The Supreme Court judges do not have a thick skin. Citizens must have the right to challenge and pass comments about proceedings and ongoing cases at the Supreme Court. The downside of this behaviour is that Ghana is a very primitive country with weak law enforcement agencies. The 2012 election petition at the Supreme Court can easily spiraled out of control. Yet, no matter how obnoxious a comment may be, nobody should be jailed because of comments passed about the case.

But note the facts - he did make the remarks, but made them before NOT AFTER the line had been drawn and final warning issued by the whole SC. His recording was REplayed and a report made in a newspaper AFTER the final warning. The newspaper only published a correction the Tuesday court was back in session - by which time the alleged offender could only mount a defense of denial.
So you see even a mere you didn't have the full story before feeling like debating with idiots

Good that you are in New York. I will advise you to get a book titled "Gideon's Trumpet" authored by Anthony Lewis to read. A poor person by the name Clarence Earl Gideon fought from prison and made his case opened by the Supreme Court of USA to revist a ruling which the Judges had made previously. This poor individual with no legal back ground was able to tell his mind about a system where the poor were deny an attorney to represent them in their cases. It was Mr. Gideon, that is why today in USA, nobody would stand trial without an attorney either you are poor or rich.
Prof. Asare is throwing light to the dark pathway of those who want to reach their destination successfully. If the Ghana Law School is lucky to have about 10 lecturers of the sort of Pro. Asare, believe you and me, the country will be blessed continously with seasoned lawyers and not that of quack ones in our midst today. Enjoy your 4th. E&OE.

We are free to speak but must excercise that freedom responsibly and not make contemptible statements with reference to a case being heard at the Supreme Court. It is a serious matter accussing the Judges of bias when they have not even rendered a decision. Some people must be taught a bitter lesson.

It is the same stupidity that the thugs on Supreme court are doing; reading something from a journalist and believing it hook, line and sinker without ascertaining whether it is true or not before charging the person. That is the idiocy going on in Ghana and yet when someone rises up and take them on, people like you have the audacity to insult them.
Had Boahene not brought a newsapaper to show these clueless and stupid judges on SC, that the paper had withdrawn its story, the judges would have jailed an innocent man. What if the paper had retracted their message yesterday, would the Judges go and apologize to Boahene for putting him in prison without doing a due process or verifying the story.
Do you see how stupid the case is? If they want to charge someone, the least they could do was to investigate the case and found out whether Boahene was at the FM station on that day and said what was reported. This is what Asare is saying and yet, you did not even read to understand anything but to insult him.

A journalist, is angry with the behavioural attitude of the Supreme Court concerning the on-going electoral petition and jailed 10 years for contempt. A second culprit, rescind his previous damaging words against the (SC), and rather given a 3 days jail sentence and released because he became remorseful.
All that the law professor was, is saying is that, if this is how meaning is given to the law(s) of the land or adjudicated, then what the Supreme Court did, is doing, is unconstitutional because such an orders is a character of the military.
This is all that the law professor was trying to get across. So what part as a Ghanaian, don't you understand?

How about the suggestion that the peoples' representative limit the powers of the Judiciary through an Act of Parliament when it comes to free speech? I did agree with Professor Asare to a large extent but his suggestion of a Military takeover as a resolution to a constitutional issue discounts his credentials as an astute constitutional scholar.He's supposed to be teaching Law in the U.S.A.and disagreements come up all the time in that country that warrants clarifications from the Supreme Court.We don't hear from constitutional scholars suggesting a military takeover by the powerful U.S. military.So where does this so called constitutional scholar get this outrageous idea from,huh?
Those who claim such highfalutin titles should not demean their claims by loosing site of common sense.

All the same it important to remind him that though the constitution guarantees freedom of speech and expression,that freedom is qualified and has limits.
Over the years, the courts have decided that a few other public interests for example, national security, justice or personal safety override freedom of speech.
