How about the speed the other vehicle was driving? Without details, we should not believe anything. It may well be the fault of the surviving driver who may have been over speeding and therefore was unable to stop.
Even if there were no U-turn sign to say no u turn, it does not mean it was the passenger driver's fault entirely.
