NPP followers never want to play fair. They always try to find a way to get the Supreme Court to rule in their. A clear example is this contribution by Professor S. Kwaku Asare. If such distortions are coming from a so-called Prof, then you can imagine the thinking of the down-trodden NPP members who live on cassava and stew made with grass cutter shit for meat must be like.
After losing miserably at the polls NPP are now fishing for any conceivable technicality to annul some votes to give them victory. How can people be that evil to the extent of seeking power at the expense of the security of the state?
I always doubt if education is useful to Africa. If a professor can stoop this low to engage in such baseless misinformation which is geared at inciting gullible members of the public to reject the SC'S decision is most regrettable. An African professor is worth less than watchman at a faculty in a European university. Not that we are not as intelligent as Europeans, but the difference is just our ATTITUDE! What makes an African professor to embark on such distortion of facts in order to mislead the less educated is down to attitude and not lack of intelligence. Whatever intelligence God has given us is used purely for evil, as Professor S. Kwaku Asare has done! I feel sorry for the so-called Prof for failing to be a source of enlightenment to society but has chosen to be the generator of misleading lies, distortion of facts to create division, intolerance, hatred, chaos, rancour and bitterness. Shame to Professor S. Kwaku Asare!

Atuguba told Bawumia that he was a doctor and therefore had to answer questions well. What about Afari Gyan, is he not a doctor and is he not the EC. When he could not answer the simplest question - what is over-voting what did Atuguba tell him?

It is about time he treated all parties fairly,for he, the presiding judge cannot bring the Supreme Court of Ghana into disrepute. He has been the calming influence in this case and has only crack the whip where necessary. If not, Lawyer Addison should have been sanctioned when he lied in open court about the interaction he had with the justice in chamber only to come out in open court to lie. This contemptuous conduct even drew the irk of Justice Baffoe Bonnie.

If Kwaku can not see that it is the responsibility of the president of the panel to ensure decorous language and civility in the court room then we can not take him serious.But my surprise is how can some one trained to be fair and balance in his assessment descend so low because of political bias ans expediency.Surely this man is a disgrace and a dishonest intellectual.

I don't have any problem if any member of that accursed and greedy class honestly criticizes any member of the panel but to attack them on grounds of bias and unfairness just because you disagree with him or her is not only irresponsible but malicious AND contemptuous.
I have always believed that this country is in mess because of the criminal and nefarious activities of the educated class. Prof Kwaku Asare is a prime example.

When I watch the on going supreme court case, I cringe on seeing open display of incompetence, disorganisation of proceedings, lack of procedural controls by the supreme court judges (the supreme court judges led by Atuguba are ASSUMING parties in the case follow professional ethics which they are subjectively applying).
The supreme court judges lack of administrative competence and efficiency which can win or lose a case is very very appalling. Iam dispointed by the lack of administrative controls, procedural controls and open open display of lack of control mechanisms in the Ghanaian judicial systems. If there were effective administrative control systems, KPMG's involvement wouldn't be necessary, the level of mistrust in handling exhibits wouldn't be high, the current level of disorganisation (as all parties might have been provided with procedural code of conduct in addition to the assumed professional code of conduct)
The supreme court judges attitude and behaviour administratively if what prevails in the whole of Ghana where Ghanaian leaders operate on assumptions of decorum but not to agreed and well spelt out procedures and standards. That is why we are underperforming.

The greatest blame goes to the Chief Justice, Georgina Wood, for picking Justice Atugba, a pro NDC, as the presiding judge. The fact is, as soon as the NDC came to power in 2008,one of their first agenda was to vilify,threaten and insult Chief Justice Georgina Wood accusing her of leaning towards NPP and also accusing her of corruption. At that time,the crescendo of ugly noises from the NDC against the Chief Justice reached its apogee as they begun to call on her to resign. All those wicked and vain NDC attacks on the Chief Justice have, in fact, had effect on her to the extent of being petrified into pusillanimity, enfeeblement and emasculation. It is therefore no surprise that she timorously picked Atugba whose cousin is at the office of John Mahama to be the presiding judge despite the clear possibility of conflict of interest, nepotism and tribalism. The shameless bias that has been exhibited by Justice Atugba so far in the petitioner's case is seen by all and posterity will judge him severely. If anything at all, he should have at least been wiser and taken firm and fair stance in the proceedings. Justice Atugba must remember and learn a lesson that the NDC who trace their roots to the PNDC, under whose reign that his professional colleagues, the 5 justices were brutally murdered committed no crime except that they tried
to administer justice without fear or favour. This time should have been the golden opportunity for Justice Atugba to show that he and the other justices cannot be intimidated and they will dispense justice without caring about whose "ox is gored" in solidarity with their fallen colleagues who died as martyrs of justice. Incidentally, the anniversary of the murdered justices is at the corner--June 30.

