KKD didn’t pin Effe down for sex – Lawyers

The 19-year-old female student who claims she was raped by fashion icon Kwasi Kyei Darkwah (KKD) was never pinned down or physically restrained in anyway by the renowned broadcaster during their sexual intercourse, Counsel for Mr Darkwah have said.

In a motion filed on notice at the Human Rights Court on Wednesday December 31, 2014 to secure bail for the 49-year-old father of two, who allegedly raped Awuraffe Orleans Thompson in the bathroom of a suite at the African Regent Hotel on December 27, KKD’s Lawyers said: “…The facts do not show that there was any physical or verbal threat of harm or physical restraint used to compel the victim to have sex with the accused, yet the prosecution contends the use of force.”

The CEO of the Finest Productions was officially charged with rape on Tuesday December 30, 2014 and has been in the custody of the Airport Police Command since his arrest.

According to the charge sheet presented to the court by the state prosecutor, KKD “on the 27th day of December 2014, at about 9 o’ clock pm at the African Regent Hotel, Accra in the Greater Accra region, and within the jurisdiction of this court, did have carnal knowledge of one Ewuraffe Orleans Thompson, a female aged 19 years without her consent.”

The District Magistrate Court presided over by Mrs Adwoa Akyaamaa Ofosu denied the fashion icon bail. The prosecution was led by ACP Atimbila.

Rape is a non-bailable offence in Ghana’s statutes. A convicted Rapist risks between five and 25 years.

KKD’s Lawyers have, nonetheless, filed an application at the Human Rights Court to secure bail for the broadcaster.
