The country is facing a crisis in its efforts to sharpen its democracy. The SC is going to play an important role in this crisis. What happens will determine how future elections will be held - specifically the counting and collating process. There are things wrong with our voting system that need changing. It is only a partisan who can call for SC to overturn the verdict even before we all (including the SC) see the evidence and hear the pleadings. But then, Akua Bonsu has never been anything but partisan.

So the NPP's claim to reject the non-biometric verification votes will not pass constitutional muster.
A citizen's vote cannot be rejected just because he or she did not use a biometric system.
Why? Because, the biometric verification is just a mechanism to reduce voter fraud--but not the system to grant or deny citizenship and the right to vote.

You erred by asking if the Supreme Court (SC) will "have the courage to agree with the NPP and overturn the results of the December 7, 2012 presidential elections or not?" This questions moves the NPP's allegations from allegations to be proved in court INTO irrefutable FACTS. This my dear, is not the case. The case before the supreme court involves allegations that are supposed to be proved BEYOND reasonable doubt, that they are the true reflections of what took place, and were undertaken to give UNDUE ADVANTAGE to one of the contestants.
The NPP started by telling the whole world that everything that was done was so designed as to give more votes to Mahama. Before going to court, they accused the EC of adding votes to Mahama and taking votes from Nana Addo. But when they were faced with presenting the facts, ALL candidates benefitted from the addtions as per the table below (taken from section 22 of their petition):
(1) John Dramani Mahama : 916,409;
(2) Henry Herbert Lartey : 6,413;
(3) Nana Addo Dankwa Akufo-Addo : 395,784;
(4) Papa Kwesi Nduom 8,778;
(5) Akwasi Addai Odike : 2,544;
(6) Hassan Ayariga : 5,956;
(7) Michael Abu Sakara Forster : 3,166;
(8) Jacob Osei Yeboah : 3,795
This is just the beginning of the real game. Since we are talking of legal issues, I will move into legal provisions regarding the elections. With the constitution and CI 75 in hand I can tell you that I am yet to come across any regulation which states that "if any polling station allowed voting without verification, results from that station would be excluded from final results." Logic may lead us to such a conclusion, and legal arguments in a court of law may grant such a prayer, but the same legal arguments, properly crafted could grant, in the worst scenario, that voting be repeated in the polling stations where voting was permited without biometric verfication.
Sections 30 (1) and (2) of CI 75 regulates voter identification before voting and Section 34 (1) directs what is to be done in case of failure of the biometric machine.
For your information, whereas Clause 1 (a) and (b) is more of a RECOMMENDATION for the presiding officer (or his assistant) to use a voter ID (or any other form of identification sanctioned by the EC) to identify the voter, Clause 2 on the other hand is an OBLIGATION on the voter (and possibly the presiding officer) to be biometrically identified before being issued with a ballot paper.
Thus, for proper identification, 2 elements are very necessary: 1, The Presiding Officer, and 2, The Biometric Verification equipment. Legal provisions are made for the presence of these elements in Section 17, for the Presiding officers and Polling Assistants, and Section 18, for the biometric equipment (sub-section 1.b). Whereas in Section 17 provison is made for replacement of the presiding officer by a polling assistant "during the absence or incapacity of the presiding officer," the only item that was to positively identify a voter before being given a ballot (the biomentric equipment) has ONLY a legal directive (adjournment, subject to an approval) backing its replacement in the event of a break-down.
This directive states in Section 34 (1) that: "Where the proceedings at a polling station are interrupted or obstructed by
(a) riot, open violence, storm, flood, or other natural catastrophe
or
(b) the breakdown of an equipment
the presiding officer shall in consultation with the returning officer and subject to the approval of the Commission, adjourn the proceedings to the following day."
Note the phrase "subject to the approval of the Commission" because if the comission declines the request for adjournment then voting could proceed without the biometric identification. Sure, such an act could be interpreted as a violation of Section 30 (2) of CI 75, but Section 30 (1) a, and b, is also a valid form of identification. The spirit of the biometric identification is to ensure that the person already identified in section 30 (1) is the voter, so in the event of a breakdown of the machine, and in the presence of all party agents, is it not possible for humans to disentangle themselves from the legal webs of a machine failure?
Moving a step further, Section 31(1) states: "A voter who desires to vote shall be present at the allotted station and the presiding officer or a polling assistant, shall after being satisfied that (a) the voter is registered and has not already voted; or (b) is voting as a proxy; deliver the ballot paper to the voter." So irrespective of the provision of regulation 30 (1) b, can a presiding officer who has satisfied himself that a voter is the person presenting an ID card (or any other identification sanctioned by the EC) but is faced with a non-functioning biometric machine give the green light to a voter by issuing the ballot paper?
Whatever the case, in persuit of good faith, what the NPP should seek, if the SC decided to uphold the argument of No Verification No Vote (NVNV), is not TO DISENFRANCHISE the innocent voters who performed their civic duties over hours in the sun, but rather an EQUAL OPPORTUNITY for the said voters to LET THEIR VOTES COUNT. And this can simply be done by seekring re-voting in the affected polling stations instead of STRIKING OUT the votes of those areas as if the voters never appeared at the polling stations to vote.
Every time that allegation of over-voting is made and repeated, I get more convinced that this allegation is the result of forgeting that SPECIAL VOTING took place in Ghana some 3 days before December 7 and that by law (CI 75, Section 21, sub-sections 10 and 11) these votes were to be counted on the 7th (and 8th due to adjournment). The NPP has not considered this factor, and have relied ONLY on the booklets issued to voter on December 7 and 8.
You may have your genuine concerns over financial irresponsibility and corruption by government officials but you should not mix that up with the process of elections. Remember that the petition at court is only a petition with allegations that are to be proved. The fact that you have decided to swallow, in one gulp all, the allegations does not mean that the SC must overturn the declared results. The SC is there to examine all the allegations, go through all the evidence placed before it, and at the end of the day tell Ghanaians whether the allegations made are sufficient enough to have benefited only one person.
Your wishes are yet to turn to horses so do not attempt to fly.

