The circumstances surrounding counsel’s withdrawal from a criminal case immediately before judgment, followed by his subsequent return to pursue an appeal after conviction, raise legitimate questions about professional ethics, procedural fairness, and the administration of justice. A lawyer is entitled to withdraw from representation where there is good cause and where the applicable professional and procedural requirements are respected. However, withdrawal at a critical stage of proceedings should not prejudice the accused or undermine the right to effective legal representation. The subsequent filing of an appeal is, in itself, neither improper nor unethical, as an accused person has the right to challenge a conviction through lawful appellate procedures. The central issue, therefore, is whether the withdrawal was justified, properly communicated, and conducted in accordance with Ghanaian professional rules. Wontumi's counsel, Appiah-Kubi conspired with others in the NPP at the end of their case in chief hoping to delay the judge from rendering his/her vedict. In the criminal mindset of the NPP, they had hoped that if and only if the case could be delayed to offer the time for Wontumi to win the contest to become NPP's national chairman then perhaps the courts may be reluctant in sending Wontumi to prison even if convicted.
For Appiah-Kubi to return to the "crime scene" is to understand the disdain the NPP has for mother Ghana and state institutions. These are not men of honor, principles, morals nor foresight. A nation that has lost its moral compass can never regain its brand and the Christian God will never bless its leaders; especially leaders who are every bit cunning and deceptive as the serpent in Garden of Eden.