I share your sentiments, but I believe that the Chief Justice put forward Atuguba's name for a purpose. She rightly did not include herself because one of her blood reltives is married to one of the petitioners.
She put Atuguba forward, hoping that he would decline it, but the man is not a decent man. There would have been a hue and cry from the NDC if Atuguba as one of the most senior judges was not included on the panel in such a landmark case. Now that he is disgraacing himself for the world to see, the CJ has been vindicated.
This is what happened with Kpegah and he is peeved with anything NPP. He was rushed through the system on tribal grounds by the P/NDC, from a lowly regional magistrate judge to the High Court, the Appeals Court and finally Supreme Court. Then he found himself acting as CJ, hoping to be confirmed. Akufo-Addo as A-G rightly refused him that honour because he was NOT qualified for it. And that has been his ire since.

All the judges have a leaning one way or the other but when it is so blatant, in any civilised society Atuguba would do it himself or be made to do so by conscientious objectors. His outburst when the Petitioners raised their doubts at the outset was a dead give away to me. He ought to be ashamed of himself for staying true to type, but as typical as it is with the Ghanaian, he will shamelessly pontificate and will have millions more to cheer him on. And what does one expects a there are many more millions like him, in fact almost everybody is like him I should say.
In this case he and all the judges have failed themselves in no small measure. I am not impressed with them 'one bit' to borrow Addison's expression. And the mind boggles as to why these judges would not take the opportunity with this to blaze the trail by actually dispensing true justice and be rewarded by posterity with a name in the books in similar manner as you read of the good and the great of say …. (fill in the blanks, Gordon of Khartoum for me, had I been English, a paradox I shamelessly admit to, as one would being a Ghanaian). The SC judges come across so ordinary and I am saddened that they have made a dog's dinner out of this, when it presented the opportunity to set an example in society which is lawless to all intents and purposes!

The whole world has seen him for what he is, and if Ghana goes up in flames, he will be the one to blame.
Yes, Ghana boasted of excellent judges in times past- Sir Arko Korsah, Justices Akufo-Addo, Koranteng Addow, Arkodie Addo, and many others. The Atugubas and Kpegahs are just a blot on Ghana's legal landscape.

It was said during the election wrangle between Al Gore and 'Dubya' in 2000, that, a Justice (Scalia or whatever his name was) tipped it in favour of Bush in the end because his daddy put him there but this was when all was said and done. Before then, I followed the press reports and not a whiff of where it was all going to go, considering AL Gore had succeeded at every turn at state level. In the end when the judgement came it was Al Gore who caved in, rather than the SC ruling against him. And had he been inclined to fight on, there was room made for him. The State of Florida was asked to set a common standard to do the recount. The then status quo of different counties adopting different standards of counting the various chads - hanging, pregnant and what have you was deemed 'unequal treatment' of the voter. Incidentally the argument there applies in the Ghanaian case with the NVNV vrs the right to vote itself,and I am sure it would be explored at a later date after the verdict. For now my point is, as biased as the judges may have been you couldn't tell until the verdict came. This is what sophistication which comes with intellectualism is all about.And really Atuguba's pathetic jokes don't cut it with me either, it is a ruse!

I have posted elsewhere that the man's demanour, utterances and command of the English language are so awful it is difficult to see how a mna like that managed to reach the high office of a judge of the Supreme Court of Ghana!
Tsatsu kept referring to Dr Bawumia as being dishonest for no just cause and the judges simply looked, until Addison rightly reminded him about his standing in Ghanaian society.
Let us hope that the other judges have seen Afari-Djan for the evasive, mumbling liar that he is. How can a man who claims to have seen elections around the world for 20 years not be clear in his mind as to "what over-voting is."

