Which law, (Act or Constitution) is this outgoing MP referring to support his claim that Mahama would be in contempt of court if he attends his inauguration? I am not surprised that Parliament approved Bills and Constitutional Instruments that contravened the Constitution, such as the Transitional Act.

I thought Appiah Ofori's comments are strange, too, when I noticed that no Court has, so far, issued any injunction to restrict the President-elect from fulfilling any of the roles assigned to the Office of the Presidency.

Unless the part of the Constitution that allows for the Suit the NPP has brought to Court on the Elections plainly prohibits the disputed President-elect to perform any such roles, it does not make sense to expect the President would be liable for contempt of Court for that inaugural activity.

If any such restriction would emerge, it could only come out of the Supreme Court deliberations on the Case.

I think Mr. Appiah Ofori got this wrong. If he prefers that restriction be imposed on the President, he could file a petition to the Courts for that particular injunction. That would make more sense than just expecting the President to be held in contempt for something that has only be alleged and not evaluated yet by the Courts.

I will gladly want to read from him the law that backs: “If Mahama does not want to be in contempt of Court then he should not submit himself for his swearing-in because he is the first respondent in the case”

If anyone knows him he should forward the following to him:
Articles Article 57, (4) and (5) state:
"(4) Without prejudice to the provisions of article 2 of this Constitution, and subject to the operation of the prerogative writs, the President shall not, while in office, be liable to proceedings in any court for the performance of his functions, or for any act done or omitted to be done, or purported to be done, or purported to have been done or purporting to be done in the performance of his functions, under this Constitution or any other law.

(5) The President shall not, while in office as President, be personally liable to any civil or criminal proceedings in court."

Maybe MPs should be obliged to study the Constitution and be tested to ensure their knowledge of it before being accepted as contestants in their constituencies as candidates.

Maybe, The President-Elect,Mr. John Mahamah, is mute in deferring his swearing-in ceremony either because he is itching to continue retaining power because he just tasted it and he has found how sweet the nectar it and because of how too sweet the nectar, he does not wish to stop, even for a a week or two, or is it because of the dignitaries who have already been invited to attend?

If none of the above holds true then, as a Statesman, and also to prove to the whole world how exemplary he is, he should defer his 'coronation' until after the determination by the supreme court, which can take only a week or two.

The outspoken MP speaking to XYZ News said the president will be acting in contempt of the Supreme Court if he allows the inauguration to take place knowing his legitimacy is being challenged.

P.C Appiah Ofori also said his party will be defeating the purpose of its challenge of the election results at the Supreme Court if its leaders attended the inauguration ceremony.

“If Mahama does not want to be in contempt of Court then he should not submit himself for his swearing-in because he is the first respondent in the case” the lawmaker said.

On whether former President Kufuor should attend the ceremony or not, the outgoing MP said it’s all up to the former President to decide.

“The former President if he wants to attend then it is not because of the party but his status as former President. He can go if he so wishes”.

So if Mahama does not submit himself for the occasion then whose inauguration will Kufuor be atending as a stateman. What baboon heads on human frames.

NPP should prove all the allegations made against the EC and John Mahama. This is what the whole country is waiting from them.
The NDC knows it won the elections according to the rules so the party is not perturbed at all.
Those figures massaged and cooked by the NPP should be proved by them. The game being played by the NPP is a well known game.
The only way that party can have make any impact in this case is through the back door and we are waiting to confront that.It is their style of doing things that is I maintain strongly that the NPP are ''profesional thieves''. They have finished with the people of Ghana because they are known. Have they won any fair elections since the days of Osagyefo Nkrumah aside the 2000 and 2004,after exhaustion from the Rawlings regime for 19 years.
