I think Kennedy is not getting the argument. Calling for a pardon a day after the sentencing is just a way of setting aside the court's ruling. Those calling for presidential pardon may not see it as such but that is exactly the implication should they pressure Mahama to invoke article 72. We all agree people have been pardoned by various presidents but were those circumstances similar? Has any president been forced to take such decisions? Has any president ever used the provision to free his party men? If even the pardon was the right thing to do, the guys should have been made to serve some time then the president can come in to intervene. But the nature of people calling for the pardon, the political colour of the contemnors and the alacrity of the demands clearly shows that invoking article 72 will not serve national interest. That is why Tony Lithur lawyer to president is against it. If the president should free them then those who are serving prison sentences also deserve the pardon. The president should just free all prisoners. If these people are pardoned then the court will lose the authority to ever sentence anybody to prison on contempt or the president will be ever bound to free any future contemnor in order that he will not be seen as bias. Is that what we would want to put our president through? No. So just let them serve their sentence so the if opposition communicators find themselves in a similar situation in future they will not have a problem with the court ruling. Four months as opposed to the 3 years allowed by the constitution is not harsh as people want to perceive it. I think the lawyers who pleaded are ingrates because they should be happy since their plea was able to reduce the sentence from 3 yrs to 4 months.

following your line of reasoning, can it be argued that retired Justice Henrietta Abban[ then an Appeals Court Judge] turned herself into a Dictator, by ignoring hitherto accepted court rules and procedures, conventions and ethics, by unceremoniously and deliberately throwing Tsatsu Tsikata into jail?
So was fmr. Kuffour's pardon granted to Tsikata, be considered an INVATION or attack on judicial independence?

The Head of State of Ghana has the constitutional right as well as moral right to think of and decide to exercise any pardon as Kennedy clearly outlines.Lawyers are important in every sphere of our activities in both life or death. Other professionals, like lawyers, and unlike the medics, have duty to the society even in death. But lawyers have taken all the social space in our country by the so called "learned" principles they adapt. Why do lawyers defend murderers and very stinking criminals. This is because there are two sides to a coin or better still,the principle of "two-ism" -male and female; positive and negative; up and down et cetera.
So, the president "can" use the pardon or 'un use' it. Why then do Lawyers who brag that their profession alone is learned and noble wade into matters that have not taken place? Almost all the woes of the nation can be safely but severally placed at the doorstep of lawyers.Please don't intimidate the President. Let him decide for himself as well as in the supreme interest of dear Ghana. Nana Bediatuo and uncle Okudzeto are fine big thinking men!