If indeed he and his team are looking for the truth they could compel the EC to produce the original documents in contention to court so that they match those with what the petitioners have filed with the court so that if there is no merit they dismiss the case. Why I am saying this? as a lay man common sense will agree with mine submission. When Tsatsu Tsikata and other respondents were doing their cross examination the bench were lenient with them and even with his request for the count of the pink sheets was hurriedly granted and look at how the bench is trying to frustrate the petitioners council to the extent that Justice Atuguba in open court could say that the unwillingness of Tsikata & co to make known the pink sheets they are missing is their strategy. If the court fails to unravel the truth, the truth will surely and eventually emerged no matter the suppression.

To make matters worse I have goose pimples all over my body when that learned man Mr. Addison rises up to begin cross-examining Dr. Afari-Gyan. I initially believed we won the election but with all these evidence and our inability to refute them, guys, I am in a limbo. What's more...the law is the law! Kwadwo did not do his work well and that is going to cost us the jubilee house for four years or possibly 8 long years! Just look at how he keeps contradicting himself when that learned man Addison produces a pink sheet! The EC in my candid opinion came to this battle ill- prepared!
Honestly I wish these NPP guys had not taken this case to court in the first place. I thought they were throwing their weight about and I was so confident the case would not survive beyond round one. However from the look of things we have a mountain to climb since our own Tsatsu, in an attempt to belittle their case rather made it stronger by admitting over voting in their stronghold. I ask... why did he do that? This legal reason of attempting to show bad faith was in bad judgement! He should have weighed the risk of failing to achieve that goal as against making a case in support of them. Now look at where he has positioned us.
The EC, which I thought would help us are also messing themselves up! Where are we really going? I am worried! Really worried for our party 'cos we have very good lawyers but it appears our good lawyers are defending a very very bad case and it appears to me a journey to nowhere!
All our lawyers sought to do was to point out their mislabeling, dups', trips', quads', sextups' and quintups' (.....plications) .....nothing else to show for! I expected Tsatsu to delve deeper into their so called analysis and expose truly, how they are mathematically challenged! Rather we are there challenging pink sheets filled or not and/or not supplied to us by the courts registry. These NPP guys have made a case against us....STRONGLY....and we are here attempting to win the case on technicalities. Guys, let us call a spade a spade! We cannot win on technical grounds. If we would, the case should have been out of court since!

Is there a way of stopping this Mr. Phillip Addison? Have we not got better lawyers than the crop we have at the moment to face Mr. Addison? See how confident he is conducting his case. He appears too much in control of affairs at the supreme court and Tsatsu and Lithur sit aloof and can't say jack to him! My world... why do they sit in court? Recently you only see them up in court when there is a contentious pink sheet in the realms.

Initially, the NPP did not like the inclusion of Justice Atuguba on the Panel and he is proving them right with his biased rulings and comments.
Judging by their comments, the NDC supporters are openly VERY happy with Judge Atugubah. That alone tells its own story.

Afari Gyan then becomes the next target. This man seems to have iron balls and to me has acquitted himself very well. i think the petitioners have also realized they can have their way with 'iron balls'. in the face of a crumbling case, they have gotten another scapegoat, Atuguba, who they will stand on and accuse the panel of eminent judges as being biased.

What the learned Professor omitted in his article is the fact that Justice Atuguba's brother or close relative serves directly under the socalled president of Ghana. In that sense, a wise, clever, humble, modest and God-fearing Justice (like Justice Atuguba) shou;d have stepped down from this process altogether.
I wonder whether Justice Atuguba has ever hear of CONFLICT OF INTEREST during his study of law.
If the good Justice Atuguba refuses to setp down from this process, everybody in Ghana and in the rest of the world will know JUSTICE ATUGUBA as a MARKET LAWYER. He might have also obtained his law degree just the way Mr. John Dramani Mahama claims he obtained a Master Degree from Russia ??
