to secure an acre plot from Land Commission at Land Commission values rather than the true market values. This is why the Ga youth and the public servants will continue to fight for the management of these lands obviously because of the huge fortunes to be made. In my view the only way out is to lease these lands at their true market values and these litigation will evaporate drastically. The middle men and public servant wont benefit and the Ga people will access the proceeds of the true market values of thier land through the Administrator of Stool Lands office as established by law since time immemorial. This is not rocket science but greedy politicians and public servants will continue to be in bed together to manipulate and lobby Laws that will forever put the management and control of Ga lands in their bosom so as to steal and pillage Ga lands.

Imagine this Law EI.108 1964 which seek to vest the Osu Mantse Layout lands in the name of the President of Ghana on behalf of the Osu people. This law is purely administrative and does not in anyway change the alodial title which means it is not an acquisition and compensation has not been paid.If ownership has not changed then how come a mere manger of land writes a lease of a parcel without the consent of the true owner. How can a CEO of a company take a major decision that bothers on ownership without the consent of the board or the shareholders or the owners of the company. Meanwhile the cardinal priciple of Statutory Formulation Act is that formulation of laws must be prospective and not retrospective however public servants has always managed this land as if its Govenment or Public land by acquisition and that by the EI.108 which supprisingly is not a retrospective law, hide behind the administrative power of Government to cheat the Ga people with a silly explanation that the proceeds of land sales are paid to the Stool account through the office of Administrator Of Stool Lands. This is comfortable for them because they are leasing these lands at peanuts with regard to the their true market values.