TABLE OF IRREGULARITIES IN THE PETITION
The NPP is quick to request that the SC annuls results from polling stations because of alleged errors in summing, or figures and words not conciding. These requests are made on the expectation of a flawless action on the part of 26,002 presiding officers, giving these officers not a single margin of error. I do not know how many people sat around a table to draw up and cross-check the sum of all the irregularities in the "table of irregularities as presented in pages 2 and 3 of the petition. But I know one thing: That given a single clolumn to sum, these legal brains, economists, statisticians and what have you, could not properly sum a single column made up of 23 figures. They FAILED in that simple test. The SUM of the irregular votes IS NOT 1,343,845 as stated in the plea BUT 1,343,047. There is no issue of a typographical error here, because the quoted figure is written in WORDS in section 21 of the petition. Should the SC declare invalid the petition because the NPP have not been able to sum correctly their own tabulation?
Craftily, the NPP managed to make the wrong figures they summed tally somehow with the amount of votes that were supposed to be deducted from each candidate. How were they able to do that?
Over the period since December 7 leaders of the NPP have done nothing more than demonstrate their basic mathematical incompetence. And they have done this right through a serious petition in the supreme court. Sadly they expect an impecable performance from 26,002 presiding officers.

Just talking about AFrica democracy from wherever the history may or may not find its feet and later talking about the election results which she wants us to agree that NDc rigged and to end it anyhow she deviated to talk about corruption and even accused whoever she has in mind of sharing money which would have been used to provide quality education.
This person must voice those receiving so-called shared money of about 2% of GDp which can use to provide free education so that the police can arrest them.this a ghost and flattering criticism which can't find its feet in current politics.
This person ignorantly stated, some polling stations re-opened the next day because of faults with some verification machines. This was not the main reason that is some of the polling stations had to reopen the next day. Some of the machines and ballot papers arrived late and so they got long queues who couldn't vote on that very day. Rainfall also disrupted some constituencies and they had to re-arrange for the next day.
In fact, it wasn't the intention of the EC for some machines to get faulty. Even when such problem arose, all the peace councils and bodies in the country agreeded for the voters to cast their votes without the verification except Akufo Addo who disgreeded because he knew in advance he would lose and he would base on to make excuses and cause chao in the country.
