Court strikes out motion against spiritual head of Saviour Church

An Accra Fast Track High court on Tuesday dismissed a motion brought before it by the registered trustees of the Saviour Church of Ghana to set aside judgment delivered in favour of the Spiritual Head of the Church, Elia Asirifi Dadeako.

The court, presided over by Justice K.A. Ofori Atta, awarded 500 Ghana cedis cost against the registered trustees of Saviour Church of Ghana.

According to the court, the motion could not be granted because it had no merit to declare the judgment null and void for the defendants led by Mr Abraham Adusei. The court said the judgment was given by a competent court and had no option than to dismiss the motion filed by the defendants.

According to the court, at the time judgment was given, no appeal had been filed at the superior court and therefore, could not be set aside as being demanded by the registered trustees of Saviour Church.

It would be recalled that in 2010, the spiritual head of Saviour Church of Ghana filed a suit at the Fast Track High Court to challenge the legitimacy of the1994 Constitution of the church claimed by the registered trustees as governing document promulgated by the Founder and Leader of Saviour Church of Ghana, Opanyin Asirifi Dadeako.

In the same suit, the court endorsed the Spiritual Head of Saviour Church of Ghana as the legitimate owner because it had been registered at the Registrar General's Department with the incorporation of 1963 Company Code.

The court ruled that it dismissed the motion because it wanted to maintain the independence and proper accountability of the judgment.

According to the court it dismissed the motion because it wanted to ensure that the 2007 High Court ruling delivered in favour of registered trustees was obtained through fraud.
